NATIONAL CONSUMER REDRESSAL FORUM
IN
KOLKATA

Date & Time of Visit - 31st JULY 2019


Purpose of Visit

The purpose of the visit was to understand the working of a tribunal and a District forum, the
nature of duties of the judicial officers. The visit was to help us understand the role of court in
dispensing justice in any case, the role of prosecutors in a case, the way cases proceed in a
court, the way magistrate, prosecutors and defense lawyers handle the case, the relationship of
the prosecutors and the consumer This gave us an opportunity to understand the actual need
of co ordination in the four pillar of the alternative justice system The visit included an in-depth
study of the day to day functioning of the District tribunals, at different levels and over a vast
variety of cases. The aim was to evaluate the resources available and the distribution of power
between the magistrate, the prosecution, and the defense council.

INTRODUCTION

TRIBUNAL - A TRIBUNAL is an institution that the government sets up to settle


disputes through a legal process. People come to court to resolve their
disagreements. Did Bill Jones run a red light before his car ran into John Smith's,
or was the light green, as he says it was? Did Frank Williams rob the bank? Courts
decide what really happened and what should be done about it. They decide
whether a person committed a crime and what the punishment should be. They
also provide a peaceful way to decide private disputes that people can't resolve
themselves.

DISTRICT TRIBUNAL– The DISTRICT TRIBUNAL of India are presided over by a


judge. The administer justice in India at a district level. These courts are under
administrative and judicial control of the high court of the state to which the
district concerned belongs.
Prosecutor - The prosecutor is the chief legal representative of the prosecution in
countries with either the common law adversarial system, or the civil law
inquisitorial system.
Prosecution - The prosecution is the legal party responsible for presenting the
case in a criminal trial against an individual accused of breaking the law.
Defense lawyer – A defense lawyer is an attorney that represent an excuse party
in a legal matters, including in a court of law, the accused party is known as the
defendant, hence the name is the defense lawyer.

KHADYA BHAWAN DISTRICT TRIBUNAL

The Building of DISTRICT CONSUMER FORUM Complex completed in the pre independence
period. This is one of the modern operational District Courts building in Kolkata. Presently cases
pertaining to west and north-west District are dealt with at Barrackpore District Courts
complex.

At present the following courts are functioning at the Barrackpore District


courts complex:

1. RETIRED CIVIL JUDGE .


2. RETIRED DISTRICT JUDGE /ADDITIONAL SESSION JUDGE.

Structure of the Tribunal room


The tribunal room is a hall consisting of a raised pavilion which has a podium for the Honorable
Judge with his Reader and Steno sitting on either side on the same podium.
On a pavilion comparatively lower to that of the Judge there is a witness and an accused box
but as informed is not being used. In between the two boxes the typist sits who types all the
statements made by the witnesses.
The prosecutor and the defense counsel stands on the bench near the typist.

Functions of forum room staff

Reader to the Honorable judge: She maintains all the case files of the cases being heard in
the court and prompts the judge with the various cases and other documents.

Steno of the Honorable judge: Records the orders of the Honorable judge.
Typist: Types each and everything going on in the court room.

2 Police Station Visit:


SHYAMPUKUR POLICE STATION.
IN KOLKATA

Date & Time of Visit – 19th JULY 2019

Purpose of Visit
Following were the objectives for our visit to police station:-

• To understand the structure of Police Station,


• Nature of duties performed by police officer,
• Hierarchy of police officials,
• Knowing about case diary, maalkhana etc.,
• To see the functioning of Police Station
• To observe how FIR is lodged,
• Community policing role and progress,
• Trends of crime and nature.

INTRODUCTION

The necessity to maintain peace and keeping law and order in the society led to
the
Establishment of law enforcing agency in the form of Police. The word “police” is
Derived from a Latin word “politia” which stands for state or administration.
Article 246
Of the Indian constitution has made police a state subject but Kolkata Police
comes under
Concurrent list and functions under Central Government.
The visit to Shyampukur Police Station have changed my opinion regarding
police stations. They have one of the most advanced administrative systems in
India. The Police is undertaking the following activities:-
• Preventing the crime
• Controlling criminal activities
• Arresting the anti-social elements
• Maintenance of law and order
* Maintaining peace and tranquility
* Women protection
 Controlling traffic

PHYSICAL OBSERVATION

On entering the premises of the police station I observed the following thing:-
1. Reception: On the left hand, as we entered the main gate inside the station, there

Was a reception which consisted of a big wooden table. It was headed by a Constable. It is a
place from where the complaint is directed to the respective duty officer. No FIR is lodged in
this section but only the entries are done.

2. Women Help Desk: To make the women feel secured and comfortable, a separate

Women Help Desk has been created. A lady constable is present at this help desk
Who deals with the women who are either complainants or needs some information.

3. Duty Officer: Duty officer is a person who lodges the FIR and tells the respective

Officer about the report. He maintains the daily diary and puts entry in them. In case
Of cognizable offence, he lodges FIR (First Information report) while an NCR (Non
Cognizable Repot) is filled in case of non cognizable offences. He also maintains the PCR calls.

4. Police Maalkhana: It is one of the most important parts of a police station. It is a

Room where case property is kept. A proper register is maintained for this purpose
and this is done by Moharrer Head Constable Malkhana i.e. MHC. These items
are collected from the place of crime and are maintained for further trial. These
Items send to Forensic labs for testing.

5. Investigation room: There is a room in the police station where a person


weather.
Accused or witness can be detained for some time by the investigation officer for
the enquiry.

6. Record Room: All files are maintained here. The record of various offences and

There details, PCR call record, bail register, FIR record and other information are
maintained here.The registers are given no. and designated by those no. only for example
Conviction record is maintained in register no.- 5, criminal record is maintained in
Register no.-9.

7. Police Lock-Up: There are separate lock-ups for male and female. It is two in

number. A proper sanitation facility is there. Rooms have sanitation facilities but no
switchboards or fans, nails or any sharp edges which might help to commit suicide or harm
themselves in any form. There was a board on which the pictures of criminals with their details
were printed. A Notice board for officer’s direction was also located. There was a map also on a
board which depicted the jurisdiction of the police station. Different registers were maintained
for different purposes.

maintained in a lawyers’ chamber for one
week in civil matters and one week in
criminal matters.

INTERNSHIP EXPERIENCE

Interned from 5th March 2021 to 30th March 2021
Monday to Saturday from 11 am-5 pm
3. Office and Team Strength:
The office of Advocate K. P Tiwari is located at 5, Kiran Shankar Road, near High
Court.
He was extremely professional and the office was cozy and decked with good
books.
A wide array of law books was very helpful in legal research.
The team strength was good, around 7-8 people.
4. Accommodation and Location:
The office located at 5, Kiran Shankar Road, near High Court. Its nearby my home.
Its a 10 minutes walking distance from Esplanade Metro Station.
The people at the office were very warm and receiving.
5. First impression and Experience:
Advocate K. P. Tiwari personally calls interns and takes an interview.
He is extremely polite and very knowledgeable.
First day at work was very nice, interns were given good amount of work.
6. Main tasks:
We were given around 20 cases during the period of internship and we had to
study and summarize the same.
Also, were taken to the Calcutta High Court, city civil court, Alipore district court,
Family Court and Bankshall Court to watch the proceedings.
We also had a chance to observe techniques of cross examination.
There were a lot of interesting cases on family settlements, matrimonial disputes
and so on. We got a chance to interact with several lawyers.
The seniors and all the people from staff were extremely cooperative and friendly
and we could always approach them with our doubts.
I met a lot of clients, took notes while cases were discussed and also attended
counseling sessions.
Sir would often advise us on cases and handling issues like confidentiality.
It was a brilliant first hand exposure regarding meeting clients and handling
disputes.
7. Work environment:
Work Environment was really good.
Peaceful and very interest generating.
Clients coming and going made us inquisitive as to what their cases were about.
The working staff was also extremely helpful.
8. Chill time with Colleagues:
There is no dearth of places to hang around and chill and as always, the amazing
street food in Kolkata makes it even more awesome!

Interns come from various colleges starting from Jogesh Chandra Chaudhary Law
Collage to Surendranath law college.
9. Stipend:
No stipend was given.
10.Overall Experience:
It was a brilliant learning experience and I would highly recommend it for all
aspiring Lawyers.
It would be an amazing start up for all as the advice, first hand exposure and
involvement was invaluable.
The healthy environment greatly promoted learning and I would easily rate it as
one of the best internships I’ve done so far.
