APPLICATION FOR THE RELEASE OF THE ORIGINAL DOCUMENTS OF

PROPERTY NO. E 15 B & 16 KHASRA NO. 19/13, CHANAKYA PLACE, NEW
DELHI.

MOST RESPECTFULLY SHOWETH:

1. That the original documents of Property No. E 15 B & 16 Khasra No. 19/13

Chanakya Place New Delhi measuring 200 Sq. yards was seized by the
Investigation officer of the case vide seizure memo dated 16.08.2019.

2. That the First chain of the Original documents wherein the above said
Property was Sold by the daya Dutt to Mukhtar Singh vide GPA dated
14.09.1988 which runs into 6 pages was send to FSL.

3. That the remaining original documents/ deeds are there in the court file and
not required for any further investigation.
4. That the Remaining Original Documents are as below:-

a. GPA dated 20.04.1989, running into 6 pages in favor of Smt. Sharda

Gupta From Mukhtar Singh.

b. GPA Dated 23.08.1989, running into 6 pages in favor of Sh. Vinod

Kumar from Smt. Sharda Gupta.;

c. GPA Dated 23.12.1994, Running into 11. pages in favor of Sh. Om

Prakash Manchanda from Sh. Vinod Kumar.

d. GPA Dated 18.06.2010, Running into 13 Pages in favor of SH. Naresh

Kumar from Sh. Om Prakash Manchanda.

e. GPA Dated 21.01.2011, Running into 12 Pages in favor of Smt. Sunita

Saluja from Sh. Naresh Kumar.

f. GPA Dated 12.12.2011, Running into 12/Pages in favor of Smt. Krishna

Devi from Smt .. Sunita Saluja.

5. That only First Chain of documents send to FSL for Expert opinion.

6. That applicant further undertake to abide by all the terms and conditions to be
imposed by this Hon'ble Court, while releasing the above mentioned documents
on superdari to applicant.

7. That the Applicant undertake to present before the Hon'ble Court as and when
required by the Hon'ble Court.

PRAYER
It is therefore prayed that the abovementioned documents mentioned in Para
No. 4 of the Application may kindly be ordered to be release on Superdari to the
Applicant in the interest of Justices.

Reply of IO received. He has no objection if aforementioned
documents are released to rightful owner.'
 lt is mentioned in the application of applicant that he /she is the
rightful owner of the aforementioned documents.
In view of decision of Hon'ble High Court of Delhi in the case
titled as "Manjit Singh Vs. State", Crl. M.C. No. 4485/2013 and Crl. M.A.
No. 16055/2013 decided on 10.9.2014, concerned IC is directed to release
the aforementioned documents in favour of rightful owner subject to
following conditions:-
1. a detailed panchnama be prepared in respect of aforesaid documents.
photographs of the aforementioned documents.
2. Photographs of the aforementioned documents be obtained.
3. IO to obtain a security bond as per the valuation report of the
aforementioned documents.
4. photographs of the aforementioned documents be attested and
countersigned by applicant, complainant and accused.
5. Production of panchnama and photographs of the aforementioned
documents during trial would suffice for the purpose of evidence and
production of said aforementioned documents shall not be insisted.
The panchnama report alongwith photographs be filed alongwith the
chargesheet.

APPLICATION TO DIRECT THE COURT AHLMAD INSTEAD OF
INVESTIGATION OFFICER TO RELEASE THE PROPERTY PAPERS OF THE
ACCUSED WHICH WAS ALLOWED VIDE ORDER DATED 09.06.2022
MOST RESPECTFULLY SHOWETH:

1. That vide order dated 09.06.2022. Ld. Link MM direct the Investigation
officer to release the Property Papers of accused of property No. E - 15B & 16
Khasra No. 19/13 Chanakya Place new Delhi on superdari.
2. That it was directed to the IO in the above mentioned order to release the
papers to the Accused but latter it was found that the said papers are already in
the Judicial File.
3. That as the order is already there to release the Property papers of property
No. E - 15B & 16 Khasra No. 19/13 Chanakya Place new Delhi on superdari, it
is humbly prayed to direct the Court Ahlmad to release the papers of Property
No. E-15B & 16 Khasra No. 19/13 Chanakya Place new Delhi to accused after
making due endorsement.
4. That the Document which was sought in the application was
