After reading and understanding of Learning materials, then Answer the following
questions:
"The Constitutional Court plays a vital role in upholding democracy and the rule of law in
Indonesia." Discuss this statement, providing arguments and examples to support your
viewpoint.

Result :

The statement "The Constitutional Court plays an important role in upholding democracy and the
supremacy of law in Indonesia" is very relevant and true. As is the case in guarding the
constitution, the Constitutional Court (MK) has the responsibility to monitor and guard the
constitution, namely the 1945 Constitution of the Republic of Indonesia.

Thus, the MK plays an important role in upholding democracy and the supremacy of law in
Indonesia, because the constitution is the legal basis that regulates political and social life in this
country. such as when the MK has several times decided several cases related to the constitution,
such as the "Papua Case" which decided that the government must provide human rights to the
Papuan people. This decision upholds democracy and the supremacy of law in Indonesia because
it respects human rights and safeguards the constitution.

Apart from that, in maintaining state sovereignty, the Constitutional Court also has an important
role in maintaining state sovereignty. By monitoring and guarding the constitution the
Constitutional Court ensures that decisions taken by the government and legislature are in
accordance with the constitution and do not violate human rights. This was proven when the
Constitutional Court had several times decided several cases related to government decisions that
were deemed to violate the constitution, such as the case "The Case of the People Rejecting the
Suralaya PLTU Project" which decided that the government's decision to build the Suralaya
PLTU was not in accordance with the constitution. This decision upholds democracy and the
supremacy of law in Indonesia,\ because it respects human rights and protects state sovereignty.
And in enforcing the law, the Constitutional Court also has an important role in enforcing the
law in Indonesia. By monitoring and overseeing the constitution, the Constitutional Court
ensures that the laws implemented by the government and legislature are in accordance with the
constitution and do not violate human rights. As is the case, the Constitutional Court has several
times decided on several cases related to law, such as the "Corruption Case" case which decided
that corruption is a criminal act that violates the constitution. This decision upholds democracy
and the supremacy of law in Indonesia because it respects human rights and maintains security
and public order. In conclusion, the statement "The Constitutional Court plays an important role
in upholding democracy and the supremacy of law in Indonesia" is very relevant and true.
The Constitutional Court has an important role in guarding the Constitution, safeguarding state
sovereignty, and enforcing law in Indonesia. Thus, the Constitutional Court plays an important
role in upholding democracy and the supremacy of law in Indonesia.

However, the statement "The Constitutional Court plays an important role in upholding
democracy and the supremacy of law in Indonesia" can be debated from several points of view.
As in limited authority, the Constitutional Court has limited authority in upholding democracy
and the supremacy of law in Indonesia. The Constitutional Court only has the power to monitor
and guard the constitution, but does not have the power to oversee government and legislative
decisions that are not in accordance with the constitution.
