DEED OF SALE

THIS DEED OF SALE MADE ON THIS ____ DAY OF JUNE,


2024

BETWEEN

MATRISHA DEY, daughter of Jagadish Chandra Dey and Late


Anjana Dey, (PAN – DAGPD6453M), (Aadhaar No. 9868 8263
9266), aged about 28 years, by faith – Hindu, by occupation -
service, residing at Shibrampur, Kastadanga Road, P.O. ______,
P.S. Thakurpukur, District – South 24 Parganas, Kolkata –
700061, 2) JAGADISH CHANDRA DEY, son of ______ (PAN –
___________), (Aadhaar No. ___________), aged about 63 years, by
faith – Hindu, by occupation – retired bank employee, residing at
___________, hereinafter called and referred to as the
OWNER/VENDOR (which term and expression shall unless
excluded by or repugnant to the subject or context be deemed to
mean and include their respective heirs, executors, successors,
successors-in-interest, administrators, legal representatives and
assigns) of the FIRST PART.
AND
SRI SANJAY DAS, son of ________, (PAN – ____________),
(Aadhaar No. ___________), (M) – 94330 76500, aged about 55
years, by faith – Hindu, by occupation - service, residing at
28/35/6, Purba Para Road, P.S. Haridevpur, P.O. Thakurpukur,
Kolkata – 700063, hereinafter called and referred to as the
PURCHASER (which term and expression shall unless excluded

by or repugnant to the subject or context be deemed to mean


and include his respective heirs, executors, successors,
successors-in-interest, administrators, legal representatives and
assigns) of the SECOND PART.

WHEREAS Narayan Chandra Das, since deceased, the


father of the purchaser and grandfather of the vendor no.1 and
father-in-law of the vendor no.2 was originally owner of all that
piece and parcel of land measuring about 6 cottah 6 sq.ft.,
situated and lying in Mouja – Purba Barisha and being part of
J.L. No.23, R.S. 43, Pargana – Khaspur, Touzi No. 1 to 6, 8 to
10, 12 to 16, appertaining to Khatian No.483 and Dag No.3015
under Police Station – Behala at present Haridevpur within the
limits of South Subern Municipality former and presently within
the limit of Kolkata Municipal Corporation, Ward No. 124 by
virtue of a registered Bengali kobala, registered at the office of
Joint Sub Registrar of Alipore at Behala and recorded in Book
No. I, Volume No. 62 at pages 47 to ….. being Deed No. 3687 for
the 1963.

AND WHEREAS after purchase of the said land, the said


Narayan Das mutated his name in the record of Kolkata
Municipal Corporation and it became known as KMC premises
no. 2593 Vidyasagar Sarani and out of his own fund he
constructed a two storied building as per sanction plan no. …….

AND WHEREAS in the manner aforesaid, the said Narayan


Das was absolute owner of the said land measuring about 6
cottah a little more or less with two storied standing there at

situated and lying in ……, morefully described in the schedule


below and hereinafter referred to as the said property is free from
all encumbrances.

AND WHEREAS while the said Narayan Chandra Das was


seized and possessed of the said property he died intestate on
23.09.1993, leaving behind his wife Smt. Ava Rani Das, one son
Sanjay Das, being the purchaser herein and one daughter
Anjana Dey nee Das, since deceased as his legal heirs and after
his death his right, title, interest and possession in the said
property was devolved upon his aforesaid legal heirs equally and
thereby they became co-sharer of the said property having
undivided 1/3rd share in the said property.

AND WHEREAS the Smt. Ava Rani Das, filed a Title Suit
No.41 of 2006 before the Learned Civil Judge (Senior Division) 7 th
Court at Alipore for partition of the said property and
subsequently, the said suit was transferred to the Learned Civil
Judge (Senior Division) 2nd Court at Alipore and renumbered as
Title Suit No.49 of 2012 for final disposal and after hearing the
Learned Court was pleased to decree the said suit in preliminary
form, declaring the share of the said Ava Rani Das and her son
Sanjay Das and her daughter Anjana Das @ Dey, since deceased
has 1/3rd share, the ex-parte against the purchaser Sanjay Das,
which was challenged by the said Sanjay Das.

AND WHEREAS the said Smt. Anjana Dey died intestate


on 06.05.2021, leaving behind her husband Sri Jagadish
Chandra Dey and daughter Matrisha Dey as her legal heir. After

her death, her 1/3rd undivided share in the said property was
devolved upon them, equally and thereby they became co-sharer
of the said property, having undivided 1/6 th share each in the
said property.

AND WHEREAS the said Ava Rani Das by virtue of


registered gift deed dated 16.02.2023, transferred her
demarcated 735 sq.ft. more or less on the first floor on ……
along with staircase common reservoir and septic tank and
common area passage, which at mouja - ….., J.L. No. ….., Touzi
no. 483 ….. R.S. 3015 within the limits of Kolkata Municipal
Corporation, Ward No.124 being KMC premises no. …… 61
police station thereafter thakurpukur, …….. District ……
together with all rights and …… appertaining thereto with the
share of proportionate land morefully described in the schedule
below and hereinafter referred to as the said property.

AND WHEREAS the said Martisha Dey got 1/6th share,


equivalent to 372.50 sq.ft. a little more or less from her mother
Anjana Dey @ Das and similarly Jagadish Chandra Dey got 1/6 th
share, equivalent to 372.50 sq.ft. of the said premises no. 2593
Vidyasagar Sarani……….

AND WHEREAS in the manner aforesaid, the vendors and


the purchaser has the following share in the said property –
Matrisha Dey (vendor no.1) – 1/3 + 1/6 = ½
Jagadish Chandra Dey – 1/6
Sanjay De – 1/6

AND WHEREAS the purchaser proposed to the vendors for


sale of their jointly 2/3rd share in the said property being KMC
Premises no. 2593 Vidyasagar Sarani ……. Equivalent to 1490
sq.ft., morefully described in the schedule below and the vendors
have agreed to sale said property to him at or for the price for the
price of Rs. ……..

AND WHEREAS after sale of the said shares of the vendors


in the suit property to the purchaser, he will be absolute owner
of the said property.
