AGREEMENT

This agreement made and executed at Saddar Court Premises, Srinagar on this the
th
7 day of April, 2014 by and between:-

1. Abdul Hameed Bhat S/O Mohammad Sidiq Bhat R/O Budoo Bagh, Khanyar,
Srinagar Kashmir hereinafter called the Party No.1 ST (which expression shall mean and
include his legal heirs, successors, representatives, assignees, nominees and
administrators).

2. Iqra Qadir D/O Ghulam Qadir Laloo R/O Sathu Barbarshah, Srinagar Kashmir,
hereinafter called the Party No.2ND (which expression shall mean and include her legal
heirs, successors, representatives, assignees, nominees and administrators).

Whereas, the party No.1st is the real owner and in possession of three storied
building situated at Sonwar Bazar, Srinagar and the Party No.1 st has already rented one
hall measuring 15’x25’ in 2nd floor from the said building in favour of party No.2 nd for
carrying the business of Boutique & Cosmetic Items Only under the name and style of
“M/S HEAVEN ANGLES FASHION ERA”.

Whereas, the said building of the Party No.1 st may come at any stage under road
widening or Govt. may acquires the same and as such the parties hereto want to reduce
into writing the terms and conditions of this agreement in order to serve as evidence for
future.

NOW THIS INDENTURE WITNESSETH AS UNDER:

1. That, the Party No.1st has rented out one hall measuring 15’x25’ in 2 nd floor from
the above mentioned building situated at Sonwar Bazar, Srinagar in favour of
Party No.2nd for a period of 5 years w.e.f. 01-12-2013 and the Party No.2 nd is

running her business of Boutique & Cosmetic Items Only under the name and
style of “M/S HEAVEN ANGLES FASHION ERA” and to this extent a
document viz rent agreement has been duly executed by and between the parties
to this agreement on 16th of December 2013 duly registered by Sub Registrar
City Judge, Srinagar 16-12-2013.
2. That, in case the aforementioned building comes under road widening or in
acquired by the Govt. for any other purpose, the Party No.2 nd shall not claim any
portion of the amount or space given by the Govt. to Party No.1 st in the form of
rehabilitation or substitute site. However, if Party No.2 nd requests Govt. for any
relief in the context other than above or in the personal capacity, Party No.1 st shall
have no objection provided the said relief is not deducted or reduced from the
amount or space of the Party No.1st given to him by the Govt. in the form of
rehabilitation or substitute site.
3. That, the Party No.2nd shall not invoke any kind of judicial proceedings against
the Party No.1st for any compensation or rehabilitation or substitute of rented
premises and also shall not cause any sort of obstruction, impediment or
objections to the Party No.1st while receiving compensation from the Govt. in the
eventuality of said building comes under road widening or govt. acquires the
same for any other purposes.

IN WITNESSES WHEREOF, the parties execute this indenture on the date,


month and year first above mentioned.

The contents of this document have been read over to the parties in their mother
tongue and they have accepted the same as true and correct in my presence.

AGREEMENT BETWEEN THE PARTIES

This Agreement is made and executed at Saddar Court premises, Srinagar


on this the …… day of March, 2017 by and between;
1. ………………. (hereinafter referred to as the party No.1st) to this agreement.
AND

2. ………………….(hereinafter referred to as Party No.2nd) to this agreement.

Whereas, the party no. 2nd to this agreement is running a Shop under the
name and style of SNIPZ N CURLZ AT RESIDENCY ROAD SRINAGAR and
the party no. Ist is willing to run the said shop for a period of 11 months.

Whereas the party no. 2nd has agreed to provide the said shop to the party
no. Ist and have entered into an agreement with regard to the said shop.

Whereas, the parties to this agreement have agreed to reduce into writing
the terms and conditions in order to avoid any further dispute in future.
NOW THEREFORE THIS AGREEMENT IS WITNESSETH AS UNDER:-
1. That, due to intervention of arbitrators, it has been agreed by the parties that
the party No.1st shall be ceased to be the partner of the school and his father
Mr. Bashir Ahmad Wani shall be treated as partner to the said school.
Actually, the partnership deed under law was to be dissolved, since, parties

have agreed not to dissolve the actual partnership deed due to some certain
obstructions.
2. That, the Party No.1st hereby transfer his interest in the firm absolutely in
favour of his father with his consent except signatories powers and induct him
as partner on his behalf in the said partnership firm from his share. However,
party No.1st to this agreement henceforth shall work as employee of the said
institution and shall be entitled his due remuneration as given to other
employees of the school. Besides this, the Party No.1 st shall be also entitled to
receive rent as fixed in respect of the school building by the parties. The rent
shall be enhanced from time to time as per market value.
3. That, incase Party No.1st again commits such acts which has created dispute
between the parties to this agreement, in that eventuality, Party No.1 st shall
pay Rs.20 Lakhs as penalty in favour of Party No.2 nd and the said amount of
penalty shall be increased from time to time depends on circumstances.
4. That, in case the party No.2nd intends to retire from the said partnership of his
own consent in that eventuality, the party No.2 nd shall be entitled to only his
due share at that time.
5. That, both the parties including father of Party No.1st shall facilitate, render
their cooperation and also shall extend every possible help to each other while
running the said school in a smooth manner.
6. That, henceforth, Party No.1st shall not interfere in any manner whatsoever in
the school affairs and shall strictly abide by and adhere to the terms and
conditions to this agreement.

IN WITNESSES WHEREOF, the parties to this agreement have put forth


their respective signatures unto this agreement after fully understanding the
averments made therein on the day, month and year already mentioned
hereinabove.
