“1.

I have calculated that we owe in 327,900 php rental to Nov 20th

2. I deducted the late fines of 72K & 80k deposits paid at start of term Nov
2021 as you mentioned that fines maybe cannot be imposed.

3. In total paid so far is 1,400,100.00 PHP to owner via bank payments /

cheques & paypal as from what I could trace since November 2021

4. Total over 2 years that should of been paid is 1,920,000.00php total

excluding deposit”

I come to a different conclusion here.

Based on the pdf file you sent, there are only listed payments for
P1,280,100.00 to date.

I also make the total due over the entirety of the contract equal to
P2,000,000.00.

The contract was for P80K per month, and required a payment of 1 month’s
rent in advance, and 1 month’s deposit, coming to P160K.

Then there are expected rental payments from December 2021 to October
2023, covering 23 additional payments of P80K each, coming to a total of
P1.84M.

So far, as far as I can ascertain from your pdf, you have paid a total amount
of P1,280,100.00. Still trying to work out why there is an additional P100 in
the payment for October 2022.

But that means you still have an amount due of P 719,900.00.

Which means that some of the payments are not accounted for in your
records.

So let’s go with the amount they claim you owe. Removing the penalties for
June 2022 and January-September 2023, you owe a total of P320,000.00.

As previously stated, the penalties are invalid and void. And if you actually
paid any, then we can deduct that from the total owed.

As I mentioned, the penalties are for dishonored or uncleared checks issued

by the Lessee to the Lessor.
The Lessee is Jamie Hayward, as per the contract. But he never issued any
checks, so no penalties can be applied.

Based on this information, it is best that we write to Pimentel on your

behalf, advising them that their penalties are invalid, and offering a one-
time only payment arrangement for monthly payments that you can afford.
