That the undersigned, JELANZ DEL FONSO y REDOÑA hereby applies to have the land
hereinafter described brought under the operation of the Property Registration Decree, and to have
the title thereto registered and confirmed:

AND DECLARE.....

1. That the applicant is the owner of the land (by right of inheritance possession in
accordance with Section 14(2) of PD No. 1529), together with the building and improvements
thereon. The said land, consisting of four thousand three hundred seventy meters (4,370) sq m. of
parcel situated, bounded and described as shown on the plan and technical descriptions attached
hereto and made a part hereof;
2. That the said land at the last assessment for taxation was assessed at ₱25,505.30,
Philippine currency and the buildings and other improvements at ₱3,680,550.25, Philippine
currency;
3. That to the best of my knowledge and belief, there is no mortgage or encumbrance of
any kind whatsoever affecting said land, nor any other person having any interest herein, legal or
equitable, or in possession.
4.That the applicant has acquired said land in the following manner: that the undersigned
has been in open, continuous, exclusive and notorious possession and occupation of the land; that
the land the applicant occupies is declared as patrimonial property since February 6, 1990; and that
the undersigned and his predeccessors in interest have been in the possession of the land since
March 11, 1990;
5. That said land is occupied by the following persons: By applicant himself, Jelanz R. del
Fonso; and his children, Juan Angel B. del Fonso, Javier Yoandri B. del Fonso; and Adexe Maximo
B. del Fonso.
6. That the names in full and addresses of the owner of the property are as follows: Jelanz
del Fonso, 18 Diversion Road, Brgy. Calogcog, Tanauan, Leyte 6502;
7. That the applicant is a widower and of legal age.
8. That the applicant’s full name, age, citizenship, residence and postal addresses is as
follows: Jelanz R. del Fonso, 50 years old, Filipino, 18 Diversion Road, Brgy. Calogcog, Tanauan,
Leyte 6502.
9. That the land included in the application is bounded by a public road and the applicant
desires to have the line of the way or road determined.
10. That the following documents are attached hereto and made a part hereof:
a. Plan in tracing cloth of land attested and duly certified by the Regional Technical
Director (Annex A);
b. Blue print copy of the plan (Annex B);
c. Technical descriptions certified by the Regional Technical Director (Annex C);
d. Geodetic Engineer’s certificate (Annex D);
e. Certificate of the Municipal Assessor of the assessed value of the land at its last
 assessment for taxation (Annex E);
f. Copy of the Original Classification approved by the DENR Secretary (Annex F);
g. Certification from PENRO survey (Annex G); and
h. PSA issued birth certificate of the applicant (Annex H); and
i. Photograph of building and improvements on the land (Annex I).

PETITION

PETITIONER, by and through counsel, unto this Honorable Court respectfully aver that:

1. Petitioner, Jelanz R. del Fonso, is a Filipino, 50 years old, widower and a resident of 18
Diversion Road, Calogcog, Tanauan, Leyte 6502;

2. Respondent is the Register of Deeds of Leyte, Palo which has an official address OSS
Bldg., Government Center, Candahug, Palo, Leyte where it may be served with summons
and other court processes at the given address;

3. Petitioner is applying for the registration of a parcel of land virtue of inheritance in

accordance with Section 14 (2) of said Decree and Article 1137 of the Civil Code which
provides that, ownership and other real rights over possession thereof for thirty (30) years,
without need of title or of good faith.

4. Petitioner, and from his predecessors-in-interest, has been occupying the subject land for
34 years starting 1989 up to present.

PRAYER

WHEREFORE, it is respectfully prayed that the Register of Deeds of Leyte, Palo issue an
original certificate of title of the land situated at 18 Diversion Road, Calogcog, Tanauan, Leyte
6502 registered in the name of petitioner herein.

Other just and equitable reliefs are likewise prayed for.
