ECONOMIC CONTRACT
(Soil investigation)

PROJECT: Vietnam Heng Xing Science and Technology Co.,Ltd

Location: Vinh Loc Industrial park, Binh Chanh District, HCM City

 Based on Construction Law 16/2003/QH11 dated on 26/11/2003 issued during of the

4th meeting of National Assembly;
 Base on Decree No 46/2015/NĐ-CP dated on 18/6/2015 relate to quality management of
works;
 Base on Circular of Construction Ministry No 08/2010/TT-BXD ngày 29/7/2010 relate to
manual method of adjusting the price of construction contracts;
 Base on Decree No. 59/2015/NĐ-CP dated 16/8/2015 of the Government of the Socialist
Republic of Vietnam on the management of investment projects in construction;
 Based on requirement of Party A and capabilities of 146 Construction Consultant
Company Limited.

Both Parties have agreed to sign the contract with items and conditions as follows
ARTICLE 1 : CONTENT
Party A assigns Party B to make the soil investigation with following contents:
Scope of works:
* Soil boring : 39 holes: 1005m
11 holes x 15m
28 holes x 30m
* Taking soil sample in boreholes (every 2m drilling, taking 1 soil sample) = 502 samples.
* Laboratory Soil Testing: 502 samples.
* Standard penetration test (SPT test): 502 times.
* Transportation of equipments : 2 times
* Soil investigation report: 05 sets (Vietnamese-English).
ARTICLE 2: QUALITY – TECHNICAL STANDARDS

 Party B ensure proper execution according to the technical requirements stipulated in the
protocol specifications (attached) and construction drawings for Party A has been
agreed .
 Party B must comply with all test procedures , test standards required by Party A on the
site.
 Location and coordinates of the boreholes according to the drawing attached.

ARTICLE 3: WORK SCHEDULE and HANDOVER RECORDS

 Work schedule: 30 days after signing the contract, hand over the master plan and advance
stage 1
 Handed over to site A: 05 records of soil investigation reports language Vietnamese-
English

ARTICLE 4: COST AND PAYMENT

Payment term:
By transfer to party B’s account

 Stage 1: 30% advance after signing the contract.

  Stage 2: 30% after party B complete drilling outsite.
 Stage 3: 40% remain after party B handover full profile of soil investigation report.
 Party B will send VAT invoice to party A after Stage 3 finish.

ARTICLE 5: RESPONSIBILITIES OF THE BOTH PARTIES

Party A:

 Party A supply site map to Party B.

 To assign staff to supervise the works in the soil boring duration .
 Payment party B as mentioned in Article 4.

Party B:

 To be responsible for technical works, documents submit to party A have to according

to standards of construction.
 Party B establishment survey outlines with the current standards, self- preservation
machinery and equipment during the implementation and handover to the A position to
finish the job.
 Responsible for technical reports and records in accordance with the standard design and
construction.
 Responsible for labor protective equipment for the entire technical staff working in the
site. Ensure the absolute safety of people and equipment in the construction process .
 Responsible for negotiation and compensation for farmers for crop damage when moving
drilling machine and equipment on site.
 To organize the schedule was inside a browser or confirm the contents and quality of
work provided for in Article 1 and Article 2 of the contract . During the implementation
process , if errors exceed the stipulated that caused the cost of repairing it shall be solely
responsible.
 Notify Party A 01 day before the start of construction to the arrangement A coordinated
implementation plan.

ARTICLE 6: GENERAL PROVISIONS

 Both Parties undertake to perform fully items and conditions regulated in the contract.
Any change of supplementation to this contract must be agreed by both in writing.
 The contract is set up 04 copies,. Each side keeps 2 copies with the equal value. In case
of a dispute about language, taken Vietnamese as the official language.
