AFFIDAVIT OF DESISTANCE

I, JETT C. ROJAS, of legal age, Filipino citizen, married, and resident of

Sitio Casamata, Brgy. Central, Ajuy, Iloilo, after having been duly sworn to in
accordance with law, depose and state:

1. I am the private complainant in a criminal case for Robbery with Violence

Against or Intimidation of Persons docketed as Criminal Case No. 2020-9352
pending before the Regional Trial Court of Barotac Viejo, Iloilo, Branch 66;

2. I am no longer interested in the further prosecution of the above-mentioned

case because I cannot personally attend those cases due to my commitments as
Municipal Mayor of the Local Government of Ajuy, Iloilo;

3. That in view of the foregoing, I hereby manifest that I now completely and
absolutely exonerate the accused Ruby Tumalaytay et.al from any liability in
connection with the above-mentioned criminal case and that I am no longer
interested and I hereby desist in prosecuting the criminal case;

4. I fully understand the legal consequences of this Affidavit of Desistance;

5. I am executing this Affidavit of Desistance to attest the truth of the

foregoing statements and respectfully pray that the aforementioned case against
Ruby Tumalaytay et. al. be withdrawn and/or dismissed.

he freely and voluntary executed the same.
