AGENCY AGREEMENT

AGENT whereby the context so admits includes its representatives and assigns to one part

The PRINCIPALS whereby the context so admits includes THEIR administrator and
estate on the other part.

And whereas the principal is the proprietor to all that piece of land known as plot number
………………………………… at ……………………………..…… Estate in
NAIROBI…………………………………….. Area/street and the developments thereon

And where the PRINCIPAL has erected a building comprising of……………

Rental rooms and facilities.

NOW THIS AGREEMENT IS AGREED AND DECLARED AS FOLLOWS:-

1. That the PRINCIPAL do hereby engage the AGENT to manage and collect rent on
behalf of the rental houses situated on plot number at
………………. …………….Estate in …………………………… Area/street.
2. That the PRINCIPAL shall pay the AGENT a commission of 10% of total rent
collected and to be deducted from the rent paid by the principals’ tenants.
3. That the AGENT shall take all reasonable measures to ensure that rent is duly paid
in time by all tenants in the aforesaid premises.
4. A. That the AGENT does hereby undertake the remit to the PRINCIPAL full rent
less
10% on …………………….of every month for all occupied rooms.

B. This agreement shall remain in force and irrevocable for a minimum period
of ………….. years from the date of signing.

 6. That the PRINCIPAL retains in respect of each unit, a deposit equal to one
month’s rent for every new tenant which will be collected by the Agent and will be
refundable at the end of tenancy by the principal through the agent.

8. That the AGENT shall provide the PRINCIPAL with a monthly return and list of
all current tenants and their corresponding rooms/payments.
9. That the contract shall be terminated with immediate effect if the PRINCIPAL
receive any payments directly from the tenants.
10. The Rights of Principal. The principal has a right to immediately terminate the
agency agreement if:-

A. The proprietor of the company (agent) transfers the ownership of the agency to
another proprietor.
B. In case of death of the proprietor/Agent
C. In case the deadline of receiving full rent is not met which is on or before…….

D. The Principal will not be held responsible for any loss as a result of the above
reasons.

11. That the AGENT shall not be responsible or reliable for rent accumulated prior to
the execution of the agreement.
