Sub: Compilation of Data for Revised Pension under EPS, 1995

The Hon’ble Supreme Court vide judgement dated 04/11/2022 in Civil appeal no. 8143-
8144/2022 in the EPFO vs. Sunil Kumar B & Ors. And connected matters had passed an
important ruling which may have significant implication for employees/employers under the
EPF act.

Salient features of EPS-95 Pension judgement are as below:


1. There is no difference between Exempted and unexempted establishments for the
purpose of pension and enhanced pension extension
2. Working and post 01-09-2014 retirees are eligible for higher pension through joint option
within 4 months as per judgement dtd: 04-11-2022.

The above judgement of the Hon’ble Supreme Court would have implications on the
employees of MAHAGENCO as well viz. both superannuated on or after 01/09/2014. (as per
EPF act.) and serving employees. Further, detailed instructions/ guidelines with regards to
process of implementation of the Judgement has to be notified by the EPFO.

Pending instructions from EPFO on the matter, GEA requests for the following exercise/
actions are to be initiated as advance preparedness by MSPGCL.
a. Month-wise actual PF contribution (Basic pay, DA pay etc.) of serving employees as well
as those employees who had superannuated on or after 01/09/2014 need to be
ascertained & validated w.e.f. 16/11/1995 or from the date of joining of MSPGCL
thereafter and kept in readiness in case member(s) opt for contribution under the
scheme of actual PF contribution.
b. Further, considering above, MSPGCL would issue separate instructions with requisite
fields for data compilation from various stations and get it ready in this regard. Also, the
data need to be provided/validated by the MSPGCL HR Dept and PF trust concerned.

In view of the above, it is requested to form a team at Corporate Office comprising of


persons from HR, Finance, IT and Industrial relations depts. They will be entrusted to
prepare a format and collection of data regarding joint option form to be submitted to EPFO.
