Whether or not, The Land Registration Authority can expedite the entry of the
Technical Description as stipulated in the ESTADOS UNIDOS DE AMERICA
ISLAS FILIPINAS as per UNITED STATES OF AMERICA PHILIPPINE ISLANDS
LAND REGISTRATION COURT, After hearing Record No. 3732, this Court
decrees that the Insular Government of the Philippine Islands, Manila, Philippine
Islands, Manila, applicant, has the absolute ownership over the land adjudicated
to it, situated in the Province of Cebu, P.I., the description of which is expressed
as follows to wit: A land known by the name of Hacienda de Talisay Minglanilla,
situated in the municipalities of Talisay and Minglanilla. It is bounded in the Nort-
East by the Managa River, with properties of Matea de Dumlog, Victoriano Atabay,
Victoriano Patay, Felipe Juana, Eduardo Atabay, Pelagio (illegible), Tomas
Rabayos, Blas Tababa, Paciencio Nabal, Ines Bacalso, Luis Padayo and the
Bulacao river, in the South by the shoreline of the Cebu bay; in the South-West by
the Ynayagan river; and in the Nort-West by the land of Pablo Cirgas, Celestino
Labria, Alejandro Cirgas, Cipriano Serapia, Pedro Degracia, Juan Palacero,
Pantaleon Sabina, Anastasio Talia, Julian Siza, Lulero Pardillo, Valentin Alipio
Antonio Rico, Felipe Comcom, Cipriano Largo. WHEREFORE, this Court hereby
orders that the subject land be inscribed per the provision of the Land Registration
Act in the name of the forecited Insular Government of the Philippines Islands,
subject however to such of the encumbrances mentioned in Article 39 of said Act
as may be subsisting, and to: Given this 15 th day of July 1908 at 11:45 a.m. by the

so Necessary to have the ANNOTATION OF TECHNICAL DESCRIPTION IN THE
CERTIFICATE OF TITLE NO. (TCT No. (T-686) 102-RT-2890 praying an Order
be issued directing the Office of the Register of Deeds of Cebu Province to
inscribe the technical description in the Certificate of Title TCT No. (T-686) 102-
RT-2890. Finding the petition to be sufficient in form and substance, Herewith
attached are the translated documents from Spanish to English version as Exhibit
A, A-1, A-2, A-3, and A-4 with Exhibit B, B-1 B-2, B-3, and B-4 To form Apart
Hereof.

HISTORY OF SUCCESSION AS HEIRS

2.1The late Spouse Bernarda Cabarrubias Bas who got Married to Rufino Sr. has
a surviving son in the name of Rufino Seno Jr. Who got married to Amelita S.
Seno, (Both Deceased) who has three Siblings Namely Randy S. Seno, Arnulfo S.
Seno and Donald S. Seno the Land Administrator/Heirs-Successor. Amelita S.
Seno was Appointed as The ATTORNEY IN FACT of the above-mentioned heirs,
Resulting in the Legal Processing of the lost title Granting in the Filing of the
Issuance of the new owner land title at Brance 16 Regional Trial Court Cebu City
and she was Able to Secure the Aforesaid title, unfortunately, She died on March
2023 leaving the Last Will of Testament to her Three Siblings Entered in Doc No.
466 Page No. 94 Book No. 01 Series of 2019 Dated on April 17, 2024, Subscribe
By ATTY. BONIFACIO DEGAMO JR. Notary Public in Cities and Cebu Province.
Herewith Attach the Instrument the extra-judicial Settlement of a Deceased person
intestate and as Exhibit F and G to Form Apart Hereof.

2.2 After the date of The late Amelita S. Seno The ATTORNEY IN FACT of the
Heirs for The late Julio Bas Successor the Youngest son in the name of Donald S.
Seno The Land Administrator Tried to Locate and Search the Reconstituted Title
However, He failed to locate the So-called Document’s the reason Why, he
executed the Affidavit of lost Entered in Doc No. 122 Page No. 25 Book No. 9
Series of 2024 Dated on 12, April 2024 Subscribe by ATTY. SANTIAGO D.
BALLESTEROS JR. Notary Public, In Cities and Cebu Province. This Instrument
was Officially Submitted to the Register of Deeds for Cebu Province that Remains
pending for Appropriate Action about Republic Act 26 the reconstitution
Proceedings. Herewith Attached is The Affidavit of Lost as Exhibit H to Form Apart
Hereof.

2.3The Successor/Compulsory Heirs Doland S. Seno The land Administrator, Also


executed his Judicial Adjudication of Heirship of a Deceased Person Intestate with
Corroborating Signatures Entered in Doc No. 121 Page No. 25 Book No. 9 Series

BALLESTEROS JR. Notary Public in Cities And Cebu Province. The So-called
Documents were Also Submitted and Included on File to The Registered Deeds
For Cebu Province. Herewith Attached the Documents Consisting of Eleven
Pages (11) As Exhibits to I-1 to I-11 to Form Apart Hereof

THE ISSUES AND ARGUMENTS TO BE RESOLVED

3.The Aforesaid TCT No. (T-686) 102-RT-2890 Issued on February 19, 2015,
Julio Bas has reconstituted under the Name of Amelita S. Seno the Attorney in
Fact Heirs, the so-called instruments did not suffice the Lot Entries Technical
Description of Land Properties as Stipulated of the Said Title. These Vital Issues
that Could Mislead the Said Documents on the Veracity of the Actual Figure
covered the said title. In a matter of Certification issued that Lot No. 2466 Flr-133
Talisay-Minglanilla Friar lands Estate, Cebu is patented in the name of Julio Bas
on March 24, 1917, Covered by Decree No. 2787. Herewith Attached is the
Instrument As exhibit L to Form apart Hereof.

3.1 Almost Seventy Decades (70) From the year 1917 Up to this year May 2024
this Court Order Will be Prescribed, That The Registered of Deeds for the
Province of Cebu Had Failed to Registered these so-called annotations of Entries
for the lot descriptions as indicated in Decree No. 2787 which Boundary Line From
The Bolacao River Talisay City Cebu, up to Cawit Island in Cebu City and
Inayagan River City Of Naga Cebu obviously can be seen in determent the
LATTETUDE And LONGETUDE in a nautical Miles of Said Parcel of Land as per
Described and Reflected in Decree No. 2787 of OCT 188 Torrents System
Registration. Subsequently Bureau of Land Personnel Represented by
Luzviminda Artes the Officer in Charge of the Land Management Bureau of the
Department of Environment of Natural Resources Regional Office 7 She has
revealed on Her Issued Certification That There Were NO OFFICIAL RECORDS
ENTERED In Their Respective Office Has to Coat and Quoted (Hereunder)
This is to certify as per verification of our records Cadastral map of FLR 133
Talisay City Cebu is not available on file with this office, records Section, DENR-
LMS Region 7, Banilad, Mandaue City.

data and the said vast rack of Land comprising a Total area of Eight Thousand
Three hundred eighty-five (8,385) Hectares as per Revise plan submitted as
prepared by Eng. Crispin Torres Geodetic Engineer.

To issue an LRA resolution and copy Furnish to the Bureau of Plan and
Management, DNR-7 City Assessor of Talisay City, and Municipal Assessor of
Minglanilla Cebu Province.

To Issue an Administrative Order directing the Registered of Deeds for Cebu

EXTRAJUDICIAL SETTLEMENT OF ESTATE
WITH GENERAL SPECIAL POWER OF ATTORNEY OF
AUTHORITY

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Extrajudicial Settlement of Estate (“Deed”), made and entered into by and
between:

Heirs of the late spouse Julio Bas and Fortuna Manca, (Both deceased), has a son in the
name of the late Ignacio Mancao Bas Married to Flora Cabarrubias has a daughter in the name
of Bernarda Cabarrubias Bas Married to Rufino Seno, Sr. Both has a son in the name of
Rufino Bas Seno,
Jr. got married to Amelita S. Seno both deceased have siblings (namely) Arnulfo S. Seno,
Randy S. Seno, Donald S. Seno, Land Administrator, ET AL., represented by among the
following surviving Heirs namely:

1. That We, BONIFACIA D. BAS, LEONARDO JR. BAS, BERNARDINA T. BAS,


EVANGELINE T. BAS, VIRGILIA FERRAREN-SENO, AND GENEVEVE D BAS, all of legal
age Filipino, residents of Dumlog, Talisay City and Biasong, Talisay City Cebu Province.
Herein referred to as the commonly legitimate Surviving Heirs/ASSIGNORS and all of them
represented by Donald S. Seno, Heirs/Successor-Land Administrator, of legal age Filipino,
Married, residing at Barangay Dumlog, Talisay City, Cebu Province in this instance by their
Attorney-in-fact, Presenter/Land Administrator/Heirs-Successors, Rogelio V. Amante,
Paralegal/Property Custodian, of legal age Filipino, widow, residing at Phase 4, Block 8, Lot 64,
Deca Homes Subdivision Barangay Tungkil, Municipality of Minglanilla, Cebu Province. Herein
referred to as the Attorney-in-fact/ASSIGNEES.

WITNESSETH:

1. That the above-named HEIRS are the only surviving and lawful heirs of spouse Julio
Bas and Fortunata Manca, (both deceased), who died intestate on ___________;

That the deceased at the time of their death left certain personal properties (“Estate”)
known as Lot No. 2466, from OCT No. 188 with TCT No. (T-686) 102-RT-2890 Decree No.
2787 under the name of Julio Bas, Patent No. ______ with Flr. 133, TAL-MING Estate
comprising an area of Eight Thousand Three Hundred Eighty-Five, (8,385) HECTARES, located
at the City of Talisay and Municipality of Minglanilla, Cebu Province herewith attached the TCT
No. (T-686) 102-RT-2890, Decree No. 2787, and the Revised Plan as Exhibit B, C, and D to
form a part hereof.

2. That there are no known debts or obligations due against the estate of the said decedent;
GENERAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

THAT WE, The above-mentioned compulsory Heirs/Successor,


do hereby appoint, Donald S. Seno, Heirs/Successor- Land Administrator, and Rogelio V.
Amante, Paralegal/Property Custodian to be our true and lawful attorney to act in, manage,
and conduct all our affairs and for that purpose in our name(s) and on our behalf to do and
execute any or all of the following acts, deeds, and things, to wit:

3.1 To exercise administration, general control, and supervision over our business
and property in the TAL-MING Estate, and to act as our general representative(s) and
agent(s) with full authority to buy, sell, negotiate, and contract for us and our behalf;

3.2 To ask, demand, sue for, recover, and receive all sums of money, debts, dues,
goods, wares, merchandise, chattels, effects and things of whatsoever nature or
description, which now or hereafter shall be or become due, owing, payable or
belonging to among us, in or by any right, title, ways or means howsoever, and upon
receipt thereof or any part thereof, to make, sign, execute and deliver such receipts,
releases or other discharges;

3.3 To buy or otherwise acquire, to hire or lease, and to pledge or otherwise


hypothecate, assign, and to dispose of, any or all of our personal property or any
interest therein, upon such terms and conditions, and under such covenants, our
attorney(s) shall dim fit or proper, and to execute in our name(s) any papers relating
thereto, and to sign, execute, acknowledge and deliver any agreements, or other
writings therefore, or in any way connected therewith, or with any business or property;

3.4 To deposit money and to withdraw same by check, receipt, draft or otherwise in
any bank in our name(s), to sign, endorse, draw, accept, make, execute, deliver and
paychecks, drafts, bills of exchanges, promissory notes, letters of credit, guarantees,
and all other writings, contracts, and agreements;

3.5 To borrow any sum or sums of money that are urgent and indispensable for the
prevention of things which are under their administration on such terms, conditions,
and stipulations, and on such security, as our attorney(s) may think fit for that purpose;
to execute all promissory notes, bonds, mortgages, and other instruments which may
be necessary and proper;

3.6 To settle any account or reckoning whatsoever wherein I we are, or at any time
hereafter shall be in anywise, interested or are concerned with any person
whomsoever, and to pay or receive the balance thereof as the case may be;
3.7 To compound with or make allowances to any person for and in respect to any
debts or demand whatsoever which now is or shall any time hereafter become due
and payable to us, and to take and receive any composition or dividend thereof or
thereupon and to give releases or other discharges for the whole of such debts or
demands, or to settle, compromise or submit to arbitration every such debts or
demand and every other right, matter, and thing due to or concerning us as our
attorney(s) may deem advisable in the premises;

3.8 To make, sign, seal, execute, and deliver contracts, documents, agreements, and
other writings upon such terms and conditions acceptable to our said attorney(s); and

3.9 In general, to do all other acts, deeds, matters, and things whatsoever, in or about
our estate, property, and affairs, or to concur with persons jointly interested with
ourselves therein doing all acts, deeds, matters, and things herein, either particularly
or generally described, as fully and effectually to all intents and purposes as we could
do in our proper person(s) if personally present.

HEREBY GIVING AND GRANTING unto our said attorney(s) full power and authority
whatsoever requisite or proper to be done in or about the premises, as fully to all intents and
purposes as I/we might or could lawfully do if personally present, and hereby certifying and
confirming all that my/our said attorney(s) shall do or cause to be done under these presents.

4. T o b r i n g s u i t , p r o s e c u t e ,
a n d / o r f i l e a l l a p p r o p r i a t e a c t i o n s (whether civil,
criminal, or administrative case) on our behalf a g a i n s t C L A I R L A N D
CORPORATION Represented by DENNIS CHUA the Plaintiffs who
filed the civil case No.1922 FOR: EJECMENT (FORCIBLE
ENTRY), currently pending at branch 2 Municipal trial court in
cities Palas of justice Talisay City Cebu Province.
, concerning our refusal to v a c a t e a n d t h e r e c o v e r y o f r e a l
property;

5. That, it is in the very best interest of the parties hereto to adjudicate unto themselves
the entire Estate extrajudicially in the form and manner hereinafter set forth;

6 . We the Heirs commonly Successors of The late Julio Bas Registered Land Owner
of lot 2466 TAL-MING Estate, will Voluntarily provide and allocate to Rogelio V. Amante, the
paralegal Contingency part and portion of land inside lot 2466 in a total area of three hundred
eighty-five, (385) Hectares of land as his Share in Providing Legal Assistance and
Documentation processing to this effect.

7 . T o s i g n a n d e x e c u t e p r o p e r c o m p l a i n t s a n d
p r e s e n t o u r s e l v e s i n t h i s p a r t i c u l a r
c a s e p e t i t i o n , a f f i d a v i t including Verification and Certification of Non-
Forum Shopping related to the filing of every pleading, petition, memorandum,
m o t i o n , o r p o s i t i o n p a p e r b e f o r e a n y t r i b u n a l o r a n y c o u r t o f law or
government agencies, as well as to sign and interpose
appeal, petition for certiorari or appeal memorandum
whenever necessary;

8 . T o e n t e r i n t o a
c o m p r o m i s e a g r e e m e n t a n d / o r a m i c a b l e
settlement in our name and stead, attend a pre-tr ial conference, a n d p e r f o r m a l l
t h e p r o v i s i o n s m a n d a t e d u n d e r R u l e 1 8 o f 1997 Rules of Civil Procedure, in
connection with and related t o o u r a f o r e s a i d a c t i o n / s b r o u g h t o r t o b e f i l e d
f o r o r a g a i n s t us concerning the same subject matter, with full authority to
d e l e g a t e t h i s p o w e r t o a n o t h e r p e r s o n o r a t t o r n e y w h o w i l l attend to the
case;

NOW THEREFORE, for and in consideration of the foregoing premises and invoking the

provision of Sec. 1 Rule 74 of the Rules of Court, the said HEIRS above named have agreed to

settle the estate extrajudicially and to this effect do hereby partition and adjudicate the same

unto themselves and the foregoing inheritance, subject however to the liabilities imposed by

Sec. 4, Rule 74 of the Rules of Court for a period of two years in Favor of any other possible

heirs, creditors or any other person deprived of the lawful participation over the said estate of

the deceased and encumbrances in addendum, We hereby affirmed conformed and ratify

designate and official appoint Donald S. Seno Land Administrator Rogelio V. Amante Property

Custodian Both of them called our General Special Power of Attorney that take effect upon

signing of this instrument. NONE Revocable

The parties agree to publish this instrument in a newspaper of general circulation in the City
and Province of Cebu once a week for three consecutive weeks. Furthermore, this
instrument shall be Copy furnished to the Ombudsman for the Visayas, Department of
Justice Department of Environment of Natural Resources Cities, Municipal Assessors, Cebu
Provincial Assessors, Regional Trial court 7 th Judicial Region, The Supreme Court, and the
Office of the President Republic of the Philippines Malacañang Palace, Metro Manila

In the remote event that any other property of the decedent should ever be found which is
not included hereinabove, the HEIRS hereto further agree as they do so agree to settle and
distribute the same in like manner and proportion as herein established and disposed of.
That the HEIRS hereby covenant and further warrant that should there be preterition

or omission of one, some, or all of the compulsory heirs in the direct line, whether living or

not at the time of the execution of this Deed, will not invalidate/nullify the terms and

conditions of this Deed. Instead, the HEIRS shall proportionately oblige themselves to pay to

the omitted Heirs or the latters’ heir(s) the share which belongs to them, under the rules of

succession under the new Civil Code of the Philippines Article 777.

IN WITNESS WHEREOF, WE have hereunto affixed our signature this 26 day of April 2024, in
Cebu City (for Talisay City and Municipality of Minglanilla), Cebu Province Philippines.
