This is an appeal preferred by the appellant/s


section 136(2) of the Karnataka Land Revenue under
Act 1964
(hereinafter referred to as the ,Act,) seeking
directions to the
respondent authority to effect the mutalion
and
the khata in the name of the appelrant, in respecttransfer
property in survey No.B3/ 1 measuring 0-03.0A, of the
situated

Tarabanahalli vi11age, Jala Hobli, Yelahanka Taluk
(hereinafter referred to as the 'said properties').

1. The delay in filing the above appeal is condoned and


the matter has taken up for adjudication on merits.

2. Tlne appellant submits that the appeliant has acquired


the property in survey No.B3/ 1 measuring 0-03.08,
situated at Tarabanahalli vi11age, Jala Hobli,
Yelahanka Taluk, under a partition deed dated 2O-O2-
1980, effected arnong the family members of the
appellant. But, the khata of the said land has not yet
been got by the appellant based on the said partition
deed and the sarne is still standing in the names of
Akkannamma and Gowramma. Hence, the appellant
has preferred the above appeal.

3. On the other side, the respondent authority has


remained absent before this court.

4. Heard the parties in the above appeal and posted the


above appeal for orders.

5. I have perused the pleadings in the memorandum of


appeal and the documents produced by the appellant.

6. On perusal of the partition deed dated 20-02-1980, it


shows that the same had been effected among the
family members of the appellant including the
appellant along with one Gowramma and
Akkannamma, in which the appellant has acquired
the property in survey No.B3/ 1 measuring 0-03.08,
situated at Tarabanahalli vi1lage, Jala Hobli, then
Bengaluru North Taluk, now in Yelahanka Taluk. But,
the khata of the said land has not yet been got by the
appellant based on the said partition deed and the
same is standing in the names of Akkannamma
sti11
and Gowramma. Therefore, the appellant is entitled
for transfer of khata of the said land. The above
appeal is entitled to be a11owed.

7 . In view of the above mentioned facts and the


observations made, I proceed to pass the following;

ORDER

The above appeal of the appellant is hereby allowed.

The Tahsildar, Yelahanka Taluk, Yelahanka, Bengaluru, is


hereby directed to remove the joint names of Akkannamma
and Gowramma and mention the name of the appellant in
column No.9 and 12(2) of the RTC, in respect of the
property in survey No.83/ 1 measuring 0-03.08, situated at
Tarabanahalli village, Jala Hobli, Yelahanka Taluk, in
accordance with 1aw.
