Executive Order For BCPC
AN EXECUTIVE ORDER CREATING THE BARANGAY COUNCIL FOR THE PROTECTIO OF CHILDREN (BCPC), DIVERSION
COMMITTEE, ITS COMPOSITION AND SPECIFIC FUNCTIONS
WHEREAS, Section 17 Republic Act 7160, also known as the Local Government Code, mandates that the Barangay shall endeavor
to provide for an effective and efficient provision of basic services and facilities which includes programs and projects for children and youth
welfare.
WHEREAS, Section 17 of the Republic Act No. 7160, otherwise known as the Special Protection of Children against Child Abuse,
Exploitation and Discrimination Acts, provides for stronger deterrence and special protection against child abuse, exploitation, and discrimination
and its corresponding penalties.
WHEREAS, Article 359 and 360 of the Civil Code of the Philippines provides that “the government shall establish Council for the
Protection of Children”
WHEREAS, Article 87 of the Presidential Decree (PD) 603 (Children and Youth Welfare Code) states that “Every Barangay Council
shall encourage the organization of a Local Council for the Protection of Children (LCPC) and shall coordinate with the Council for the Welfare
of Children (CWC) in drawing and implementing plans for the promotion of Child and Youth Welfare.” There is therefore a need to organize
LCPC not only in the Barangay but also in all other Local Government Units (LGUs), to ensure synchronization and integration of policies,
program and projects for children
WHEREAS, Section 15 of Republic Act 9344, also known as the Juvenile Justice Welfare Act of 2006, mandates the LGUs to
establish Local Council for the Protection of Children and allocate one percent (1%) of their Internal Revenue Allotment for strengthening and
implementation of the program and projects of the said council; and Section 46 the Organization of Diversion Committee to assist the authority
implementing the diversion in identifying the appropriate programs for the CICL and the Family.
WHEREAS, DILG Memorandum Circular 2002 – 121 dated August 5, 2002 enjoins all Local Chief Executive to organize/re-
organize their respective Local Council for the Protection of Children;
WHEREAS, pursuant to Ordinance No. 2019-13-03 also known as Child Welfare Code of the City of Tacloban to pursue program
and mechanism to ensure the protection and development of children.
WHEREFORE, I, ____________________________ the Punong Barangay, by virtue of the power vested in me by the law, I do
hereby order the creation of the Barangay Council for the Protection of Children and its Diversion Committee with the following composition and
function to with;
Section 2. Barangay Council for the Protection of Children duties and functions
Child Welfare Code of the City of Tacloban also known as Ordinance No. 2019-13-03
Conduct capability building projects to increase the knowledge and skills in handling children’s program.
Establish and maintain database on children in the barangay
Monitoring situational reports on children and prepare quarterly updates including the implementation of children’s program and make
recommendations to the City Council for the Protection of Children for consideration and nationwide application
Perform such other functions and other child related laws especially in matters of child and parent’s education, health, entertainment,
etc.
Section 4. Formulation and Supervision of the Diversion Program at the Barangay Level
- The diversion program at the Katarungan Pambarangay Level shall be formulated by the Diversion Committee
- The supervision of the Diversion Program at this level shall be done by the Punong Barangay, with the assistance for the
BCPC.
- AS a form of monitoring, the members of the BCPC and the community volunteers to be designated by the BCPC, may
conduct house visits with the child and the parents or guardians, in order to monitor the child’s progress in the Diversion
Program and ensure compliance with the Contract of Diversion. This may be done in consultation and collaboration with
the LSWDO.
Section 6. Repealing Clause. Any Executive Order, Office Order or in parts thereof inconsistent herewith are hereby deemed repealed
or modified accordingly.
