Master Lease Addendum
This addendum shall be a part of, and incorporated within the Residential Rental Agreement/Lease

shall bind all residents residing with the signing party. This addendum shall continue in effect upon the signing of
any renewal lease agreements, even if a new agreement is not signed.

The Lease and Addenda are hereby amended as follows. All other terms shall remain in full force:

right to refuse delivery of any package or mail for any person or entity not listed on a lease agreement with Owner.
Owner reserves the right to refuse any refrigerated or perishable packages.

Facilities:
Resident understands and agrees that any and all facilities provided by the Owner are provided as a
gratuity and are not a part of the Resident’s rental agreement, and that Owner reserves the right to change or limit
the hours of any such facilities, or to eliminate them completely without prior notice to the Residents and that any
such action by Owner shall not constitute a claim by Residents of any breach of this lease by Owner, nor be a basis
for any reduction of Resident’s rent or early termination of Resident’s lease agreement.

TESTING THE SMOKE ALARM AND CARBON MONOXIDE ALARM


Test by pushing the button on the cover. The alarm will sound if all electronic circuitry, horn and battery are working. If no
alarm sounds, the unit has a defective battery or other failure. You can also test the smoke alarm by blowing smoke into it.
SMOKE ALARM HUSH FEATURE
If the smoke alarm has a hush feature, you can silence the alarm by pushing the hush button on the cover and holding
for three seconds.
BATTERY REPLACEMENT (where applicable)
The alarm has a low-battery indicator which will “chirp” at 30-second intervals for a minimum of 7 days. Replace the battery
when chirping occurs. Use a Mallory MN1604 or Eveready 552 9-volt alkaline battery or equivalent sold at most drug,
department, hardware or electronic parts stores. Never use an ordinary or heavy-duty carbon-zinc battery. If the alarm is
equipped with a 10-year battery, it may not last 10 years and must be replaced with a 10-year battery. A “10-year battery”
means a battery that is warranted by the battery manufacturer to be free from defects in materials and workmanship for
a period of at least ten (10) years when used in an ionization smoke alarm that: (a) is listed by a nationally recognized
testing laboratory; and (b) has been approved by the nationally recognized testing laboratory for use with a 10-year battery.
NON-REPLACEABLE BATTERIES (where applicable)
If the alarm is battery operated, but has non-replaceable batteries, notify Owner/Agent immediately in writing if the alarm
indicates the battery is failing. Owner/Agent will replace the alarm as soon as practical.

clean up the waste. For any rental unit which includes a yard designated for use exclusively by the Resident, Resident is responsible
to clean up and dispose of pet waste on the Premises promptly.
8. Pets will not be allowed to make noise or engage in threatening conduct which might disturb other residents, Owner/Agent, guests
or other pets/assistance animals.
9. Pets will be kept clean. Any pet waste that is accumulated in a tray inside the unit will be disposed of properly and promptly.
10. Resident will immediately notify Owner/Agent of any personal injury or property damage caused by the pet(s).
11. Any damage attributed to the pet(s) will be paid for promptly by Resident.

as an additional insured on Resident’s insurance policy if possible. Said proof shall be subject to reverification at any time a
declaration page is reissued. The company or agent shall be instructed to notify Owner/Agent directly of any lapse of insurance if
that is possible. (This paragraph is not applicable to HUD project based subsidized properties.)

1. These rules apply to the installation of direct broadcast satellite antennas of one meter or less in diameter, antennas of one meter
or less in diameter or diagonal measurement designed to receive video programming service via multipoint distribution service, or
antennas designed to receive television broadcast signals (collectively called “satellite dishes”).
2. Resident is allowed to install individual satellite dishes only to the extent and in locations allowed by local, state or federal law.

3. Satellite dishes may only be installed inside Resident’s unit or on any porch, patio, deck, balcony or other area over which Resident
has exclusive use and control under the terms of his/her Rental Agreement. No resident may install a satellite dish on the exterior,
roof or restricted areas of any building, or in the common areas of the building or complex. No satellite dish may extend beyond
balcony railings. Owner/Agent may remove any satellite dish installed on the exterior, roof, or restricted areas of any building, or in
the common areas, without Resident’s consent and Resident will pay all costs.
4. RESIDENT NEEDS TO BE AWARE THAT HIS/HER UNIT MAY NOT BE IN A PROPER LOCATION TO RECEIVE SATELLITE
BROADCAST SIGNALS EVEN IF HE/SHE INSTALLS A SATELLITE DISH. PRIOR TO INSTALLATION, RESIDENT SHOULD
CHECK WITH A QUALIFIED AND REPUTABLE COMPANY TO DETERMINE IF HE/SHE IS ABLE TO RECEIVE ADEQUATE
SIGNALS AT HIS/HER UNIT.
5. Resident shall notify Owner/Agent in writing prior to any installation. Such notice shall include a description of the location for the
satellite dish and the installation (attachment) method.
6. No resident may drill holes in walls, doors or window frames in order to install the satellite dish or run cable from the dish to the
television.
7. No installation may be performed in a manner that causes permanent damage to the unit or the building. The satellite dish must be removed
at the end of the tenancy and all damage, other than ordinary wear and tear, must be repaired or restored. If Resident fails to properly
remove the satellite dish at the end of the tenancy, Owner/Agent is authorized to do so and charge Resident all applicable costs.
8. All installations must be performed in such a manner as not to cause legitimate safety concerns. These would include, but not be
limited to, danger of falling, danger of permanent damage to the building or proximity to power lines.
9. RESIDENT IS RESPONSIBLE FOR ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY CAUSED BY HIS/HER SATELLITE
DISH. RESIDENT MUST PURCHASE AND MAINTAIN LIABILITY INSURANCE FOR THE USE OF A SATELLITE DISH, WHICH
INSURANCE MUST NAME OWNER/AGENT AS AN ADDITIONAL INSURED. RESIDENT SHALL PROVIDE OWNER/AGENT WITH
PROOF OF INSURANCE UPON REQUEST.
10. All installations must be performed in complete compliance with all applicable statutes, rules and regulations, including any
homeowner/condominium association rules and regulations that may apply. If permits are required, Resident will obtain all such
permits and any homeowner/condominium association consents prior to installation. Any fees charged by a homeowner/condominium
association for its consent will be paid by Resident.
11. If Owner/Agent has installed and made available a central satellite dish for use by all residents, then individual residents may not
install their own satellite dishes.
12. These rules are meant to comply with 47 CFR § 1.4000, as may be amended from time to time. All requirements of such section are
hereby incorporated herein. In no event shall Resident have more rights to install or maintain satellite dishes under this Installation
Policy than are allowed under 47 CFR § 1.4000. In the event any portion of this Installation Policy is held to conflict with applicable
law, those portions shall be deemed stricken and all other portions of this Installation Policy will remain in full force and effect.
13. No portion of this Installation Policy may be waived by Owner/Agent or changed verbally. Any such waiver or change will be effective
only when in writing, signed by Owner/Agent.

administrative fees or costs associated with the utilities and services and related billing costs or billing, and the method of billing, metering, or
otherwise allocating the cost and charges to Resident for utilities and services, is indicated below.

FORMULAS / ALLOCATION METHOD KEY


"1" – Per Occupant. Each Occupant is equal to 1 full occupant. 1 occupant = 1; 2 occupants = 2, 3 occupants =3. The total number of
occupants in Resident’s unit is divided by the total number of occupants currently residing at the community, the result is multiplied by
the total bill. This result is the utility or service cost per unit. This formula does not pro-rate based on move-in date.
"2" – Additional Occupants are 70% of an Occupant. The first occupant is equal to 1, and each additional occupant per unit is counted as 70%
of an occupant. 1 occupant = 1, 2 occupants = 1.7, 3 occupants = 2.4, etc. Total costs for utilities and services is computed in accordance
with Formula 1 above, except the total number of occupants per unit is computed in accordance with this paragraph. This formula does
not pro-rate based on move-in date.
"3" – Per Unit. Each unit is billed equally regardless of the number of occupants or square feet, this item does pro-rate based on move-in date.
The total bill for the utility or service is divided by the total number of occupied units at the community, and the result is the utility or
service cost per unit.
"4" - Flat Rate. Each unit is billed an equal flat rate per month regardless of number of occupants or square feet, this item does not pro-rate
based on move-in date.
"5" – Per Foot based on total occupied square feet. The total utility or service bill is divided by the total number of occupied square feet, and
the result is multiplied by the square feet of each individual unit. This result is the utility or service cost per unit. This item does not
pro-rate based on move-in date.
"6" – 50% Per Occupant/50% Per Foot. The total bill for a utility or service is divided by two to get one half the total utility or service cost.
One half the total cost is divided by the number of occupants at the community, the result is the per occupant cost. The per occupant cost
is then multiplied by the number of occupants in Resident’s unit, and the result is the 50% per occupant cost. One half the total cost is
then divided by the total rentable square feet at the community, the result is then multiplied by the square feet of each individual unit, the
result is the 50% square foot cost per unit. The sum of the “50% per occupant cost” and the “50% square foot cost per unit” is the total
utility or service cost per unit. This formula does not pro-rate based on move-in date. For example, a $5,000 total utility or service bill
for a community with 450 occupants, and 250,000 square feet would result in the following bills for a 1,000 square foot unit based on the
following occupancy: 1 occupant would pay $15.56, 2 occupants would pay $21.11, and 3 occupants would pay $26.67.
"7" – Meter Reading. Each unit is billed for the difference between the previous meter reading and the current meter reading for each units
metered item.
"8" – Per Occupant 60/30 – A similar billing to Per Occupant but it takes a ratio of the occupants into account. The first occupant in any unit
equals 1 occupant; the 2nd occupant in any unit counts as 0.60 of an occupant; any unit with a 3rd occupant or more, each occupant will count as
0.30 of an occupant. 1 Occ = 1 Occ - 2 Occs = 1.60 Occs - 3 Occs = 1.90 Occs - 4 Occs = 2.20 Occs - 5 Occs = 2.50 Occs - 6 Occs = 2.80

2. If an allocation method or flat fee is used Agent, Owner, or their billing company will calculate Resident’s allocated share of the utilities and
services provided and all costs in accordance with state and local statutes. Under any allocation method or flat fee, Resident may be paying for
part of the utility usage in common areas or in other residential units as well as administrative fees. Both Resident, Agent, and Owner agree that

using a calculation, allocation formula or flat fee as a basis for estimating total utility and service consumption is fair and reasonable, while
recognizing that the allocation method may or may not accurately reflect actual total utility or service consumption for Resident. Where lawful,
Agent may change the above methods of determining Resident’s allocated share of utilities and services and all other billing methods, in Agent’s
sole discretion, and after providing written notice to Resident. More detailed descriptions of billing methods, calculations and allocation formulas
will be provided upon request.

3. When billed by Agent or Owner directly or through Agent’s or Owner’s billing company, Resident’s payment of utility and/or services bills
must be received by the due date issued on the bill, which will be the 1st of each month, or the payment will be late. The late payment of a bill or
failure to pay any utility and/or services bill is a material breach of the Lease and Agent will exercise all remedies available under the Lease, up
to and including eviction for nonpayment. To the extent there is a billing fee for the production of any utility or services bill or a set-up charge or
initiation fee by Agent, Owner or their billing company, Resident shall pay such billing fee in an amount not to exceed $5.95 per billing period
and such set-up charge/initiation fee in an amount not to exceed $38.00.

4. Resident will be charged for the full period of time that Resident is living in, occupying, or responsible for payment of rent and utility or
service charges on the apartment. If Resident breaches the Lease, Resident will be responsible for utility and service charges for the time period
Resident was obligated to pay the charges under the Lease, subject to Agent and Owner’s mitigation of damages. In the event Resident fails to
timely establish utilities and services, Agent may charge Resident for any utilities and services billed to Agent or Owner with respect to
Resident’s apartment and may charge a reasonable billing fee for billing Resident for such utilities and services.

5.When Resident moves out, Resident will receive a final bill, which may be estimated by Agent based on Resident’s prior utility and services
usage. This bill must be paid at the time Resident moves out or it will be deducted from Resident’s security deposit, as permitted by state law.
Unless prohibited by law, bills may also be estimated on a temporary basis when necessary due to equipment malfunctions or other problems.

6. Agent and Owner are not liable for any losses or damages Resident incurs as a result of outages, interruptions, or fluctuations in utilities or any
other services provided to the apartment unless such loss or damage was the direct result of an intentional or negligent act or omission by Agent,
or Agent’s employees. Resident releases Agent and Owner from any and all such claims and waives any claims for offset or reduction of rent or
diminished rental value of the apartment due to such outages, interruptions, or fluctuations.

7. Resident agrees not to tamper with, adjust, or disconnect any utility or services sub-metering system or device. Violation of this provision is a
material breach of Resident’s Lease and may subject Resident to eviction or other remedies available to Agent under Resident’s Lease and this
Addendum.

8. Agent and Owner have the sole authority to select and approve all utility and services providers who may provide services to Resident(s) at the
apartment community, to the extent not prohibited by law.

9. Where lawful, all utilities, charges and fees of any kind under this lease shall be considered additional rent, and if partial payments are accepted
by Agent or Owner, they will be allocated first to non-rent charges and to rent last.

10. This Addendum shall be enforced to the fullest extent lawful. This Addendum is designed for use in multiple jurisdictions, and no billing
method, charge, or fee mentioned herein will be used in any jurisdiction where such use would be unlawful. Any determination by a court of
competent jurisdiction that a provision of this Addendum is legally invalid or unenforceable shall not diminish the validity or enforceability of the
remaining provisions.

11. Special Provisions. The terms of this section supercede any other conflicting terms of this Addendum.

Collectively "automated electronic payments "are paperless transactions that occur instantly and automatically without a
check being hand-processed through a local bank clearinghouse or the Federal Reserve System.
3. Authorization to Enroll. By executing this Lease Addendum, Resident is agreeing to be enrolled in an online payment
program, and to allow Owner to create an online account for Resident. Resident is also agreeing to pay a one-time, non-
refundable activation fee of $_____________.
10 Resident will be given a user name and password for access to this online
account where Resident may initiate and manage ACH or Card payments or rent or other property-related payments.
4. Right to opt out. Enrollment in the online payment program is the only way ACH or Card payment will be accepted. However,
enrollment is not required and Resident has the right at any time to give written notice of Resident's decision to withdraw
from the program. Should Resident choose to do so, Resident will thereafter be required to make all payments by regular
check or certified check according to the terms of the Residential Rental Agreement.

5. Delinquency. Access to the system will be restricted if any payment is considered "late" under the Residential Rental
Agreement. At Owner's sole discretion, ACH or Card Payments that are "late" will not be allowed, or will only be accepted if
paid in full. Owner has the right at any time to require Resident to pay all future rent payments by regular check or certified
check according to the terms of the Residential Rental Agreement, in lieu of payment through ACH or Card. Payments made
through this system after service of any eviction notice must have prior written approval of management before the payment
is made. Any unapproved payment made after service of an eviction notice shall be deemed rejected and shall be refunded (or
otherwise retransferred) within thirty (30) days.

SNOW & ICE REMOVAL PERSONAL RESPONSIBILITY ADDENDUM

This addendum is a supplement to the Residential Rental Agreement.

Owner and Residents agree and acknowledge that the premises are located in an area that receives significant
amounts of snow and has temperatures that allow ice to form. It is agreed that Owner shall take reasonable steps
to clear ice and snow from walkways and stairways, and to remove snow as practical from parking and driving areas.
It is agreed that reasonable steps shall be for Owner to commence action to clear such areas within two hours of the
cessation of snowfall during daylight hours or within the first two hours of daylight after a nightly snowfall that has
ceased. It is acknowledged that it may take considerable time to remove snow and ice.

It is acknowledged that it is impossible to completely clear all areas of snow and ice. Resident agrees to assume and
accept liability and responsibility for it, its occupants, and its guest’s safety while utilizing the walkways, stairways,
parking lots, and driveways of the Owner’s property. Resident shall supervise and assist all guests, minors, and
occupants while on the premises. Owner shall only be liable for damages in the event of gross negligence by Owner
in refusing to rectify a known defect that causes ice accumulation. Residents, occupants, and guests accept the risk
of walking upon areas that have snow or ice accumulation. It is acknowledged that ice may form underneath snow
accumulation and that there maybe other unseen hazards under any snow, Resident acknowledges this and agrees
to assume the risks associated with such. It is Residents obligation and responsibility to inform occupants and guests
of this limitation in liability and to indemnify Owner from any claims relating to snow and ice.

Residents agree to notify Owner or its agents of any and all defects or of places where there could be a problem with
ice or snow accumulation. Residents agree to take all steps necessary to assist in maintaining the safety of the
walkways, stairways, parking lots and driveways. Resident agrees to hold harmless and indemnify Owner from any
liability relating to damages from snow or ice sustained by Resident, it’s guests, occupants, or other visitors and their
property. Resident agrees to disclose and advise its guests as to this policy and agrees to indemnify Owner from any
liability associated with claims from such guests.

will help control any problem, minimize any infestation, and limit its spread.

Resident agrees to avoid and not bring in secondhand goods that have not been thoroughly inspected for the presence of pests.
Resident agrees to promptly report any problems, specifically any signs of pests; and any related maintenance needs. Resident
acknowledges that failure to timely report pest problems can substantially increase the kinds, number and costs of treatments.
Owner/Agent may conduct extermination operations in the unit several times a year and as needed to prevent or treat for pest
infestation. Owner/Agent will notify Resident in advance of extermination operations in the unit, and give Resident instructions
for the preparation of the unit and safe conduct during and after treatment. Resident will be responsible to prepare the unit for
extermination treatments in accordance with Owner/Agent’s or the exterminator’s instructions. Resident must request, in
writing, extermination treatments in addition to those regularly provided by Owner/Agent.
Resident agrees to follow the preparation guidelines required by Owner/Agent or the exterminator on the day of interior
extermination treatments to ensure the safety and effectiveness of the extermination operation. If Resident is unprepared on
the scheduled treatment date, Owner/Agent may charge Resident for the service call. Owner/Agent also reserves the right to
charge Resident for necessary extermination services.
Preparation guidelines may include but are not limited to the following:
• Empty and clean all cabinets and drawers in kitchen and bathroom
• Remove all miscellaneous items from floor, clean all closet floors, and remove all items from under beds and/or furniture,
allowing as much floor as possible to be accessible to treatment
• Remove pets from the areas to be treated and notify Owner/Agent of their placement
• In most cases, all residents and pets must vacate the unit for 3-4 hours after service
• Remove chain locks or other types of obstruction on day of service
• Cover fish tanks and turn off their air pumps
• Do not wipe cabinets after treatment
Prior to extermination, Resident is solely responsible to notify Owner/Agent, in writing, of any anticipated health or safety
concerns related to extermination and the use of pesticides.
Resident agrees that violation of any of the terms of this addendum constitutes a material noncompliance with the
Rental Agreement and is grounds for eviction and/or other legal action by Owner/Agent. Pest control protocol may
change as new research developments occur.
Resident acknowledges that Owner/Agent will not be responsible for damage to, or decontamination of, Resident’s
personal property or for providing temporary accommodations due to Resident’s failure to follow the terms of this
Addendum.

Resident is liable for damages beyond normal wear and tear. Normal wear and tear assumes Resident has cleaned and
maintained the Premises during the tenancy in compliance with the Rental Agreement. Resident acknowledges that there
are no guidelines under applicable law as to what constitutes “normal wear and tear.” The parties desire to establish some

Cleaning:
Resident must regularly clean the Premises as part of Resident’s normal obligations under the Rental Agreement. At move-

and/or vacuuming all floors, cleaning all counters, sinks and appliances, etc. and following other cleaning guidelines provided

Carpet Cleaning (Oregon):
As provided in your Rental Agreement, Owner/Agent may deduct the cost of carpet cleaning from the security deposit
regardless of whether Resident cleans the carpet before delivering possession of the unit back to Owner/Agent as long as:
a) the carpet was cleaned or replaced after the previous tenancy or the most recent significant use of the carpet and before
Resident took possession and b) the carpet is cleaned after move-out using a machine specifically designed for cleaning
or shampooing carpets.

CONCESSION ADDENDUM
The addendum (“Addendum”) to the Rental Agreement (the “Agreement”) dated 08/23/2023 between

If Residents fail to pay rent before the 7th day of the month, in any month, during the initial lease term or any renewal period, in

Concessions attributed to that month. Furthermore, Residents shall owe the full amount of rent as stated in the Rental Agreement, as if
no concessions were given for that month, plus any applicable late charges as a result of Residents being delinquent. In the event
Residents are asked to vacate the Leased Premises, evicted or move out prior to the expiration date of the initial lease term or any
renewal period, Residents shall reimburse Owner, upon demand, the full amount of Concessions. Residents must also pay all other
rent, fees, charges or sums due to Owner as a result of Residents’ failure to comply with the terms and conditions of the Rental
Agreement. Residents acknowledge that Concessions constitute a discount of rent only and not a discount of any other fees, charges,
or sums which Residents may be required to pay under the terms and conditions of the Rental Agreement.

Concessions indicated above are given to Residents as an incentive and with the understanding that Residents will fulfill all obligations
under the Rental Agreement through the initial lease term or any renewal period. If Residents do not meet the terms and conditions of
the Rental Agreement for any reason whatsoever, Concessions specified above will be withdrawn and the discounted amount shall be
due and payable in full to Owner by Residents upon Owner’s demand.

DISCLOSURES TO RESIDENTS
The following disclosures are made to Residents concerning matters that may affect you while living n the apartment community. If any
information contained in this Exhibit is of concern to Resident, Resident is encouraged to contact the applicable agency for further
information.

1. NO SECURITY. Regardless of the presence of electronic gates, on-site personnel, patrol cars, cameras, alarm systems or other
features that may be present in the Community, Landlord provides no assurance regarding the security or protection of
Residents within the Community. Any personnel, systems or devices used by Landlord are precautionary measures but are not
guarantees against crime. All systems are subject to human error, absenteeism, mechanical malfunctions and tampering.
Residents should always proceed as if such systems do not exist and use common sense in protecting themselves and their
property. Failure of any security system provided by the Landlord shall not serve as a basis for diminution of Resident’s
obligations under the agreement or as a basis for early termination of the agreement.

A maximum of one (1) vehicle(s) per approved applicant, with a maximum of two (2) vehicles per apartments, may be parked in
the Community. Permissible vehicles are automobiles, sport utility vehicles, pick-up trucks, mopeds and motorcycles. Parking
is for licensed, with current tags, operational vehicles only. Motorcycles and mopeds must be parked in Resident’s parking space,
not on walkway, patios or courtyards. Unauthorized vehicles including vehicles with expired tags, inoperative vehicles and
improperly parked vehicles will be towed away at vehicle owner’s sole expense. Residents shall not store inoperative vehicles
within the community. Vehicles remaining in the same space for more than thee (3) days will be considered stored and are
subject to towing at vehicle owner’s expense, unless Resident has obtained Landlord’s prior written permission for the storage.
Residents shall not store any personal property of any type other than authorized vehicles within the parking spaces.

2. VIEW; FUTURE DEVELOPMENT. Although your apartment may enjoy some unique view potential, neither Landlord nor the
manager makes any representation concerning the view from your apartment. Any view your apartment may enjoy as of the
date of your move-in may be impaired or obstructed by the installation and growth of trees and other landscaping, as well as
the construction of homes, fences, walls and other improvements within the surrounding area. You agree that you are not
relying on any representation by Landlord, manager or any of the leasing office staff respecting views form your apartment in
making your decision to lease your apartment. Further, no representations are made as to the nature, type or extent of any
future development in the vicinity of this apartment community, including the impact of existing or future roads and other
infrastructure on the community.

3. NOISE; COMMERICAL USES. You are advised to consider the current and potential exposure to noise that you may experience
from activities that occur within and in the vicinity of the apartment community. Potential sources of noise affecting you may
arise from, but are not limited to, automobile traffic, entry gates, roads, emergency facilities, construction activity, fire alarm
testing, church bells or chimes, aircraft over flights, and nearby commercial uses. The Community is located adjacent to various
retail stores, and trash pickup, delivery trucks and other operational uses may create additional noise. No representations are
made as to the impact of current or existing noise levels on you or your apartment.

4. CONSTRUCTION INCONVENIENCES. In the case of construction in the vicinity of the Community, Resident may experience noise,
dust, traffic and other inconveniences related to such construction activities.

Please acknowledge that you have read and understand the above disclosure by signing below. You further acknowledge that your
decision to lease an apartment in this community is not based on any representation regarding the matters described herein other than
as provided in this disclosure. You are encouraged to get additional information regarding any matter of concern to you from the
applicable agency offices referenced above.

FITNESS CENTER AGREEMENT

The fitness center is for the EXCLUSIVE use of Nightingale Residents only. To keep
everyone safe, a parent or guardian must accompany residents who are 12 to 17 years old when they use the fitness center.
Residents who are 12 years old or younger will not be allowed in the fitness center. Hours of operation shall be
24 Hours . In order to prevent unauthorized use of the fitness center residents agree not to allow anyone
into the fitness center unless he/she has used their own unit key to enter. All using the fitness center will be required to wear shirts and
shoes. Food, glass, smoking and alcoholic beverages are not permitted in the fitness center. No playing or loitering will be allowed in
the fitness center. Please be advised that the fitness center is not supervised, so Residents will only use the premises and equipment at
their own risk. Nightingale will leave a copy of the owner’s manual to use the machines at
the fitness center. If you would like a copy of the owner’s manual, please let us know and we will provide you one.

Nightingale shall NOT be held liable for any damages or personal injuries
sustained by residents in the use of the fitness center equipment. If you are unfamiliar with the equipment, please refrain from
using it until you have read the owner’s manual for operating instruction. Residents with heart or similar conditions are advised not
to use the equipment without first consulting their physician. Before starting any exercise program it is advisable to talk with your
Doctor.

I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions
stated above.

BIKE STORAGE ADDENDUM
