Dear Sir,
Further to your quotation and subsequent discu.ssions held with you, we are pleased to
award you the above mentioned work as per terms and conditions and Bill of
quantities mentioned below:

Contract Value:-
The total Contract Va.Lue is Rs. LT,OOOl- (Rupees seventeen Thousand only)

9. The entire work will be executed as per schedule of work. Your part amount will
be withheld, if your work progress is found unsatisfactory.
10. If the job done does not meet the sterndards and speci{ications set by developer,
the developer may terminate the contract.
11. You will carry out the work in coordination with various agencies and as per our
instructions. You will submit daily report to the Project Engineer as per the
format supplied to you.
12. You will submit work schedule to us, so as to enable us to plan the material
procurement and payment schedule accordingly.
13. You will follow all State and Central (iovernment or Local Body Rules, as
applicable to your work.
14. A11 the works sha1l be finished in acceptable workmanship and as directed by the
Architect/Project Manager and sha11 be as per I.S. code and TMC specifications.
15. A11 Labours should have valid identity cards
16. You should verify Police records of all empioyees.
17. You should have valid labour License from the labour commissioner.
18. You should always keep the work place/site clean & strictly observe HSE rules as
advised.

19. Electricity & water:


The owner sha1l provide electricity & Water free of cost to you at site upto one
point further tapping in Contractors scope.

20. Storaqe of Materials.


a) Lockable storage area/room shall be provided to Contractor for storing the
materials issued by owners if possible, however safety of these materials is in
your scope.
b) Contractor shall shift your storage area if need arises without any extra cost to
the owner.

21. Supplv of labour & Materials:


a) By owner: Nil
b) By contractor:-As per BOQ.
22. Workmanship
If the workmanship is not approved by the owners then the cost of redoing the
work the work and the cost of the materials shall be recovered by the owner
from contractors R.A" Bill at the sole discretion of the owners.

23. Housekeeping (If Applicable)


Evcryday contractor shall bring down his debris to ground floor and stack the
same''e..i. sr-ritable location as directed. Faiiing which the owner sha,ll arrange to
get the rLebris down and debit the cost in contractor's R.A. Bill with 30%
additionai charges other than market rates"

24. Pavment Terms


1. 100% Payment after Completion of work.

25. Defect Liability


Your rvork is guaranteed against Supply of Defective material & Poor
workmanship for a rninimum period of 12 months after virtual completion of
work. You shall rectily if an-v defects arise during this period to our satisfaction

26. Completion Period-
You shall submit schedule of work at site & jointly agreed with our Site
Incharge"

27. Safety Requirements at Site:


Contractor should take adequate precautions for safety at site by providing
Safety helmets, Safety belts, Shoes & Gloves etc. to workmen while
working/movements at site. A11 Electrical lines, temporaryf permanent at site
should be checked before usage to ensure safety of workmen. If any accident
occurs at site due to negligence of the above mentioned safety norms, the
contractor will be solely responsible for all the consequences arising out of the
above and the client is absolved of any claims/compensation if any payable by
the contractor to his workmen or any third party.

31. Arbitration:
A11 disputes and differences arising between the parties hereto in respect of this
Agreement/work order and/or any disputes or differences related to
interpretation or meaning of any provision or term of this Agreement/work order
andlor differences regarding claims of parties against each other andf or rights
and obiigation of the parties under this Agreement/work order, the parties
hereto sha-l1 use their best efforts to resolve such dispute or difference amicably
by mutual negotiations. Failing which all disputes which have not been
amicably settled shall be referred to sole arbitrator, Advocate Shri Prashant
Kadam and M/s. PRISH. Hereby give consent for appointment Advocate Shri
Prashant Kadam as Arbitrator. The arbitration proceeding shal1 be conducted as
per provisions of Arbitration and Conciliation Act, 1996 and modification
thereafter. The parties have agreed that the venue for the arbitration proceeding
shall be at Thane only and only Thane courts shall have exclusive jurisdiction
on such dispute between the parties.

32. Termination:
The Developer due to non performance of the Contractor may terminate this
contract with immediate effect. In such event, the Developer shall have no
liability towards the contractor for any claim of damage or loss of business or
otherwise.
