ORGANIZATION AND RESPONSIBILITIES

1. ORGANIZATIONAL STRUCTURE

1.1. NAC’S management structure includes Executive Management, Senior Management, Flight Operations
Support Personnel and Flight Crew.

1.2 NAC’s Chief Executive Officer has the ultimate corporate authority for ensuring that all operations and
maintenance activities can be financed and carried out to the standards required by the South African
Civil Aviation Authority and any additional company requirements.

1.3 NAC’s Responsible Person Flight Operations shall in turn be appointed by and responsible to the Chief
Executive Officer for ensuring that air operations are conducted in accordance with national and
international regulations and standards and company operating policy. NAC’s Flight Operations
Organizational Structure is set out below:

2. DAY TO DAY MANAGEMENT AND CO-ORDINATION

2.1 The day to day management and co-ordination of NAC’s operation shall in turn be handled in
accordance with the following management structure which shall work closely together with the
nominated post holders identified above.

3. NOMINATED POSTHOLDERS

3.1 The Following persons are appointed as the Responsible Persons and Post Holders in the required
positions as indicated below and are responsible for the execution of the duties and functions of their
respective positions in accordance with the relevant stipulations of the CAR’s, CATS and this
Operations Manual.

3.2 Changes in the nominated post holder positions of NAC shall be referred in writing to the Air Service
Licensing Council and International Air Services Council for approval. Once approval is obtained, these
changes may then be published as an amendment.

4. DUTIES, RESPONSIBILITY AND AUTHORITY OF NAC PERSONNEL

4.1 CHIEF EXECUTIVE OFFICER (ACCOUNTABLE MANAGER)

4.1.1 RESPONSIBILITIES

The Chief Executive Officer hereby undertakes that he will take any actions as may be
required to exercise his responsibilities and to give effect to his commitment to safety and
reliability of NAC’s air service operations

As the CEO he has corporate authority for ensuring that all operations, maintenance, quality
and safety activities can be financed and carried out to the standards required by the
Authority and any additional company requirements.

The CEO is responsible for providing the necessary resources and facilities to enable the
nominated Responsible Persons to perform their assigned tasks for which they are
responsible, in order to ensure safe operations and airworthy aircraft. The CEO shall
furthermore be responsible to:

(a) Ensure that this Operations Manual is established, approved , implemented,


maintained and adhered to.

(b) Designate persons to fulfil certain tasks for which they must accept responsibility and
accountability. In addition he must ensure that such persons so designated shall
exercise their authority and execute their authority and responsibilities in accordance
with the stipulations of this Manual and the CARS and the CATS.

(c) Ensure that NAC at all times fully complies with the provisions of the Act and the
Regulations, as well as any other applicable aviation legislation.

(d) Financial and administrative control of the air services in accordance with its budget.

(e) Ensure the validity and currency of the air service licences and Part 127 and Part 138
Operating Certificates.

(f) Take any actions as may be required to exercise his responsibilities or to give effect
to safety and reliability.

(g) Issue any instructions deemed necessary in the provision of an air service that will
provide the passenger with the best service.

(h) Ensure that flight operations, aircraft and personnel matters comply with the
stipulations of the CAR’s and the CATS.

(i) He must be contactable by NAC at all times.

(j) Serve as a permanent member of the SQAM Committee.

(k) Address all problems experienced and anticipated.

4.1.2 AUTHORITY

The CEO shall have the authority to:

(a) Implement the necessary actions as may be required to give effect to the quality safety
and reliability of the air service in accordance with the stipulations of this Manual.

(b) Issue any instructions deemed necessary in the provision of an air service that shall
provide the client with the best possible air service.

(c) Take any action as may be required to exercise his/her responsibilities or to give effect
to his/her commitment to safety and reliability.

(d) Take financial, administrative and operational decisions in accordance with NAC’s
budget and resource requirements and to approve operational budgets and business
plans.

(e) Stop or prohibit any unsafe or unreliable flight operation.

(f) Liaise with the clients on their needs and requirements.

(g) Appoint the required Responsible Persons and Managers as required.

(h) Conduct, initiate, order, assist or give support to investigations into accidents,
incidents, occurrences or hazards.

(i) The Responsibilities and Authority of the Chief Executive Officer may be delegated
in the absence of the Chief Executive Officer, during which time the duly delegated
Chief Executive Officer shall then assume all the aforementioned responsibilities
and authority which normally vests with the absent Chief Executive Officer.

4.1.3 DELEGATION OF AUTHORITY

Should the CEO not be able to execute his responsibilities and/or authority, the CEO, or
failing the ability of the CEO to make such appointment, the Board of Directors, shall
designate a member of the Board of Directors to fill this post and the responsibilities and/or
authorities associated with it.

4.1.4 CHIEF EXECUTIVE OFFICER DECLARATION

I, M.S. Banner, in my capacity as Chief Executive Officer for National Airways Corporation,
hereby accept the authority, responsibilities and accountability for duties as set out above
and I will at all times adhere to it.

4.2 RESPONSIBLE PERSON OPERATIONS (MANAGER HELICOPTER OPERATIONS

4.2.1 RESPONSIBILITIES

The Manager Helicopter Operations is responsible to the Chief Executive Officer for the safe
and efficient operation of the flying section of NAC. The Manager Helicopter Operations shall
be NAC’s appointed Persons Responsible Flight Operations. The Manager Helicopter
Operations must be contactable by NAC at all times. He is responsible for:

(a) the overall discipline, welfare and morale of flight crew, cabin crew members and
operational personnel;

(b) the supervision of general administration and for the efficient functioning of the
flying section of NAC as a whole;

(c) ensuring that all reports of operational irregularities including incident and accident
reports are properly investigated, resolved and actioned as necessary. He will
address items of operational significance brought to his attention by staff members.

(d) determining flight crew establishments and the associated training programmes
necessary to meet present and future operational requirements;

(e) participating in the activities and functions of the NAC’s Aviation Safety Committee
in terms of NAC’s Safety Management System;

(f) ensuring the optimum use of flight crew resources and that all flight crew under his
control have the appropriate knowledge, qualifications, skills, experience and training
to perform their assigned duties;

(g) Ensuring, in conjunction with the Chief Pilot and Training Captain the maintenance of
proper records regarding flight operations in general, and the proficiency of individual
flight crew members in particular;

(h) Serve as a permanent member of NAC’s SQAM Committee.

(i) He must be contactable by NAC at all times;

(j) Ensure that the Operations Manual is established, implemented, maintained and
adhered to;

(k) the safe and efficient operation of the flying section of NAC.

4.2.2 AUTHORITY

The Manager Helicopter Operations shall have the authority to :

(a) stop or prohibit any unsafe or unreliable flight operation;

(b) liaise with NAC’s clients on their needs and requirements;

(c) conduct, initiate, assist or give support to investigations into an accident, incident,
occurrence or hazard;

(d) withdraw any flight crew member from flying duties in the interest of flight safety; and

(e) appoint aircrew and flight operations personnel.

4.2.3 DELEGATION OF AUTHORITY

Should the Responsible Person Flight Operations not be able to execute his responsibilities
and / or authority, the CEO shall designate a Manager, or alternatively a member of the NAC
Board of Directors, who shall fill this post and assume the responsibilities and / or authorities
associated with it.

4.2.4 RESPONSIBLE PERSON FLIGHT OPERATIONS DECLARATION

I, A. Brown, in my capacity as Responsible Person Flight Operations for National Airways


Corporation, hereby accept the authority, responsibilities and accountability for duties as set
out above and I will at all times adhere to it.

4.3 PERSON RESPONSIBLE AIRCRAFT

4.3.1 RESPONSIBILITIES

The Person Responsible Aircraft is responsible to the Chief Executive Officer for ensuring
that the air service operates in a safe and reliable manner with regard to aircraft maintenance
and engineering. The Person Responsible Aircraft must be contactable by NAC at all time.
In this regard the Person Responsible Aircraft shall be responsible to:

(a) Ensure that each aircraft used in providing the air service is airworthy and serviceable
for flight;

(b) Ensure that all work performed by the AMO on aircraft, aircraft components, aircraft
engines, aircraft engine components and other specified items or equipment are done
in accordance with the requirements of the manufacturer’s handbooks or manuals
and the Approved Maintenance Schedules as required in terms of the provisions of
the Civil Aviation Regulations, 2011;

(c) Ensure that the provisions of this Manual are fully complied with in respect of aircraft
operated by NAC;

(d) Ensure that all maintenance personnel have the appropriate knowledge, qualifications,
skills, experience and training to perform or supervise their assigned duties;

(e) Ensure that all maintenance personnel at all times fully comply with this Manual;

(f) Advise NAC’s Quality Assurance Manager of any maintenance and engineering
related changes required to this Manual;

(g) Co-ordinate aircraft maintenance scheduling with maintenance personnel and


assigned AMO’s

(h) Ensure that all maintenance records are properly maintained by the responsible
AMO’s.

(i) Monitor the responsible AMO in order to ensure that all applicable Aircraft Service
Bulletins and Airworthiness Directives are complied with;

(j) Oversee the general aircraft condition on a day to day basis to ensure that the aircraft
are maintained in a good and clean condition at all times.

(k) Serve as a permanent member of NAC’s SQAM Committee.

(l) Ensure that all monthly payments in respect of engine and airframe maintenance
contracts are remitted by no later than the last working day of each month;

(m) He must be contactable by NAC at all times.

(n) Ensure that the air service operates in a safe and reliable manner with regard to
aircraft maintenance and engineering.

4.3.2 AUTHORITY

The Person Responsible Aircraft shall have the authority to prohibit the use of any
unsafe or unreliable aircraft, aircraft component, aircraft engine, aircraft engine component or
any other specified item or equipment.

4.3.3 DELEGATION OF AUTHORITY

Should the Responsible Person Aircraft not be able to execute his responsibilities and / or
authority, the CEO shall designate a manager, or alternatively a member of the NAC Board of
Directors, who shall fill this post and assume the responsibilities and/or authorities associated
with it.

4.3.4 PERSON RESPONSIBLE AIRCRAFT DECLARATION

I, H. Hanekom, in my capacity as Person Responsible Aircraft for National Airways


Corporation, hereby accept the authority, responsibilities and accountability for duties as set
out above and I will at all times adhere to it.

4.4 QUALITY ASSURANCE MANAGER (MQA)

4.4.1 RESPONSIBILITIES:

NAC’s MQA reports directly to NAC’s CEO and is responsible for providing an independent
overview of NAC’s activities and assistance on Quality matters to Managers at all levels.
The MQA tasks and responsibilities are the following:

(a) Formulation of Organisational objectives, plans, policies, programmes and


procedures concerning NAC pertaining to the Organisational OM and Maintenance
Control Manual.

(b) Implementation of organizational Quality Management System pertaining to the OM


and Maintenance Control Manual.

(c) Development, maintenance and implementation of said plans, policies, procedures


and programmes in line with organization implementation plan timeframe.

(d) Continuous improvement and development of said documentation to keep the


organisation in line with customer requirements, CAA regulatory requirements and
International Aviation Standards.

(e) Establish an Audit Program

(f) The Manager Quality Assurance shall ensure that all operational documents are
controlled.

(g) The Manager Quality Assurance shall ensure the Internal/External Audits are
documented.

(h) The Manager Quality Assurance shall issue Quality Alert Notice if Audit concerns
need to be communicated to the organisation.

(i) Auditing, internally (Base), externally (outstations) local and foreign supply chain
against set out audit criteria in an effort consolidate and standardise all operational
and supply chain quality assurance activities.

(j) Conduct training relating to the Quality Management System ensuring all personnel
are aware of the MOE and Maintenance Control Manual, its function within the
organization and each individuals responsibility there in.

(k) Be a permanent member in the Safety and Quality Assurance Review (SQAM)
committee.

(l) Constructing and monitoring an engineering quality system.

(m) Establishing and ensuring compliance with the engineering quality audit program.

(n) Prepare audit reports and dispatch it to the Chief Executive Officer and Director of
Maintenance. Discussing with the Chief Executive Officer what follow up action will
be required by contracted Maintenance Organizations to rectify any faults found
during the audit.

(o) Undertake audits in accordance with the annual audit program assisted by the Quality
Auditor.

(p) Making recommendations to the Chief Executive Officer, which will affect closure of
the reports.

(q) Liaison with the contracted maintenance organization to ensure that the audit
discrepancies are actioned in a timely and appropriate manner.

(r) Filing reports once closed and ensuring that they are kept together with all forms and
correspondence in connection with the quality audit for 5 years following the audit.

(s) Perform roll and responsibilities as set out in the MOE and Maintenance Control
Manual under the “Duties and Responsibilities” section.

(t) Promoting quality achievement and performance improvement throughout the


organization

(u) Setting QA compliance objectives and ensuring that targets are achieved

(v) Perform other related duties as may be required from time to time.

3.4.2 AUTHORITIES

The Quality Assurance Manager shall furthermore have the authority to:

(a) stop or prohibit any action or operation which contradicts policies and procedures as
set out in the organizational MOE and Maintenance Control Manual;

(b) stop or prohibit any action or practice that is unsafe or unreliable in conjunction with
the CEO;

(c) enforce adherence to the Quality Manual, procedures, policies and work instructions

(d) On Quality Assurance matters, the Quality Assurance Manager has direct and
immediate access to the CEO and all management and is authorised to conduct
audits in connection with any aspect of the operation.

4.4.3 DELEGATION OF AUTHORITY

Should the MQA not be able to execute his responsibilities and/or authority, the CEO shall
designate a Manager, or alternatively a member of the NAC Board of Directors, who shall fill
this post and assume the responsibilities and/or authorities associated with it.

4.4.4 QUALITY ASSURANCE MANAGER DECLARATION

I, R. Diamond, in my capacity as Quality Assurance Manager for National Airways Corporation,


hereby accept the authority, responsibilities and accountability for duties as set out above
and I will at all times adhere to it.

4.5 SAFETY MANAGER

4.5.1 RESPONSIBILITIES

The Safety Manager shall report directly to NAC’s CEO with respect to the implementation
and maintenance of NAC’s SMS program and will report any significant safety concerns with
unacceptable risk to the CEO. The Safety Manager will be responsible to:

(a) develop a systematic plan for NAC, which will allow it to reach the standards of
safety and efficiency required by SMS policies and shall be responsible for day to day
activities of Safety;

(b) ensure that all Aviation Safety Occurrence Reports, Non-Conformance Reports and
“Good Show Reports” are processed through NAC’s Safety Committee where
applicable and initiate any corrective actions considered necessary;

(c) conduct Risk Assessments on recognized safety risks and establish risk mitigating
procedures for recognized risks;

(d) promote a climate of interest and engagement, where the individual will be encouraged
to report Aviation Safety Occurrences and deviations from NAC standards.

(e) ensure that reported Aviation Safety Occurrences and deviations from NAC standards
are processed and action taken to rectify them;

(f) co-coordinating the SACAA’s Mandatory Occurrence Reporting scheme and liaise
with the heads of all departments company-wide on flight safety;

(g) act as Chairman of NAC’s Flight Safety and SQAM Committees arranging its meetings
and keeping records of such meetings;

(h) be a permanent member of NAC’s SQAM committee;

(i) maintaining an open liaison with manufacturers’ Flight Safety and QA departments,
government regulatory bodies and other flight safety and QA organizations world-
wide;

(j) assisting with the investigation of accidents and conducting and coordinating
investigations into incidents;

(k) manage or have oversight of the FOQA Programme;

(l) participate in corporate strategic planning;

(m) ensure that a continuous improvement methodology is implemented within NAC;

(n) ensure that staff are aware of the requirement for the implementation of corrective
actions necessary to maintain or regain the necessary standards of safety and
efficiency;

(o) monitor flight safety trends and compliance with the regulatory requirements, and any
other standards defined by the Civil Aviation Regulations, to ensure safety at the
workplace;

(p) ensure that any changes / revisions are conducted in a controlled manner and that
the integrity of the SMS System is maintained during such change / revision;

(q) review, at planned intervals, the SMS to ensure its continuing suitability, adequacy
and effectiveness. The review shall evaluate the need for changes to the SMS,
including but not specifically limited to policy and objectives;

(r) ensure that SMS program records, which provide evidence of conformance to
requirements and effective operation of the Safety Management System, are identified
and controlled, providing as necessary for: identification, storage, retrieval, protection,
retention time, and disposition of this program;

(s) plan an SMS audit program in conjunction with the Quality Assurance Manager,
taking into consideration the status and importance of the activities and areas to be
audited as well as the results of previous audits.

4.5.2 AUTHORITY

NAC’s aviation Safety Manager shall have the authority to:

(a) stop or prohibit any action or operation, which could jeopardize the safety of the air
service of NAC;

(b) stop or prohibit any action or operation that is unsafe or unreliable in conjunction with
the CEO;

(c) conduct, initiate, order, assist or give support to investigations into accidents,
incidents, occurrences or hazards.

(d) report any irregularities and / or shortcomings to the CEO or the organization to NAC’s
Board of Directors.

4.5.3 DELEGATION OF AUTHORITY

Should the Aviation Safety manager not be able to execute his responsibilities and / or
authority, the Chief Executive Officer shall fill this post and assume the responsibilities and /or
authorities associated with it.

4.5.4 SAFETY MANAGER DECLARATION

I, A. Correia, in my capacity as Safety Manager for National Airways Corporation,


hereby accept the authority, responsibilities and accountability for duties as set out above and I
will at all times adhere to it.

4.6 AVIATION SECURITY MANAGER

4.6.1 RESPONSIBILITIES

NAC Aviation Security Manager must be contactable by NAC at all times and shall report to
the Executive Director Flight Operations. NAC’s Aviation Security Manager shall have the
duties and responsibilities as set out in NAC’s Security Manual. Furthermore the Aviation
Security Manager will be responsible for and shall have the authority to:

(a) Establish and maintain an effective Security Management (SEMS) System.

(b) Be the central point of contact with the SACAA Security division for NAC

(c) Conduct threat and risk assessments on recognized security risks

(d) Monitoring of preventative measures and aviation security trends

(e) Liaising with the heads of all departments on aviation security matters

(f) Be a permanent member in the Safety and Quality Assurance Review (SAQR)
committee.

(g) Maintaining an open liaison with customer security departments, government


regulatory bodies and other aviation security organizations

(h) Carry out security audits and inspections ,including base audits

(i) Maintaining familiarity with all aspects of the NAC activities and its personnel.

(j) Ensure that an effective security audit schedule is maintained and implemented

(k) Ensure that corrective action on security audit findings are addressed and
Implemented on a timely basis.

(l) Developing, implementing and maintaining the NAC Security Programme.

(m) Developing of Security Training and ensuring that ALL NAC staff is trained in
accordance.

(n) Manage and monitor the issuance of employee/crew cards and access control cards
for NAC facilities and aircraft.

4.6.2 AUTHORITY

The Aviation Security Manager shall have the authority to:

(a) stop or prohibit any action or operation, which could jeopardize the security of the air
service of NAC;

(b) stop or prohibit any action or operation that is unsafe or unreliable in conjunction with
the CEO;

(c) conduct, initiate, order, assist or give support to security investigations into accidents,
incidents, occurrences or hazards.

(d) report any irregularities and / or shortcomings to the CEO or the organization to
NAC’s Board of Directors.

4.7 CHIEF PILOT

4.7.1 RESPONSIBILITIES

The Chief Pilot shall report directly to the Manager Helicopter Operations for the co-ordination
and control of all flight crew. The Chief Pilot shall be responsible:

(a) for crew scheduling and the exercise of control over the discipline, general welfare
and morale of flight crew members in conjunction with the Manager Helicopter
Operations;

(b) for ensuring the optimum utilization of flight crew to meet operational requirements
together with the Manager Helicopter Operations;

(c) to investigate new routes, equipment and or airport navigational facilities in order to
ensure that the minimum standards of NAC’s operational requirements are satisfied;

(d) to ensure that all flight crew members comply with the requirements of the CARs;

(e) for advising and assisting the Responsible Person Flight Operations of procedures that
could contribute to safer and / or more economical and efficient operation of aircraft and
maintaining operating standards;

(f) for the co-ordination and control of flight training and maintaining flying standard. He
will further ensure standardization of instructional and flight techniques;

(g) to control proficiency checking requirements on behalf of NAC with regard to all initial
and periodic flight training including subsequent route competency and instrument
rating checks. He will undertake to ensure that training and competency checking
requirements are completed with minimum disruption to the normal flight operations;

(h) to ensure that training files and complete documentation records are maintained for
each flight crewmember;

(i) to ensure that CAR’s requirements in respect to the renewal or upgrading of pilot
licenses have been timeously complied with;

(j) to liaise closely with training organizations and to submit recommendations, which
may serve to enhance NAC’s training requirements and / or procedures;

(k) to serve as a permanent member of the SQAM Committee.

4.7.2 AUTHORITY

The Chief Pilot shall have the authority to :

(a) prohibit the use of any Flight Crew and who do not satisfy the particular license or
regency requirements of the CAR’s and this Operations Manual;

(b) discipline or recommend the disciplining of flight crew members;

(c) select appropriate training organizations to satisfy NAC’s training requirements.

4.7.3 CHIEF PILOT DECLARATION

I, M.Gouws, in my capacity as Chief Pilot for National Airways Corporation, Helicopter Division

4.8 CHIEF TRAINING CAPTAIN

4.8.1 RESPONSIBILITIES

The Chief Training Captain shall be responsible for:

(a) the co-ordination and control of the flight training of NAC in conjunction with the Chief
Pilot;

(b) maintaining flying standards in consultation with the Chief Pilot and Responsible
Person: Flight Operations. He will further ensure standardization of instructional and
flight techniques among flight training personnel;

(c) the co-ordination and control of flight training, including but not specifically limited, to
the control of initial and periodic flight training and subsequent proficiency checks,
route competency and instrument rating evaluations;

(d) ensuring that all training files and complete documentation records are maintained for
each individual flight crew member. Training reports are to be countersigned by the
crew member concerned;

(e) ensuring that all CAR’s requirements in respect of the renewal or upgrading of pilot
licenses have been complied with;

(f) ensuring that all CAR’s requirements in respect of the renewal or upgrading of pilot
licenses have been timeously complied with;

(g) developing training courses and standard operating procedures, in conjunction with
the Chief Pilot for new aircraft types;

(h) conduct an effective flight training administration system;

(i) liaise with the Chief Pilot and Manage Helicopter Operations to ensure that training
and competency checking requirements are completed with minimum disruption to
the normal flight operations.

(j) the Chief Training Captain will undertake any other duties as may be assigned to him
by either the Responsible Person Flight Operations or the CEO.

4.8.2 DELEGATION OF AUTHORITY

In the absence of the Chief Training Captain or should the Chief Training Captain not be
available to execute his responsibilities and / or authority, the Chief Pilot shall fill this post and
the responsibilities and / or authorities associated with it.

4.9 OPERATIONS MANAGERS

4.9.1 RESPONSIBILITIES

NAC’s Helicopter Charter Division is responsible for the day to day operations of all South
African Operations departing from Grand Central Airport as well as over border Operations;
furthermore NAC provide Part 138 Air Ambulance support missions to clients as required.
NAC’s CT Helicopter Operations Division provides helicopter charter flights from the Cape
Town Waterfront and Cape Town International Airport.

Each NAC Helicopter Division shall have an Operations Manager, this Operations Manager
must be contactable by NAC at all times and shall report to the Responsible Person Flight
Operations. The Operations Manager shall be responsible for:

(a) ensuring that all Operations instructions are carried out, that manuals are amended
or updated and that aircrew and other staff records are maintained;

(b) the co-ordination and control of all flight operations;

(c) supervising personnel scheduling and exercise control over discipline of the flight
crew and flight operations personnel as may be applicable to his / her respective
division;

(d) the general welfare and morale of the personnel within the Flight Operations
Department;

(e) an effective communication and assistance channel with operational bases at all
times;

(f) ensuring an effective security oversight with regards to flight operations;

(g) liaising with clients and handling agents with regards to flight operations at bases;

(h) ensuring effective communications between operations and all other NAC divisions;

(i) ensuring that operational procedures and documentation is continuously updated and
distributed;

(j) the co-ordination and control of Aircrew and Operations Personnel training;

(k) He will ensure that training files and complete documentation records are maintained
for each individual Aircrew and where applicable Operations Personnel;

(l) serving as a permanent member of the SQAM Committee;

(m) ensuring that flight operations facilities are established at all bases for the effective
control of operational requirements;

(n) ensuring proper assistance to each finance department;

(o) ensuring that all reports of operational irregularities including incident and accident
reports are properly reported, resolved and auctioned as necessary;

(p) He will be required to perform any other duties assigned to him by the Responsible
Person Flight Operations.

(q) He must be contactable by NAC at all times.

4.9.2 AUTHORITY

Each Operations Manager shall have the authority to:

(a) stop or prohibit any unsafe or unreliable flight operation;

(b) liaise with the clients on their needs and requirements;

(c) conduct, initiate, order, assist or give support to investigations into any accident,
incident, occurrence or hazard;

(d) institute disciplinary actions against any flight operations personnel;

(e) suspend any flight crew member on just cause and reasonable considerations.

4.9.3 DELEGATION OF AUTHORITY

Should the Operations Manager not be able to execute his responsibilities and / or authority,
the Executive Director Operations shall designate a manager who shall fill this post and the
responsibilities and/or authorities associated with it.

4.10 Base Manager

3.10.1 For duties and responsibilities of the Base Manager, refer to the Base Standard Operating
Procedures Manual.

4.11 Pilot-in-Command (“PIC”)

4.11.1 Responsibilities

NAC will nominate one of the pilots to be in command for each flight or series of flights
undertaken for or on behalf of NAC. The PIC shall take all reasonable steps to:

(a) maintain familiarity with all relevant aviation regulations, notices, circulars and
procedures;

(b) maintain familiarity with the contents of this Operations Manual and other relevant
publications;

(c) communicate with the Chief Pilot on a regular basis with reference operational and
maintenance issues that may affect his / her specific environment.

It is the specific responsibility of the PIC to:

(a) ensure the safe operation of the aircraft and safety of its occupants and cargo
during flight time;

(b) report directly to the Chief Pilot;

(c) have authority to give all commands he deems necessary for the purpose of securing
the safety of the aircraft and of persons or property carried therein, and all persons
carried in the aircraft shall obey such commands;

(d) have the authority to disembark any person, or any part of the cargo, which in his
opinion, may represent a potential hazard to the safety of the aircraft or its
occupants;

(e) not allow a person to be carried in the aircraft who appears to be under the
influence of alcohol or drugs to the extent that the safety of the of the aircraft or its
occupants is likely to be endangered;

(f) have the right to refuse transportation of inadmissible passengers, deportees or


persons in custody if their carriage poses any risk to the safety of the aircraft or its
occupants;

(g) ensure that all passengers are briefed on the location of emergency exits and the
location and use of relevant safety and emergency equipment;

(h) ensure that all operational procedures and checklists are complied with, in
accordance with this Operations Manual;

(i) ensure that the weather forecast and reports for the proposed operating area and
flight duration indicate that the flight may be conducted without infringing any minima
as stated in this Operations Manual;

(j) decide whether or not to accept an aircraft with unserviceabilities allowed by the
DDPM/MEL;

(k) take all reasonable steps to ensure that the aircraft, and any required equipment is
serviceable;

(l) in the absence of qualified person or engineer, ensure that the refuelling is
supervised with particular attention being paid to:

(i) the correct grade and the amount of fuel;

(ii) fuel water checks;

(iii) fire safety precautions;

(iv) checking filler caps for security and correct replacement after refuelling;

(v) sign on behalf of the engineer on the flight folio on items requiring MEL defer;

(m) take all reasonable steps to ensure that the aircraft mass and balance is within the
calculated limits for the operating conditions

(n) confirm that the aircrafts performance will enable it to complete safely the proposed
flight;

(o) not permit any crew member to perform any activity during take-off, initial climb, final
approach and landing except those duties required for the safe operation of the
aircraft;

(p) take all reasonable steps to ensure that before take-off and before landing the flight
crew are properly secured in their allocated seats;

(q) take all reasonable steps to ensure that whenever he considers it advisable (e.g. in
turbulent conditions), all passengers are properly secured in their seats, and all cabin
baggage is properly stowed. He should encourage the use of seat belts throughout
the flight;

(r) ensure and be responsible for all documents and manuals as specified in the CAR’s
including this Operations Manual are carried and the will remain valid throughout the
flight or series of flights;

(s) ensure that the pre-flight and security inspection has been carried out;

(t) ensure that a minuted NAC base safety meeting is held weekly;

(u) not permit:

(i) a flight data recorder to be disabled, switched off or erased during flight nor
permit recorded data to be erased after flight in the event of an accident or an
incident subject to mandatory reporting;

(ii) a cockpit voice recorder to be disabled or switched off during flight unless he
believes that the recorded data, which otherwise would be erased
automatically, should be preserved for incident or accident investigation nor
permit recorded data to be manually erased during or after flight in the event
of an accident or incident subject to mandatory reporting;

Not all helicopters are equipped with Flight Date and Cockpit Voice
NOTE:
Recorders.

(v) maintain and ensure that all NAC employees maintain a high standard of discipline,
conduct and appearance as representatives of NAC as per the company code of
conduct;

(w) in an emergency situation that requires immediate decision and action, take any
action he considers necessary under the circumstances. In such cases he may
deviate from rules, operational procedures, and methods in the interest of safety;

(x) the PIC has the authority to apply greater safety margins, including aerodrome
operating minima, if he deems it necessary;

(y) the PIC must ensure that should maintenance be required whilst away from base that
the Responsible Person: Aircraft, be contacted for advice;

(z) the PIC shall ensure that a continuous listening watch is maintained on the
appropriate radio frequencies at all times during the various phases of flight;

(aa) ensure that all operational documentation is completed as per NAC and the client’s
requirements;

(bb) ensure that when on NAC base operations, the required documentation be returned
to base as per the NAC Operational Procedures;

(cc) provide NAC Operations Management with a weekly flight report as per NAC
Operational Procedures;

(dd) ensures that any occurrence that is deemed to affect the safety of the operations or
personnel be reported to the SM: SQA in a timely manner.

(ee) will after arrival in South Africa on completion of a tour of duty report to the Main
Base of Operation on the 1st day before his/her rest period starts;

(ff) ensure that occurrences and incident are reported to the NAC Safety manager and
MQA within 48hrs or as per the CAR’s requirements;

(gg) ensure that the insurance limitations of the aircraft insurance are complied with;

(hh) has the right to report safety infringements directly and anonymously to the CSQA;

(ii) ensure that all licenses and relative documents in the CAR’s are current, valid and
copies have been submitted to the Chief Pilot 14 days before expiration of the
relevant document;

(jj) When on home reserve be contactable and be able to report for duty within 2 hours.

(kk) The ultimate decision for final safe dispatch of the aircraft rests with the PIC of the
aircraft as NAC Helicopters do not have dispatchers. The PIC will be responsible for
self-dispatch. Even though other NAC Staff might assist the PIC with dispatching
duties it will stay the ultimate responsibility of the PIC.

4.12 First Officer/Co-Pilot

4.12.1 Responsibilities

The First Officer/Co-Pilot is responsible to the PIC to assist in the safe and efficient conduct
of the flight. In the event of the incapacitation of the PIC, the First Officer/Co-pilot will
assume command. The First Officer/Co-Pilot must take reasonable steps to:

(a) maintain familiarity with all relevant aviation regulations, notices, circulars,
procedures and the contents of this Operations Manual as are necessary to fulfil his
function;

(b) assist the PIC as requested, concerning administrative duties in relation to the flight;

(c) support the PIC in the maintenance of a proper standard of crew discipline, conduct
and personal appearance.

It is the specific responsibility of the First Officer / Co-pilot:

(a) to carry out such duties concerning the flight, in accordance with NAC Standard
Operating Procedures, including procedures, limitations and performance as are
allocated to him by the PIC;

(b) to confirm the safe navigation of the aircraft, maintaining a continuous and
independent check upon both the geographical position of the aircraft and its safe
terrain clearance;

(c) complete the navigation log and flight folio as per NAC Operational Procedures;

(d) to volunteer such advice, information and assistance to the PIC, as may contribute
favourably towards the safe and efficient conduct of the flight;

(e) to maintain a high personal standard of discipline, conduct and appearance as a


representative of NAC;

(f) to support the PIC, active example in the development and maintenance of a high
standard of professional expertise and morale amongst the crew;

(g) to ensure that any occurrence that is deemed to affect the safety of the operations or
personnel be reported to the SM: SQA in a timely manner;

(h) when on home reserve be contactable and be able to report for duty within 2 hours;
and

(j) personnel be reported to the Safety manager in a timely manner.

4.13 Aircraft Engineering and Maintenance

4.13.1 All aircraft used in providing the air service shall comply with the aircraft engineering and
maintenance provisions of the CAR’s, Part 66, Part 145 and SA-CATS-AMO.

4.13.2 All aircraft which are used in providing the air service shall have a valid Certificate of
Airworthiness issued in accordance with the CAR’s. All aircraft which are used in providing
the air service shall be inspected, constructed, repaired, overhauled, maintained or modified
in accordance with the CAR’s.

4.13.3 Flight folios and logbooks for aircraft, aircraft engines, aircraft components, aircraft engine
components and other specified item or equipment shall be kept, preserved and maintained
in accordance with the provisions of the CAR’s.

4.12.4 All aircraft, aircraft engines, aircraft components, aircraft engine components and other
specified item or equipment that is/are owned, hired or exclusively managed by NAC, which
are used in providing the air service, shall furthermore be engineered, maintained, inspected,
constructed, overhauled, repaired and modified in accordance with the Manual of Procedure
of each specific Approved Aircraft Maintenance Organization (AMO) listed hereunder.

4.13.5 The Executive Director Maintenance shall ensure that the mentioned AMO is licensed in
accordance with the provisions of the CAR’s and NAC’s Maintenance Control Manual, to
carry out maintenance on the aircraft being operated by NAC.

4.13.6 Notwithstanding any other provisions in this Section, no aircraft shall be operated by NAC,
unless the Executive Director Maintenance has satisfied himself that:

(a) A copy of the AMO licence, of the AMO maintaining a particular aircraft, as well as
the Certificate of Airworthiness (or a certified true copy thereof) of that aircraft, is kept
on file by NAC; and

(b) A copy of the defect report, if any, at the termination of the last previous flight of an
aircraft, plus a copy of the documentation relating to the defect removal of such a
defect, shall be kept on file by NAC;

4.13.7 Documentation referred to above, shall be made available, on request, to any inspector
authorised by the Director for Civil Aviation.

5. APPROVED MAINTENANCE ORGANIZATION

Refer to NAC’s Maintenance Control Manual

6. TYPES OF MAINTENANCE TO BE DONE BY AMO'S:

MPI's, inspections, general repairs, inspections and modifications (full maintenance).

7. CATEGORIES AND RATINGS OF AMO'S:

As endorsed on AMO license certificates.

8. CHANGE MANAGEMENT

8.1 Change Management will be handled in accordance with NAC’s Executive Safety Committee or SQAM
Committee and shall be responsible for effective Change Management and shall be required to identify
the associated risks in respect of the change

8.2 The Executive Safety Committee or SQAM Committee shall minute the specific key task and Change
Management plan and required to follow up on the progress of the Change Management plan on a
weekly basis.
