The Lodger Agreement Bedroom 2
Between
1. Mr. Vikas Pai of the Property 5, Eastbourne Grove, Bolton, BL1 5TR (the Landlord)
2. _______________ of ___________________________________________ (the Lodger)
Grant of license
7. The Landlord grants and the Lodger accepts a license to occupy the Room at the Property for
the Term at the Rent with the right to use the Common Areas on the terms contained in the
Agreement
8. The Lodger acknowledges that this agreement is an excluded license from the Protection of
Eviction Act 1977 as the Lodger lives in the same dwelling as the Landlord
9. The Lodger accepts that this Agreement does not grant an assured or assured shorthold
tenancy as it is a letting granted by a resident landlord
10. The Agreement is personal to the Lodger
11. The Room is part of the Property with fixtures and fittings as set out in the Inventory
12. The Landlord gives the Lodger (in common with the other occupiers of the Property), the
right to use the Common Areas
13. If the Lodger has the use of the Landlord’s furniture, these are listed on the inventory. The
Lodger will
a. Not damage or remove any of the items in the Inventory from the Property; and
b. Make good all damages and breakages of the items on the Inventory which may
occur during the Term; and
c. Keep the items in the Inventory in clean and good condition
Lodger’s Obligations
14. To pay the Rent and all other sums due under the Agreement (whether formally demanded
or not) clear of all deductions at the agreed times
15. To pay any overdue Rent and other sums due subject to an interest of 6% per annum (above
Bank of England base rate) calculated from the date payment is due upto the date payment
is received by the Landlord
16. To pay a reasonable and proportionate contribution of all charges of gas, electricity, oil,
water, sewerage or other services used at the Property not included in the Rent
17. To keep inside of the Room clean and in a good condition and not damage the Property or
any part of it;
18. Not to take any lodgers or assign, sublet, charge or part with or share occupation of the
Room or any part of it;
19. To use the Room as single private home and not to carry any trade, profession or business
on or from the Property
20. Not to keep any pets at the Property
21. Not to cause any nuisance to any of the neighbouring properties or to any other person at
the Property
22. Not to use the Room for any immoral or illegal purpose
23. Not to carry out any internal decorations of the premises without previous consent in
writing from the Landlord
24. To report to the Landlord any defect or repairs for which the Landlord is responsible
25. To permit the Landlord at reasonable times to enter and check the condition of the Room
26. The Lodger does not have right to exclude the Landlord from any part of the Property
27. On leaving the Property
a. Give the Landlord a forwarding address
b. Remove all rubbish and personal items from the Property
c. Return all the keys to the Property to the Landlord
28. The Lodger will not have exclusive possession of the Room
29. To keep the bins (red, black, green and beige) at the front of the property before Tuesday
morning for collection. The bins shall not be overfilled or wrongly filled which may attract
any fines for which the Lodger will be fully responsible for payment
Landlord’s Obligations
30. The Landlord will pay the council tax of the Property
31. The Landlord will pay all the utilities bills already included in the Rent
32. The Deposit to be held in an account by the Landlord for the Term as a security against the
Lodger’s failure to pay the Rent and other sums due under the Agreement or non-
performance of the obligations within this Agreement. The deposit will be returned to the
Lodger at the end of the Term less any outstanding Rent or other sums or reasonable
deductions properly made by the Landlord to cover any reasonable costs incurred with
cleaning the Room and/or belongings left behind by the Lodger
33. The Landlord will carry out any repairs or defect to make the stay in the Room and at the
Property convenient for the Lodger during the Term
Termination
34. The agreement will end at the end of the Term or earlier in accordance with the clauses
below
35. Either the Landlord or the Lodger may anytime during the Term terminate this Agreement
by giving to the other Early Termination Notice either in writing or verbally. On expiry of the
notice, this Agreement will end
36. If the Lodger breaches any of the Lodger’s obligations contained in the section above, the
Landlord may at any time during the Term terminate the Agreement by giving the Lodger
one week notice. On expiry of the notice, this Agreement will end
37. Termination under this clause will end the Agreement with no further liability for either
party save for the existing breaches
