SUBJECT: ‘LEGAL NOTICE’ Under Sections 138(3)(b) of The


Negotiable Instrument Act, 1881.

DEAR SIR/S,
Under the instruction and request of Mr. Nur Mohammad Mia, hereinafter
referred to as “MY CLIENT”, I do hereby serve you with this legal notice, as
under: -

1. That my client is a law abiding citizen and a retired service holder and you
the notice receiver is the nephew of my client. After his retirement you
have borrowed in total of Tk. 20,00,000/= (Twenty Lac Taka) from my
client on _________ to inject cash inflow to your business with the
condition to return fixed cash incentive at a rate of Tk. 40,000/= per
month against the said investment in favour of my client;

2. That my client has put his trust on you and gave you loan from his hard
earned pension money and other sources but you the notice receiver have
failed miserably to pay all the accrued dues in due time, in consideration
of the amount received from my Client. Despite repeated requests for
payment and even after the rescheduling of payment obligation, you have
failed to fulfill your commitments till date;

3. That the total arrears owed by you the notice receiver in respect of the
loan amount is approximately of Tk. 35,00,000/= (Thirty Five Lac Taka
only) till date, which has been increasing month by month;

4. That my Client has made several attempts to recover the said amount from
you. But, in all those instances, you avoided the meetings and did not
honour your commitments to pay the total outstanding amount in
installment or at its entirety till date and as a result of that my Client has
suffered irreparable loss even he had to sell his fond car to adjust his own
personal liabilities;

5. That in order to set off your liabilities, and to recover partial amount from
the total outstanding amount, my Client has submitted two bank cheques,
provided by you the Notice Receiver for encashment, before the Sonali
Bank Limited, Kalyanpur Branch, Dhaka and the said Cheques have been
dishonoured on 13.06.2021 and 16.06.2021 respectively along with
dishonour slips encrypting a note “Account Closed/dormant/blocked”
and “Insufficient Fund” respectively. Description of the Cheques are given
below-

6. That since, the cheques have been issued by you the Notice Receiver, and
has been dishonoured by your Banks on 13.06.2021 & 16.06.2021,
therefore, you the notice receiver, are hereby given this Legal Notice under
Sections 138(3)(b) of the Negotiable Instrument Act, 1881 and cordially

requested to pay my Client the total value of the dishonoured cheques


amounting to Tk. 21,00,000/= (Twenty One Lac Taka only), within 30
(thirty) calendar days from the date of receipt of this notice.

On the basis of the foregoing facts and circumstances,


I call upon you by this Legal Notice and request you to
pay the amount of Tk. 21,00,000/= (Twenty One Lac
Taka only), as partial payment from the total
outstanding amount of Tk. 35,00,000/= (Thirty Five
Lac Taka only) owed to my Client within the next 30
(Thirty) Calendar days from the date of receipt of this
Legal Notice.

In the event of failure, I have received clear instruction


from my client to initiate indispensable legal action
against you and your firm before the competent
Criminal and/or Civil Courts of Law without any
further notice.

In that occasion, you and your business organization


shall be held responsible for all the costs and
consequences thereof in this matter.

A copy of this Legal Notice has been retained in my office for future reference.
