PARTICULAR OF CLAIM

(1) The plaintiff is Tshoganetso Galesupelwe an adult female of full legal capacity whose address for the
purpose of this action is P.O.box 255, Rakops village. Residential plot number 325 Matsharatshara
Ward ,Xhumo village.

(2) The defendant is Leonard Mangalane an adult male of legal capacity whose address and Residential
plot number for the purpose of this action are not known to the plaintiff and better known to the
defendant.
Employeed by Security services located at Shashe village.

(3) Locus Standi

3:1 The plaintiff is a resident and domiciled in Botswana.

3:2 The plaintiff and defendant can sue and be sued in their names.

3:3 The defendant is part of the agreement which gives the plaintiff cause of action.

3:4 The default in payment by the defendant directly affect the plaintiff.

(4) JURISDICTION.

4:1 The plaintiff is a resident within the jurisdiction of the court.

4:2 The court has originally jurisdiction to hear and determine civil matters which limits does not exceed
p80.000.00 which plaintiff’s claim is within the confines of the said cap:

(5) On or around the year 2021 the plaintiff and the defendant entered into agreement of loaning the
defendant the sum of P1500.00.

(6) The terms of the agreement were as follows:

6:1 The defendant was to pay back the money loaned to him in a space of a month.

6:2 The plaintiff did give the defendant p1500.00.

(7) The defendant never paid back the aforesaid sum of money as per the arrangement terns.

(8) The plaintiff contacted the defendant on both of his cellphone numbers mentioned as per above ,
however she was given empty & false promises by the defendant.
(9) Consequently the defendant is indebted to the plaintiff in the sum of P1500.00.

(10) Despite due and lawful demands the defendant is refusing to pay the plaintiff wherefore the
plaintiff prays for judgment against the defendant in the following terms;

(A) Payment in the sum of P1500.00.

(B) Cost of the suit.

(C) Further and/ alternative relief.
