Subject: Reply to your letter dated 03.09.2021 regarding non-delivery and loss of goods

Mam’,

This reply is with reference to captioned letter dated 03.09.2021 mentioned in subject line sent by you
regarding non-delivery and loss of goods. At outset the undersigned being partner of Response Cargo
Movers before providing para-wise reply to the referenced letter denies all the bogus contents therein being
a sham and raised to avoid the liability of overdue payment owed by our firm for services provided to your
firm.

In reply to the first para it is vehemently denied that your firm is an authorized branch of our firm, there has
never been any principal and agent relation between us during the course of the business association since
October 2019. The relationship in between us has been on principal to principal basis where you were
booking customer goods load from Bhadohi and forwarding the same to us for forward transportation. Also it
needs to be mentioned that your firm has been directly billing the customers for their individual loads while
our invoices were raised on your firm basis the total amount of load provided for a particular date. Further it
is denied as alleged by you that the goods of three (03) parties were sent to Delhi through our firm and the
same was not distributed, it is clear from the ambiguous details provided in your letter itself which are not
the actual invoices raised by us on the relevant dates mentioned i.e. 20.08.2020, 28.11.2019 & 29.10.2019
therefore the question of return of such goods is out of context. All other allegations that are raised in the
para are irrelevant and have no commercial effect hence denied.

In reply to the second para it is denied that your firm has sent goods worth Rs. 30 Lakhs with our knowledge
and information which has been misappropriated by our firm and that the same is not being returned till
date. These tactics are being employed from your side to wriggle out of your liability of overdue payment
towards our firm to a tune of approx. Rupees Nine Lakhs till date.
The contents of the third para are baseless and bogus therefore require no reply. Further it may be noted
that any sham litigation initiated by your firm will be responded appropriately by us with facts and relevant
records maintained at our offices.

Further you are again being called upon through this reply to clear your liability of overdue payment towards
our firm to a tune of approx. Rupees Nine Lakhs with immediate effect failing which we shall be constrained
to take appropriate legal action against you and your firm, both civil as well as criminal, which shall be
entirely at your costs, risk and consequences. This reply is without prejudice to all other legal rights and
remedies available to us for the above stated purpose.
