This Plan is designed to assist personnel in dealing with an unexpected discharge of oil. Its primary
purpose is to set in motion the necessary actions to stop or minimize the discharge and to mitigate its
effects. Effective planning ensures that the necessary actions are taken in a structured, logical and
timely manner.
The Plan envisioned by regulation 37 of Annex I to the Convention is intended to be a simple document
to guide the master through the various actions and decisions required during an incident. Extensive
background information on the ship, cargo, etc., has been intentionally avoided, as this information is
generally available elsewhere.
Plan Review:
Regular review of the Plan by the owner, operator or master on an annual basis is recommended to
ensure that the specific information contained therein is current. An annual review of the Plan will allow
quick capture of changes in local law or policy, contact names and numbers, ship characteristics, or
company policy.
After the use of the Plan in response to an incident, its effectiveness should be evaluated by the owner
or operator and modifications made accordingly.

1. Article 8 and Protocol I of MARPOL 73/78 require that the nearest coastal state should be notified
of actual or probable discharges of oil to the sea. The intent of the requirement is to ensure that
coastal states are informed without delay of any incident giving rise to pollution, or threat of pollution,
to the marine environment, as well as the need for assistance and salvage measures, so that
appropriate action may be taken.
2. The reporting procedure to be followed by the Master or another person in charge of the ship after
an oil pollution incident is based on guidelines developed by the International Maritime Organization.1
See Appendix 2 of this plan for a copy of the reporting procedures.
3. If the ship is involved in a pollution incident, reports must be made both to coastal state or port
contacts, as appropriate, and to contacts representing interest in the ship.
4. A flow chart indicating the reporting procedure to be followed in accordance with the MARPOL
requirements follows.

Reports should be transmitted by the quickest available means to the responsible authorities
of the nearest coastal state or the Rescue Co-ordination Center (RCC) via the appropriate shore
radio station. If the ship is within or near to an area for which a ship reporting system has been
established, reports should be transmitted to the designated shore station of that system.
The following additional information should be sent to the owner or operator either at the same
time as the initial report or as soon as possible thereafter:
Further details of damage to ship and equipment.
Whether damage is still being sustained.
Assessment of fire risk and precautions taken.
Disposition of cargo onboard and quantities involved.
Number of casualties.
Damage to other ships or property.
Time (UTC) assistance was requested and time (UTC) assistance expected to arrive
at the scene.
Name of salvor and type of salvage equipment.
Whether further assistance is required.
Priority requirements for spare parts and other materials.
Details of outside parties advised or aware of the incident.
Any other important information.
After transmission of the information in an initial report, as much as possible of the information
essential for the safeguarding of life and the protection of the ship and the marine environment
should be reported in a supplementary report to the coastal state and the owner or operator, in
order to keep them informed of the situation as the incident develops. This information should
include items P, Q, R, S and X, as appropriate.
Examples of initial reports follow, together with an example of a format, which may be found
suitable for direct transmission.

*The previous Example Report is based on an incident involving an oil tanker, and is inserted
intentionally.
In order to expedite response and minimize damage from a pollution incident, it is essential that the
appropriate international coastal states are notified without delay. This process is begun with the initial
report. Guidelines for compiling reports are provided in Section 2.2. This Plan includes, in Appendix 4,
a list of agencies or officials of administrations responsible for receiving and processing reports. In the
absence of a listed focal point, or where the responsible authority cannot be contacted by direct means
without delay, the Master should contact the nearest coast radio station, designated ship movement
reporting station or Rescue Co-ordination Center (RCC) by the quickest available means.
Notification of local agencies will speed response. The variety of trades in which ships engage may
make it impractical to list local agencies in the Plan.
If an oil spill occurs when the vessel is in port, whatever the cause, it is the Master's duty immediately to
activate the vessel's Company Contingency Team and report the incident. Precise details of whom to
notify locally should be obtained prior to or on arrival, but the following is a guide (not necessarily in the
order given):

In the case of a natural death of a crew member or passenger the CRF1 will not be required.
Additionally, Malaysia/Singapore Flag vessels are required to contact the authorities listed below when
an incident involving them occurs: -
The Master is responsible for reporting any incident in United States waters involving a spill to:
USCG National Response Center, or if no contact – the local Captain of the Port
Where a Qualified Individual (QI) is appointed the regulatory authority reporting may all be done via that
QI. However, if the Master is in any doubt, he shall at least make the report to both the USCG and the
QI. If all reporting is done through the qualified individual, the QI shall subsequently provide
confirmation of same to the Master.
All follow-up reports by the Master shall be reported to any appointed Qualified Individual. If the
function of the QI transfers to someone else on site, the Master is to report to that "relieving" QI unless
instructed to do otherwise.
f. Agent
The Qualified Individual will coordinate any follow-up reporting to be done, including to the USCG
Captain of the Port (COTP) as the designated Federal On-Scene Coordinator (FOSC).
In the event of a serious incident, ship's personnel may be fully engaged in saving life and taking steps
to control and minimize the effects of the casualty. They should therefore not be hampered by having
non-essential communications requirements imposed upon them.
A list of ship interest contacts is detailed in Appendix 1, which also indicates the order of priority for
notifying those concerned. After office hours contacts are included.
All further reports and copies of messages sent to coastal states and/or port authorities should be sent
to the company. If required, the company's office will be staffed as soon as possible after receipt of an
initial report.
Once initial reports have been made, the company's corporate plan will ensure that other interests such
as flag state authorities, P&I Club and classification society are notified and kept up to date on the
incident.
Great care in casualty response must be taken to consider stability and stress when taking actions to
mitigate the spillage of oil or to free the ship if aground. Internal transfers should be undertaken only with
a full appreciation of the likely impact on the ship’s overall stress and stability. When the damage
sustained is extensive, the impact of internal transfers on stress and stability may be impossible for ship
personnel to assess. Contact may have to be made with the operator, manager or other entity in order
that information can be provided so that damage stability and damage longitudinal strength assessments
may be made.
2.4.2 Information to be provided by Crew to Shore-Based Personnel to Facilitate the Assessment of

If vessels have such contracted services only, See Appendix 1 for the vessel-specific contact
information. MARPOL 73/78 Annex I, Reg. 37.4 require all tankers of 5,000 tons deadweight or more to
comply to this requirement.
2.4.4 Plans/Vessel’s Condition

For current cargo, ballast and bunker quantity and quality data, refer to the record of the ship’s
departure condition (File G – Chief Officer’s filing system).
In the event of a casualty, Masters are authorized to sign a Lloyd’s Standard Form of Salvage
Agreement. Refer to Appendix 3. This contractual agreement allows a rapid decision to be made by
the Master regarding towing or other assistance from the salvors in case of an emergency.
2.5.2 Salvage Tugs and Salvage Brokers
If time permits, assistance from salvage tugs can be requested through the Management Office.
2.5.3 ICS/OCIMF Publication Peril at Sea and Salvage: A Guide for Masters
Enclosed is the ICS/OCIMF Publication Peril at Sea and Salvage: A Guide for Masters as a ready
reference for the Master’s guidance in the event of a casualty.
See Appendix 5.
The Company Contingency Team has the responsibility for the overall direction and implementation of
the response to casualties and spills. In effect, the Company Contingency Team is the spill management
team during incidents involving spills or threat of a spill, for areas outside the United States. The primary
duty of the Company Contingency Team is to ensure that the Master is fully supported and to engage
authorities, agencies and resources as outlined in this plan.
The Company Contingency Team responsibilities may, dependent on the location and nature of the spill,
include:

Liaison with local national and flag state authorities or other authorities
Spill operation
Planning
Logistic support and telecommunications
Finance
Insurance
Legal
Appropriate emergency manning – being prepared for an emergency on a 24-hour basis.

representing the Company Contingency Team for the vessel.
A spill management team, designated by the Master, will implement mitigation, recovery and clean-up
procedures immediately. The team is to have all necessary training in use of whatever equipment or oil
absorbents the vessel has onboard. Each member of the team will have instruction on what his duties
are in an oil spill situation.
The Shipboard Response Team may be composed as follows, augmented by off-duty personnel.

If operational oil spills are caused by a failure of equipment in machinery spaces any further
operations of this equipment should be stopped immediately or measures are to be taken to
avoid an oil spill.
Such equipment may be:
- Oily-water separating equipment or oil filtering equipment to de-oil bilge water from
the engine room bilges.
- Valves in pipes connecting ballast/bilge systems.
- Gearing of bow thrusters.
- Stern tubes.

3.3.4 Collision
The primary concern following a collision is that steps be taken to save the crew and vessel. The ship’s
collision station bill is designed to accomplish this and the duties of the crew are contained therein.

3.3.5 Fire and Explosion
The primary concern following a fire and/or explosion is that steps be taken to save the crew and
vessel. The ship’s firefighting station bill is designed to accomplish this and the duties of the crew are
contained therein. There are, however, considerations and responsibilities consistent with both saving
the crew, vessel and preventing pollution.

3.4.2 Crew Functions to Develop Information - With or Without Shore Assistance
The following structure, to be augmented as necessary by the Master, defines the function of the ship’s
crew in carrying out key tasks and developing essential information to develop an action plan with or
without shore assistance.

The procedures for ship to ship transfers are found in a separate transfer procedure and lightering plan
onboard the vessel, and/or are to be carried out in accordance with the ICS/OCIMF Ship to Ship Transfer
Guide (Petroleum). Refer to the operational/safety checklists in that guide, and to the following safety
procedures under Internal Transfers in Section 3.5.3.
3.5.2 Safety Considerations for Emergency Ship to Ship Transfer
Establish communications with the Coastal State authority if transfer is to occur within a
specific jurisdiction.
Establish communications with lightering vessel.
Prepare detailed procedure for the transfer operation.
Layout mooring lines and fendering.
Top-up the proper derricks and deck cranes.
Clear anchors for use if necessary.
Verify ship stability and stress.
Provide safety briefing to crew.
Internal bunker transfer:
use portable air compressors or steam generators to operate pumps if no power
available;
use approved portable submersible pumps with power packs if cargo piping is
damaged.
3.5.3 Safety Considerations for Emergency Internal Transfer
Verify existing and future stability and stress.
Prepare detailed procedure for transfer operation.
Ensure adequate internal communications.
Check compatibility of bunkers.
Provide safety briefing to crew.
Ensure integrity of all containment devices.

portable containers for recovered waste
non-sparking portable pumps, hand shovels and scoops
emulsifiers for cleaning deck
3.5.4 Salvage
The Master should not hesitate to make a decision when he estimates that repair of the casualty,
especially engines, will not be complete before the vessel drifts dangerously close to the nearest land
or hazard to navigation.
In determining this, he must take into consideration, maximum possible drift rate, possible deterioration
of weather, nearest tugs, tug power and speed and possible time for connecting up towage in severe
weather.
Towing and lightering operations have great potential for preventing catastrophic releases of oil once a
casualty has been sustained. It is vital therefore that the master, Deck Officers and appropriate crew
become thoroughly familiar with the provisions of related guidelines developed by industry and the
International Maritime Organization (IMO).
The master shall also be thoroughly familiar with the provisions of Lloyd’s Standard Form of Salvage
Agreement, (LOF). (Refer to 2.5.1 and Appendix 3)
Detailed towing procedures are contained in Peril at Sea and Salvage, A Guide for masters prepared
by ICS and OCIMF Lightering procedures are contained in Peril at Sea and Salvage and further
elaborated in Ship to Ship Transfer Guide (Petroleum), also prepared by ICS and OCIMF. These
publications shall be kept onboard in the library maintained by the Pollution Emergency Officer.
The master is required to place excerpts of Peril at Sea and Salvage in Appendix 5 for easy
reference.
For guidance, a typical 12-barel kit made by a reputed firm contains the following items:-

Note: Additional equipment requirements specified in applicable state plans shall also be complied with.
The above equipment shall not be used for general purposes. If any of the equipment is used for actual
oil spill response purposes or is otherwise damaged, re-ordering should be done immediately. The
removed bunker oil and the used clean-up material should be retained on board in proper containment
units until it can be discharged to a reception facility.
List of ship specific equipments and storage location are included herein for easy reference.
Use a portable pump,to draw oil spilled on deck and pump into any available tanks after taking
necessary safety precautions, proceed to clean the area with sorbents, or sawdust, rages, and cleaning
agent/oil surfactant.
Note: Spilled oil must never be washed overboard, nor shall the use of dispersants or degreasers
be used on oil that has spilled into the water.
Information on the use of oil pollution response equipment can be found on/within the container
provided, elsewhere as posted in the cleanup equipment locker or as given during training.
As a minimum:
Use the material as per the manufacturer’s instructions only.
Ensure that all necessary safety precautions are followed considering the characteristics of
the cargo.
Plan for and ensure that all used absorbent material and recovered product is disposed of
safely and properly, and in accordance with any site disposal plans as relevant.
The quantity and quality of the cleanup equipment and materials provided should be maintained to the
original amounts and usable condition.
3.7.3 Mitigating Activities
Once the spill is under control and immediate safety of ship and personnel addressed, the Master
should ensure that personnel onsite are assessed for threats to their health – short and long term, and
that proper Protective Equipment is available for present and future activities.
Dangers of toxic vapours should be recognized and unnecessary personnel removed from the area.
Toxic gas detectors are carried onboard should be used as necessary. Dampers are to be isolated by
using barriers.
Systems shall be set up for decontamination of personnel prior entering clean areas. Careful attention
should be given to storage and eventual disposal of removed oil and oil soaked material.
It is essential that record keeping be complete and accurate and not speculative.

Subsequent to ensuring that the necessary notifications have been made, the ship's Master should
ensure that the appropriate communication is established so that the plan-designated response
resources can be set in motion to initiate an immediate response.
It must be remembered, though, that the Master's primary responsibility is first, the safety of the crew
and vessel, and secondly, to stop the outflow of oil and take actions necessary to prevent the spill or
the potential of the spill from getting worse.
In most instances, the source of leakage of spill will be obvious but there will be cases, such as at night
or during low visibility days, where the source will be difficult to identify or it might be difficult to observe
smaller oil leakage on the sea surface. In such cases, a simple white cloth sufficiently weighted and
suspended over the ship's side may give the best indication of the source of the oil outflow.
If no source of an oil leak is identified but there is cause to suspect a leak due to a reduced oil tank
level or oil observed on the water surface, it may be necessary to request the oil spill response
contractor or agent to arrange for a diver to carry out an underwater inspection to locate the source.
If the oil has gone over the side, there is very little, if anything, that the crew can accomplish to remove
the oil from the water.
Over the side cleanup activities will not normally be undertaken by ship's crew, but may be authorized by
the Master if consistent with the safety considerations and in the best overall interest of the cleanup.
GENERAL
Quick, efficient coordination between the ship and coastal state or other involved parties becomes vital
in mitigating the effects of a pollution incident.
In most countries it is accepted that an oil spill can be tackled most effectively from the shore and there
is normally no requirement on the part of the shipowner or the ship/s crew to organize the clean-up
response in respect of oil lost overboard. In the case of casualties, the responsibility for organizing and
controlling the clean-up response is usually assumed by an agency of government. In both cases the
spiller would be expected to cooperate fully, and pay the reasonable costs of clean-up and any damages
caused, up to a specified limit of liability based on the tonnage of the ship.
It is vital to quickly establish efficient coordination between the ship and the coastal state so that
agreement can be obtained to any planned mitigation procedures before they are implemented.
Initial reports as per Reporting Procedure Sec. 2, should be sent to the nearest coast radio station on
appropriate frequencies in the bands:
405-525 kHz, 1605-2850 kHz or 156-174 MHz or
by Satellite communication as described in Inmarsat Users Manual
Where such stations are equipped with telex, then the vessel’s Inmarsat system should be used to
transmit reports.
If the ship is not within reach of an MF or VHF coast radio station, then the report should be sent to the
most appropriate HF coast radio station.
In cases where the ship is within, or near to, an area where a ship movement reporting system is in
operation, such report should be sent to the designated coast radio station of that system.
Similarly, if in area covered by a Rescue Coordination Center (RCC) the reports should be routed to such
RCC. For details of the locations and procedures for communicating with RCC’s refer to the IMO
MERSAR manual carried on board.

Whenever clean up or oil recovering action are taken by the vessel, to mitigate the effects of an oil
pollution incident, the Master should advise the local authorities and clarify roles and responsibilities of
the ship and coastal state and/or local authority and keep close contact between the ship and coastal
state, etc.
The Master should notify the local coordination center of the identity of the vessel’s responsible person
for clean up and recovery action.
Very stringent responsibilities have been imposed by the United States federal and state authorities for
all vessels trading in US waters jurisdiction.
The US Oil Pollution Act of 1990 also applies to dry cargo vessels trading in US waters. However, no
federal approved response plan is required. Since the federal law (OPA’90) does not preamp state law,
some states have implemented Vessel Contingency Plan requirements.
The vessels covered in this plan have a 24-hour contact for any pollution incident in North America through
the Company’s QI. Their contact numbers are listed in Appendix 1 Vessel Specific Information.
Vessel Response Organization: the vessel shall have onboard the name and telephone numbers of
two oil spill removal organizations identified as capable of providing a timely response to an oil spill at
the ship’s intended port of call, and at any portion of the route to and from said port of call. The list of
the Texas Certified Designated Cleanup Organizations can be found in Appendix 6.
All ships of 400 or more gross tons that carry oil as cargo and fuel, as well as oil tankers of 150 or more
gross tons, must meet the following requirements:
Declaration Letter:
The declaration letter must be completed and onboard the vessel prior to the vessel entering Canadian
waters. The letter provides the following information:
the name of the insurer;
provides the name of the individual responsible to implement the response plan with 24- hour
accessibility; and
identifies the certified response organization with whom an arrangement for clean up activity
has been made.
Canadian Response Organization Contracts:
A contract must be in place with the proper response organization for each zone in which the vessel will
operate.
4.1.5 Shore-side Spill Response Contractors
Response Contractors where required by legislation are mentioned in the vessels USA VRP and
California Contingency Plans. These Contractors have met governmental standards for amount of
response resources required to be held.
4.1.6 Planning
At quarterly drills, an estimate should be made to decide the sufficiency of the ships equipment and/or
available shore side equipment. Manager should be notified if this seems insufficient.
5 NON-MANDATORY PROVISION
The vessel specific plans are located onboard the vessel ready for use in an emergency. Refer also to
Ch.2.4.4.
Should any repair or refit change any of the above listed plans, they shall be replaced by the revised
diagrams. One copy of each changed plan/drawing shall be sent to the Company.
Refer to Ch.3, sec.7 for details of the oil spill response equipment available on board.
If any of the equipment is consumed during exercises or any actual spill response, the inventory must be promptly
replaced by, at the very least, the equivalent quality and quantity of the equipment used.
The news media can have a huge impact on the image of our company, customers, and the shipping
industry in general. Indeed, the actions and response requirements of the authorities may well be media
driven. Thus, it is critical that the information provided to the media is correct - projecting deep concern,
positive action according to plan, and liaison with the local and national authorities to eliminate or
mitigate the emergency. For this reason, the designated company spokesman will coordinate all press
releases, and otherwise organize and coordinate additional spokesmen as appropriate.
Where shipboard and local/on-scene company personnel have to respond to the media, they should
only report known facts, not give any conjecture on causes, or other opinions, and politely refer the
media to the above referenced company spokesman for additional information.
It is not the intention of this guide to instruct ships’ officers on how to conduct formal interviews or hold
a press conference. If a press conference is held, it will be arranged and conducted by the company
media personnel.
In a major spill in the USA, the USCG will arrange a Joint Information Center (JIC) to provide information
to the public and to the media. Within that office, public relations contractors will have a specific media
management function (in concert with the owner, manager, legal counsel, QI and P & I club) - initially
with the Coast Guard if possible, or independently if working with the Coast Guard is not possible. On
completion of any unavoidable responses to media inquiries, ship personnel should always refer the
media representatives to the USCG Joint Information Center for scheduled press briefings, press
releases and for further information.
It is the responsibility of the Master that shipboard exercises are conducted and recorded in accordance
with the frequency outlined in the company’s policies and procedures. The SOPEP plan should be tested
during the on board exercises and the Master should design the exercises in such a way that encourage
a critique of the plan as well as the response equipment. At the discretion of the Master, the exercises
shall be executed, announced and unannounced, and the scenarios shall vary from month to month.
Management should be notified of any recommendations as a result of such exercises.
Exercises that focus on procedures for potentially catastrophic events shall be conducted in accordance
with the casualty risk
All users of the Plan have the responsibility of pointing out changes that affect the validity or use of the
Plan. Update information may originate from the vessel, the ship owner/manager, and/or the plan
preparer, as a result of experience in using the Plan during drills or actual discharges, changes of contact
information, or regulatory changes. Regular review of the Plan by the Master will ensure that it remains
current.
Appropriate revisions will be made by Management whenever there is a change in guidelines, laws or
regulations, contact names and numbers, ship characteristics, or Management policy.
The document review body is responsible to make sure the Plan is reviewed annually, incorporating any
update information he has received. They will provide results of the review to the plan preparer who will
perform the Plan changes and submission to the Flag Administration.
This SOPEP Plan will be revised, updated and added to as necessary, but no less frequently than once
a year. Changes in contact names and numbers in the Appendix 1 should take place as they occur.
These sorts of changes in the non-mandatory sections of the plan are not required to be submitted to
the Flag Administration or class for approval. However, this information must be given to the Qualified
Individual.
Changes in laws or company policy which require a rewrite of the plan may have to be approved by the
Administration or Class on behalf of the Administration and should be submitted for assessment and
review as these changes may alter the substance of the plan..
After each spill, the Company Contingency Team will evaluate the effectiveness of the Plan during the
actual spill response, and revise it as necessary.
5.5.4 Revision Control
Initially, every page will be at revision “20” followed by the date the plan was generated in the year,
month, day format.
Each chapter [other than Appendices] have the current revision numbers and date displayed in their
footers. These are also listed in the Table of Contents (TOC). The TOC will be updated to reflect
change/s made to each chapter [other than Appendices].
Vessel specific revision numbers / dates are provided for each appendix. Upon receipt of appendix
revisions, manual holders shall replace obsolete versions and update the Record of Revisions
(Appendix 0).
