The abovementioned minor is allegedly a suspect in a rape case and was

apprehended by the mother of a minor victim.

V. BACKGROUND OF THE MINOR AND FAMILY

A. ABOUT THE MINOR

Valentino was born last January 27, 2004 at Tarlac Provincial Hospital. His
mother died while giving birth to him. His father abandoned him when he was
one year old. He stands 5 feet and 5 inches. He looks healthy with a thin body
built.

Valentino finished his elementary at Aguso Elementary School. He was

not able to attend his junior highschool to attend to his grandfather who suffered
stroke. He was an average child when he was still attending school. The client
is having a hard time in his penmanship and reading . He is fond of playing
computer games. He is friendly and gets along easily with everyone. He was
hired eventually by the owner of the computer shop where he is playing games.
If given the chance he would like to take a vocation course that deals with
Computer maintenance.

B. ABOUT THE FAMILY

Minor’s parents are both from Tarlac City. Minor’s mother died while
giving birth to him. His father abandoned him and has another family. The father
is currently living at Capas, Tarlac. The minor is living with his grandparents from
his mother. Grandfather who is 70 years old suffered stroke and is bedridden.
Grandmother is 65 years old and is doing laundry for their neighbors to augment
the food and medicines needed by the family.

The minor is raised by his grandparents. The grandmother is taking care

of his bedridden husband that is why there is a lack of parental care. The minor
basically tends to himself since his grandparents are old and have a difficulty
both physically and financially.

The child is presently working as a helper at a Computer Shop near their

house in Tarlac City. He is living with his grandparents. The minor was
abandoned by his father who have another family in Capas, Tarlac. His mother
died while giving birth to him.. He was raised by his grandparents .
 C. THE CHILD’S COMMUNITY

Valentino and his grandparents live in old makeshift house that is

attached at the wall of the dam. It is made out of cartons and scrap plywood that
floats along the Tarlac River. It has one room which serves as their living, dining,
and bedroom. During rainy season it also serves as their kitchen. They are
considered as among the indigent family of their barangay.

Most of their neighbors are also indigent since they are considered as
squatters that lives near the walls of the dam along Tarlac River. Few of their
neighbors work as freighters in the near public market or tricycle drivers. Most of
the children are not going to school due to the scarcity of the income of the
families in the community.

VI. ASSESSMENT AND RECOMMENDATION

The minor’s moral development was not fully improved because he

was not being given proper guidance by his parents. He was not given the
chance to have his education but he have a dream of at least finishing a vocation
course. The minor was willing to share his experiences and initiates to ask some
question during the queries. This is the case of the minor who was accused of
raping his girlfriend.

Based on the information and the conduct of assessment of

discernment by the undersigned social worker using several tools it was found
out that minor is with discernment on the charges against him.

As the client is a minor, he must not be legally allowed to be turnover

to jail custody therefore, it is respectfully recommended that minor be admitted at
Regional Rehabilitation Center for Youth ( RRCY ) for rehabilitation and proper
management.
