COMPLIANCE OF CONTRACT

Dear T. Majuru for MKM Construction

It has come to our attention that the project, Unit 9 & 10 – Pagomo which was
due to finished foundation slab work on the 31st of August 2023 has been delayed
till an unknown date. This delay has caused us great inconvenience and has
resulted in additional costs. See current project overview and previous POW
attached.

We would like to remind you that as per the terms of our contract (section 10 sub-
section 10.1.1) timely completion of the project is of utmost importance. The delay
in the completion of the project may lead to termination under (section 12) of your
contract. We had placed our trust in your ability to complete the project within the
agreed timeframe, which unfortunately has not been met.

We expect all contractors working with us to be fully committed to meeting the

project deadlines and fulfill their contractual obligations.
We are therefore issuing you a warning letter regarding the delay in the project
completion and demand that you take corrective measures immediately to expedite
the completion of the project.

Provide a revised Gantt chart on the remaining stages to completion within 24hrs
upon receiving this notice

We urge you to take prompt action and ensure that such a delay does not occur in
the future. We intend to maintain a good working relationship with you, but we
require your full cooperation to ensure that all projects are completed on time.
