Subject: FUNDAMENTAL BREACH OF CONTRACT LEADING TO TERMINATION
Reference is made to your framework contract for roads and drainage element repairs with KCCA
and the Call-Off-Order (COO) prepared for the construction of the drain at Kosovo in Lubaga
Division.
You were issued a commencement order dated 16th October 2023, Pursuit to the provisions of
Sub-Clause GCC 1.1(ff) and GCC 26.1 of the Special Conditions of Contract (SCC), with start
date and commencement dates as 18th October 2023 for three (3) months till 18th January 2024.
The physical progress of 55% is below satisfactory levels compared to time progress.
Please note that;
 You did not submit a performance security per GCC Clause 59.2(f), which is a
fundamental breach of contract that leads to termination.
 GCC Clause 59.2(g) the current rate of progress of the Works as measured against the
time is low, which per GCC Clause 59.2(g) breach of contract which leads to termination.
Provide an updated program of works per GCC Clause 27.2 of the Special Conditions of Contract,
showing the actual progress achieved on each activity and the effect on the timing of the
remaining work, including any changes to the sequence of the activities.
You are hereby instructed to speed up the works and complete them within one calendar month

beyond which we shall invoke GCC Clause 59 of the general Specification of Contract.
