No. A834/23-24 Dated 29 MAR 2024 regarding NEWS LETTER REDEVELOPMENT PROGRESS, I am in receipt of the communication regarding signing the consent form. I being the member have extended my support in the Redevelopment process, I wish to state that I am yet to receive cheque from the society which was delivered by the Developer to the society I have already submitted my KYC documents to the society still I am attaching the fresh copy for your perusal. That, the present tenant is in possession, but his title to the property is in dispute, or under a cloud, I asserts title thereto and being the member I am eligible for any fruits of Redevelopment I have already argued in the Courts that they have missed the main issue as the Tenant /Occupant was merely in custody of the house on behalf of me the Member. Accordingly, a caretaker can never sue a valid title-holder of the property. I have further argued that the caretaker's possession can never be a possession of individual's right With reference to my above mentioned letter I have to state and once again make my humble submission for handing over all/or any benefits arising out of Redevelopment being the member of the society, the out of the suit does not in any way hamper the fact that I am member of the society and till the final disposal of my above mentioned dispute for recovery and possession of the suit flat (premise) belonging and owned by me which is un-lawfully and without any authority has illegally been occupied by …………………………………..who has no right to possess the same without right title interest over it. I have proved my bonafied membership to the society Opponent as Original Individual Member (So U/s 91(1)(b) a member, whereas …………………is a Rank outsider and failed to produce documentary proof (evidences) of his ownership in court, Right Title and Interest over disputed flat (premise) so he should be not to be allowed to participate in any manner in redevelopment process , the Society has admittedly agreed in their W.S. dated on 16-01-1996 by raising preliminary objection in CC/IV/47/95 U/S 9A by saying the order dated 11-2-1994 is without jurisdiction and hence considered null and void. In light of above I request you to give me all the benefits arising out of the Redevelopment as per Provisions of MCS Act 1960
