A JURIDICAL ANALYSIS OF SULTANATE LAND UTILIZATION BASED ON
YOGYAKARTA SPECIAL REGIONAL REGULATION NUMBER 1 OF 2017
CONCERNING MANAGEMENT AND UTILIZATION OF SULTANATE LAND IN GESING BEACH, GIRIKARTO VILLAGE, GUNUNGKIDUL REGENCY
ABSTRACT
The utilization of the sultanate land was regulated in the Yogyakarta
Special Region Regulation Number 1 of 2017 concerning the Management and Utilization of the Sultanate Land. In 2021 the central government together with the provincial government built a new port on the sultanate land which was utilized by the people of Girikarto village, causing conflict. The purpose of this study was to find out the laws and regulations on the utilization of the sultanate land and to analyze the implementation of the law application in Gesing Beach, Girikato Village, Gunungkidul Regency. This study used a normative-empirical method (applied law research). It was a legal understanding in the sense of norms or rules and the implementation of these legal rules. The legal materials used in this research are primary legal materials, secondary legal materials and tertiary legal material. Real behavior was a result of the application of legal norms by using a qualitative descriptive analysis. The framework of this research used the principle of land registration with the principle of legal certainty. The conclusion of this research shows that the utilization of sultanate land is regulated based on applicable laws and regulations in the Special Region of Yogyakarta. The application of legal values and principles is not fully implemented, causing conflicts. The government and the utilizing community do not apply a culture that obeys the applicable laws and regulations. This research reveals the root of the problem that caused the conflict that occurred at Gesing Beach.
