People vs. Abad


(79 PHIL 766)

FACTS:
Accused Francisco Abad was found guilty of the complex crime of
treason with homicide and was sentenced to death. Accused served
as an informer and spy of the Japanese Army and also participated in
the following:
a. A raid conducted by Japanese soldiers at the house of a certain
Magno Ibarra and confined him in the Japanese garrison.
b. He cause the arrest and incarceration of Mr. Francisco
c. Force, coerce and compel a certain Osias Salvador and his two
brothers to go to the Japanese garrison where they were tortured as
guerilla suspects. Osias’ two brothers were able to escape however
Osias died due to his injuries and torture.
d. Took advantage of his connection and influence as spy where
he hand over one Francisco Donato to the Japanese soldiers who
slapped and kicked him for the incident in which Abad was to blame
and threw sugar cane butts to Donato’s wife
The lower court found the accused guilty on the first three counts

ISSUE:
whether or not the court erred in admitting evidence of supposed
treasonable acts.

RULING:
Yes, the two witness rule must be adhered to all of the external
manifestations of the overt act in issue. Both acts may logically be
presumed to have answered the same purpose, the singleness of
purpose is not enough to make one of two acts.
