PREFACE

The materials extracted in this book are designed to be used in conjunction with Principles of
Administrative Law, 3rd edition (Melbourne: Oxford University Press, 2018) (PAL). Whereas in
past editions we have included a broader range of administrative law materials, we decided to
only include case-based material in this edition. This decision in no way implies that materials
drawn from the broader administrative law literature are less important than case law to
understanding administrative law. Quite to the contrary, we believe any well-rounded study
of administrative law will involve the reading of a range of other sources, including statutes,
government reports, and scholarly contributions. Rather, our decision reflects the view that
the selection of such materials is best gauged by reference to the specifics of particular
studies, the pedagogical needs of individual groups of students and the aims of their teachers
(noting that these may change from year to year and that material to supplement our case
selections may be made available to students online). The inclusion of any particular case
on any reading list is also a highly selective exercise, but we are reasonably confident that
our selection of cases will overlap significantly with the needs of teachers and students alike
to address topics typically taught in Australian JD and LLB administrative law courses. We
therefore expect that individual teachers will supplement the cases contained in this volume
with other materials to suit their own needs. This is necessarily so in relation to those chapters
(1, 8, 9 and 10) for which we have only included a list of suggested readings.
Readers of this volume will find fewer cases than are typically found in a ‘case book’
used for legal education in Australia. As with previous editions, this reflects a decision on
our part to promote the benefits of engaging with longer case extracts to build reasoning
skills appropriate to the study of administrative law. Administrative law principles may be
easy to state but they are often relatively abstract and can be difficult to apply. We think
that longer extracts from cases, even when presented to illustrate particular issues, better
reveal the argumentative process through which judges choose among multiple possible
interpretations of the law to reach their conclusions. Longer extracts also enable students
to better understand how the principles of administrative law are applied and developed in
particular statutory and factual contexts.
The cases we have included should not be thought of as a definitive collection of the
most important cases in Australian administrative law. In a collection of this size, it has not
been possible to include all the cases that could meet that description. Nor have we included
cases on every issue covered in the chapters of PAL. What we have sought to do is to put
together a collection of cases that lay out and apply the major principles of administrative

law, alongside cases that complicate or otherwise develop those fundamental statements of
principle. Our decision to include longer extracts is also motivated by a desire to promote a
deeper understanding of the way that administrative law adjudication is structured, and the
wider context of issues traversed when a court attends to a particular point of principle. Thus
although the cases are designed to accompany discussions of particular topics in PAL, many
illustrate principles that cut across individual topics.
Our hope is that our selections will further the efforts of teachers and students to treat
the interpretations and arguments in PAL as a basis for developing their own ideas and points
of view. To promote this objective, the extracts are preceded by ‘reading questions’. Users
familiar with the previous editions of the casebook will notice the addition of brief statements
of the major questions at issue in each case above the ‘reading questions’, designed to assist
students to navigate their reading of the extracts. We hope that (when read in combination
with PAL) teachers and students alike will find sufficient material contained here to address
topics typically taught in Australian JD and LLB administrative law courses.
As with previous editions, many of the footnotes in the cases included in this volume have,
for reasons of space, been removed. The footnotes retained have been located, in square
brackets, at the point where cited material has been either directly quoted or specifically
discussed in the judgment, or where we have otherwise concluded that the content of the
note should be included. Necessarily this choice to omit some footnotes or the full content of
some footnotes comes at a cost. But making it has allowed us to include considerably more
cases than would otherwise have been possible. That said, we should remind readers that this
volume is designed as a classroom tool only. Those pursuing further research are advised to
consult the original materials. Further, and in keeping with the contemporary trend by courts
towards the use of medium neutral citation and numbered paragraphs within judgments, the
case extracts new to this edition are formatted by reference to paragraph numbers rather than
to the pages numbers of any officially reported version.
We would like to thank the production team at OUP for their efficiency and professionalism
in steering this project to completion. Finally, building on the primary efforts of Leighton in
preparing the previous editions of this casebook, Peter and Leighton would like to thank

Visitata così tutta la parte della città che è esumata, alla estremità di
essa, al fianco opposto a quello delle Tombe che abbiamo appena
lasciato, al basso della Via di Stabia, dopo alcuni passi oltre gli
scavi, e a traverso de’ campi coltivati, che celano ancora parte della
città, si giunge all’Anfiteatro, del quale si son date in questa edizione
incise la fronte esterna nel titolo del secondo volume dell’opera e nel
corpo, la veduta interna. Vol. II cap. XIV.
Questa rapida corsa potrà durare quattro ore e, se appena il lettore
ha sentimento artistico, ne ritrarrà di certo da una prima visita il
desiderio di altre, le quali certo gli verranno rivelando nuove cose
degnissime di osservazione e di nota, e sarà allora, io spero, che gli
torneranno più accetti questi miei studi, nel compire i quali, non
fatica e stanchezza, ma diletto e conforto ho ricavato sempre contro
la cospirazione del silenzio e la viltà di politici avversari, le codarde
compiacenze di insipienti Eliasti e la stupidità degli Iloti onde
abbonda la nostra terra, Saturnia tellus, che mantien vivo l’appetito
del vecchio Nume divoratore de’ suoi figliuoli e che così ne
compensa le veglie sudate e le opere generose.
Non mi mancarono tuttavia i plausi de’ buoni e gli onesti ed onorevoli
incoraggimenti e poichè nel pigliar le mosse di questi miei studj, io
ne proclamavo auspice quel fior di senno e d’onestà che è il mio
carissimo Pietro Cominazzi; così piacemi chiuderli ancora nel suo
nome e il lettore non ascriva a mia vanità, ma al volere di
quell’egregio, se finisco qui riferendo i versi de’ quali egli per
quest’opera mi voleva onorato
