The rights, liabilities, and duties of a bailer and bailee, presented in points:

Bailer

Rights

1. Right to Claim Goods:

o The bailer has the right to claim the goods once the period of bailment or the
purpose of bailment is over.
2. Right to Demand Return:
o The bailer can demand the return of the goods at any time, subject to the conditions
of the bailment agreement.
3. Right to Sue for Damage:
o The bailer can sue the bailee for damages if the bailee fails to take reasonable care
of the goods.
4. Right to Terminate Bailment:
o The bailer can terminate the bailment if the bailee acts inconsistently with the terms
of the bailment.
5. Right to Compensation for Unauthorized Use:
o If the bailee makes unauthorized use of the goods, the bailer has the right to claim
compensation for any damage resulting from such use.

Liabilities

1. Disclosure of Defects:
o The bailer must disclose any known defects in the goods to the bailee. Failure to do
so makes the bailer liable for any damages arising from such defects.
2. Compensation for Loss:
o The bailer is liable to compensate the bailee for any loss sustained due to the defect
in the goods if the defect was known to the bailer and not disclosed.
3. Expenses for Extraordinary Care:
o The bailer must bear any extraordinary expenses incurred by the bailee for the
maintenance of the bailed goods.

Duties

1. Delivery of Goods:
o The bailer must deliver the goods to the bailee as per the terms of the bailment
agreement.
2. Compensation for Expenses:
o The bailer is obliged to repay the bailee for necessary expenses incurred in keeping
the goods.
3. Indemnify the Bailee:
o The bailer must indemnify the bailee for any loss arising from the defective title of
the goods.
Bailee

Rights

1. Right to Possess Goods:

o The bailee has the right to possess the goods until the bailment is terminated.
2. Right to Compensation:
o The bailee is entitled to be compensated for necessary expenses incurred for the
preservation of the goods.
3. Right to Lien:
o The bailee has a right to retain the goods until due remuneration for services is
received, known as a bailee's lien.
4. Right to Sue Third Parties:
o The bailee can sue third parties for wrongful deprivation of the bailed goods or for
causing damage to the goods.

Liabilities

1. Duty of Care:
o The bailee is liable for any loss or damage to the goods if they fail to take
reasonable care.
2. Liability for Unauthorized Use:
o The bailee is liable for any loss or damage resulting from unauthorized use of the
goods.
3. Liability for Non-Return:
o The bailee is liable for failure to return the goods at the end of the bailment period
or upon the bailer’s demand.

Duties

1. Duty to Take Care:

o The bailee must take reasonable care of the bailed goods, as would a person of
ordinary prudence under similar circumstances.
2. Duty to Return Goods:
o The bailee must return the goods to the bailer or dispose of them according to the
bailer’s directions once the purpose of bailment is accomplished.
3. Duty Not to Mix Goods:
o The bailee must not mix the bailer's goods with their own or with others without the
bailer’s consent. If mixed with consent, both parties share the proportionate
interest. If mixed without consent and inseparable, the bailee bears the loss.
4. Duty to Use Goods Only for Authorized Purpose:
o The bailee must use the bailed goods only for the purpose for which they were
bailed. Unauthorized use can make the bailee liable for any resulting damage.
5. Duty to Deliver Accretions:
o The bailee must deliver any increase or profit from the bailed goods to the bailer.
These points cover the fundamental aspects of the rights, liabilities, and duties of both the bailer
and the bailee in a bailment relationship.
