AFFIDAVIT

I, JUAN DELA CRUZ, Filipino, of legal age, single, with address at c/o DII
Building, Km. 123 KAMOTE ROAD, Muntinlupa City, after having been sworn to in
accordance with law, hereby depose and state:

1. That sometime in the evening of October 30, 1998, I went to Uniwide

Coastal Mall along Coastal Road in Paranaque City;
2. That I was then driving one Honda City model 2032 with Plate No. WAJ-
0210 and registered under the name of KAWAYAN Industries, Inc.;
3. That since the parking lot of the mall was almost full, I had no choice but
to park at the far end of the parking lot;
4. That after parking the car, I went inside the supermarket to buy some
groceries;
5. That after almost an hour and after buying everything I needed, I returned
to the car;
6. That when I reached the car, I noticed that there was a dent adjacent to
the door handle, driver side, of the door as if something was inserted between the edges of
the front and rear right doors;
7. That I looked around the area and noticed that while there were other
vehicles parked there, mostly passenger jeepneys, the only security guard available was
about 100 meters away and that when I inquired if he noticed anything peculiar earlier in the
area where my car was parked, he said he didn’t see anything;
8. That after assessing the damage, it appeared that someone tried to pry
open the door of the car but failed to succeed;
9. That damaged was the edge of the right front door near the door handle as
well as some cracks under the plastic molding near the glass panel;
10. That I am executing this affidavit to attest to the truth of the foregoing
statements and for all legal intents and purposes.

I, VICTORIA D. BARIAS, Filipino, of legal age, single, with address at No.

133 St. Jude Street, Pasay City, after having been sworn to in accordance with law, hereby
depose and state:

1. That sometime in the evening of October 25, 1998, I went to Star City in
Cultural Center Complex along Roxas Boulevard with my nephews and nieces;
2. That I was then driving one Honda City model 1998 with Plate No.
DTW-158 and registered under the name of CALIFORNIA CLOTHING, INC.;
3. That I parked the car in the designated parking area across Philtrade
Center since the other parking lots were already filled;
4. That after securing my car, I went to Star City;
5. That around 11:00 p.m., we finally went back to the car and went straight
home;
6. That the following morning I noticed that there are some dents on the
hood of the ca which weren’t there when we left for Star City;
7. That most likely the dents were sustained when the car was parked at the
Star City the previous night which I did not notice at that time since it was nighttime;
8. That damaged consisted of depressions/dents on the hood and a deep
scratch on the right fender, near the edge of the hood;
9. That I am executing this affidavit to attest to the truth of the foregoing
statements and for all legal intents and purposes.
