BY-LAWS OF PEDERASYON NG MGA BARANGAY

KAGAWAD NG PILIPINAS BACARRA CHAPTER
ARTICLE I
ORGANIZATION
SECTION 1. Scope - These By-Laws shall be binding on

all levels of organization of the Sangguniang Barangay as
defined by the Local Government Code (Batas Pambansa
Bilang 337), namely: Katipunang Bayan, Katipunang
Panglungsod, Katipunang Panglalawigan, Katipunang
Pampook at Pambansang Katipunan ng mga Barangay and
the Municipal, City, Provincial Regional and National Levels,
respectively.
SECTION 2. Membership - The members of the

Katipunang Bayan and the Katipunang Panglungsod are the
Sangguniang Barangays Membership in the Katipunang
Panlalawigan includes all Katipunang Bayan, in the
Katipunang Pampook, all the Katipunang Panlalawigan and
the Katipunang Panglungsod; and in the Pambansang
Katipunan ng mga Barangay, all the Katipunang Pampook.
SECTION 3. Procedure
a.Katipunang Panglungsod or Katipunang Bayan . All

Kagawad in each city or municipality representing their
respective Sangguniang Barangay shall organize their
Katipunang Panglungsod or Katipunang

composed of not less than five (5) nor more than eleven (11)
members. The exact number of the Board shall be
determined before the election by a majority of those

SECTION 4. Representation
a. Representation in the Katipunang Bayan or

Katipunang Panglungsod
- Every Sangguniang Barangay shall, in all meeting
and/or
deliberation called by the Katipunang Panglungsod or
Katipunang
Bayan, be represented by one (1) of the Barangay
Kagawad, who

incapacity, such representation shall devolve
successively upon their
respective Vice President or Secretary.
d.Representation in the Pambansang Katipunan ng mga
Barangay
The President of the Katipunang Pampook shall bpe
their
representative to the Pambansang Katipunan ng mga
Barangay.

ARTICLE II
FUNCTIONS
SECTION 5. - The Katipunan at each level shall:
a. Adopt measures for the promotion of the welfare of

the
barangay officials and their respective constituents.
b. Assist in the education of the barangay residents for

the
development of good citizenship, cooperation and
unity, in
order to promote a united and concerted action for
the
achievement of the country's development goals;
and
c. Promote, assist and serve all the Sangguniang

Barangays.
SECTION 6. Regular Meeting - The Katipunan ng mga

Barangay of
Bacarra Ilocos Norte agreed during a meeting convened
last February 9, 2024 that the regular monthly meeting
of the Federation is set on every 1st Thursday of the
month at 8:30 in the morning at the Multi-purpose Hall
Building of Brgy. #3 San Andres II, Bacarra Ilocos Norte.
SECTION 7. - Regular meeting. The Board of Directors of

shall have regular meeting once a month at the host

barangay, Bacarra Ilocos Norte.
SECTION 8. - Special Meetings - Special meetings of a

Federation of Barangay Kagawad and Board of Directors
of the Federation at any level may be called by its
President or by written request, phone calls and text
messaging of a majority of the Board of Directors
whenever necessary. Designated Public Relation Officer
(PRO) is directed to do the information dissemination.
SECTION 9. Notice - Notice of the time and place of

regular and special meetings of the Board of Directors
of the Federation and Federation of Barangay Kagawad
shall be given either a request letter addresses to the
Punong Barangay then he/she will assign from the
Kagawads (rotational representatives) to represent
their respective barangay with memorandum and follow
up message either text messaging process or through
group message using the messenger application, with
respect to special meetings, the notice shall be given
like the same and shall state briefly the purpose of the
meeting and no other business shall be acted upon at
such meeting except by the consent of all members
present thereat.
SECTION 10. Quorum - A quorum for any meeting of the

Board of
Directors and the Federation of Barangay Kagawad
shall consist of a majority of the members thereof. A
majority consist of one-half plus one of the existing
members of the Board.

ARTICLE III
POWERS AND DUTIES OF EXECUTIVE OFFICERS
SECTION 12. Executive Officers - The Federation at all

level except
the Pambansang Federation of Barangay Kagawad shall
have the following officers: President, Vice President,
Board Secretary, Board Treasurer, Auditor and members
of the Board of Directors. The Board Secretary and
Board Treasurer were elected coming from the
members of the Board of Directors.
The powers and duties of the President are:
a. To execute and administer the policies, measures

orders and
resolutions approved by the Board of directors of the
Federation;
b. To preside over the meetings of the Federation and
the general
membership;
c. To formulate and recommend plans and programs to

the Federation
of the Barangay Kagawad for implementation by the
Federation at
all levels;
d. To negotiate, sign, and enter into contracts for and in

behalf of the
Federation, upon the authorization by the Board of
Directors;
e. To represent the Federation in cases where such
representation is
needed;
f. To exercise the power of the general supervision
over the officers of
the Federation;
g. To enforce the By-Laws, existing laws, decrees, and
other documents relative to the Federation of Barangay
Kagawad; and
h. To look after the general welfare of the Federation.
SECTION 13. Vice President - The powers and duties of

the Vice
President:
a. To perform the powers, duties, and responsibilities of

the President
in case of each Latter's absence, death, or incapacity to
perform the functions of his/her office;
b. To represent the President in activities whenever
necessary;
c. To perform such duties as the President may direct.
SECTION 14. Secretary - The powers and duties of the

Secretary are:
a. To take charge of the maintenance of the

organization in the absence of the duly elected officials
or upon the dissolution of the

organization;
b. To be the custodian of all records of the Federation;
c.To keep the minutes of all meetings of the Federation

and of the
general assembly, and to record all proceedings of
the same;
d. To keep the seal of the Federation;
e. To keep a record of all pertinent laws, decrees,
circulars and other
documents relating to the Federation, and
f. To prepare the agenda at least five (5) days before
each meeting of
the Board of Directors.
SECTION 15. Treasurer - The power and duties of the

Treasurer are:
a. To be the custodian of all Federation's assets,

properties, funds and
securities, and to submit to the Board of Directors,
through the
President, annual inventory thereof at of the year;
b. To collect and receive fees, contribution, money,
materials and all
other resources accorded to the Federation treasury,
for which
he/she shall issue official receipts;
c. To disburse funds under the authority of the
President in accordance
with standard accounting and auditing procedures;
d. To render monthly reports to the Board of Directors
during monthly

meeting;
e. To submit to the President an Annual Financial
Statement duly
certified by him/her;
f. To certify to the availability of funds whenever
necessary;
g. To post bond for the faithful performance of others.
SECTION 16. Auditor - The auditor shall make a

quarterly report on
the financial condition of Federation to the President.
The report shall
contain, among other things, the statement of the

resources, assets,
and liabilities.
SECTION 17. The Pambansang Federation of Barangay

Kagawad shall have the following set of officers
namely: President, Vice President, Secretary, Treasurer,
Auditor, and other officers that the board may deem
necessary.
ARTICLE IV
ELECTIONS AND TERMS
SECTION 18. Elections. ⁃ The elections of officers of the

Katipunang Bayan and Katipunang Panglunsod shall be
held within thirty (30) days after the general, barangay
elections are held; The
Katipunang Panlalawigan within thirty (30) days after
the election of the

Katipunang Bayan; the Katipunang Pampook within

thirty (30) days
after the election of the Pambansang Panlalawigan; and
the
Pambansang Katipunan ng mga Barangay within thirty
(30) days after
the election of the Katipunang Pampook.
SECTION 19. Term of Office. - The term of office of all

officers
of the Katipunan at all levels shall be from the date of
the election until
the next Katipunan elections following the general
barangay elections
subject to the limitation of Section 4 and the
succeeding Sections hereof.
SECTION 20. Vacancies and Succession in the

Katipunan
In case a permanent vacancy arises in the Office of the
President due
to refusal to assume office, failure to qualify, death or

removal from office, voluntary resignation or incapacity
to discharge the function of his office ,the Vice
President shall assume the office for the unexpired term
of the former.
Any permanent vacancy on the same grounds shall

be filled up by an election from among the members of
the Board.
In case of multiple vacancies in the Board of

Directors whereby

the present membership cannot constitute a quorum,

the President of
the Katipunan shall call for an election to fill up the
vacancies and those
elected shall assume office as Director for the
unexpired term.
SECTION 21. Removal and Suspension. - All elected

officers
of the Katipunan, including members of the Board of
Directors, may be suspended or removed from office of
any of the following grounds
committed while in the office.
1. Disloyalty to the Republic of the Philippines;

2. Culpable violation of the Constitution;
3. Dishonesty, oppression, misconduct in office and
neglect of duty;
4. Commission of any offenses involving moral
turpitude;
5. Absence of Authority;
6. Unauthorized absence for three (3) consecutive
months.
Any complaint for the suspension and/or removal of

an officer of
a Katipunan on grounds as provided shall be initiated
only by a member of the, Board of Directors of the
Katipunan concerned in a written sworn statement and
shall be heard by the Board of the said

Katipunan. In the process of deliberation of the case,

the complaint shall be inhibited
from participating therein, including the right to vote.
All elected officers of the Katipunan, including

members of the
Board of Directors may be suspended or removed from
office by vote of 2/3 of all the members of the Board of
the Katipunan concerned.
The decision of the members of the Board of the

Katipunang
Bayan is appealable to the Board of the Katipunang
Panlalawigan;
Katipunang Panglunsod and Panlalawigan to the
Katipunang Pampook;the Katipunang Pampook to the
Pambansang Katipunan ng mga Barangay. In all cases
mentioned herein, only the decision of PBK shall be
final and executor. Appeal shall be made within fifteen
(15) days upon receipt of the decision of the Board of
Directors of the
corresponding level, otherwise the decision shall be
deemed affirmed by the Pambansang Katipunan ng mga
Barangay (PBK).
In the event that the majority of the members of

the Board in any
level are the complaints, the complaint shall be
investigated and heard
by the next higher level of the Katipunan and in the
case of the PBK by
the Ministry of Local Government. The procedure of

appeal shall be in
accordance with what is mentioned herein.
SECTION 22. Resignation. - A resignation of an officer or

member of the Katipunan becomes effective upon
acceptance by a
majority vote of the Board of Directors of the Katipunan.
ARTICLE V
FUNDING
SECTION 23.- The Katipunan in all levels shall derived

all its funds
from fund-raising campaigns or activities for specific
projects designed to uplift the Sangguniang Barangay,
without the necessity of securing permits, subject to
the provisions of the Election Code, where-by no fund
raising shall be allowed during the period specified by
law immediately preceding an election.
SECTION 24. - All funds of the Katipunan at all levels of

organization
shall be deposited as trust funds with their respective
Katipunan Treasurer at
municipal/city/provincial/regional and national and be
disbursed only for the specific purpose for which the
funds were raised in accordance with approve
resolutions by the Katipunan concerned, subject to
auditing rules and regulations. And all funds shall be
deposited to the Land Bank of the Philippines through
Current Account and the only can disburse is the

official signatories which is the Federation President

and Federation Treasurer.
The Treasurers at all levels of the Katipunan shall

be required to file a bond.
Ms. Vianney I. Bonoan Kagawd of Brgy #01, Sta. Rita , Bacarra,

Ilocos Norte was designate as the Federation Treasurer
to handle Federation funds and disburse the same with
consent of all Federation Officers and members.
SECTION 25. Membership Fee - Each member of the

Federated of
Sangguniang Barangay Member must pay his/her
membership fee in the amount of FIFTY PESOS (Php
50.00) within the time and on the conditions set forth in
these by-laws. The fees shall be equal for all members.
PENALTIES
It was agreed upon duly deliberation of the Federation

of Barangay Kagawad of Bacarra, Ilocos Norte to
impose the following penalties;
1. Any member who is absent during meeting of the

Federation will have to pay his penalty in the
amount THREE HUNDRED FIFTY PESOS (Php
350.00) per absence. On the 3rd offense of
members, he/she will also be subjected to
disciplinary action.
A proxy is only allowed in case of disability of a

member to
attend said meeting due to sickness and or some

very
important matter/s to attend.
Important matter/s to attend to are specified as:
a. Death/Interment of immediate family of a

member
b. Wedding of a daughter/son
c. Sick leave or on leave
d. Emergency case like hospitalization of the
member
including his/her immediate family
2. Any member who does not wear the prescribed

uniform during
regular meeting of the Federation will be fined in
the amount
of THREE HUNDRED PESOS (Php 300.00) of
which fined
shall be collected before any clearance is being
issued for the
disbursement of honorarium. No wearing of
shorts and
slippers during meetings. Must be pair of shoes
or sandals as
long as it will give a pleasant countenance as
elected and
honorable barangay officials.
3. Any member who will not attend Federation,

Municipal and
Provincial activities will be fined in the amount of
THREE

HUNDRED PESOS (Php 300.00).
ARTICLE VI
DEATH AID
SECTION 26. - In accordance with Section 393 (b) (2) of

the Local
Government Code that an active official who die during
their term of office shall be covered by death benefits
relevant and parallel to a death aid contribution from
the members of the Federated of Sangguniang Barangay
Members of the Municipality of Bacarra amounting to
ONE HUNDERED PESOS (Php 100.00) per Sangguniang
Barangay Member.
EFFECTIVITY
SECTION 27. These By-Laws shall be effective and

binding on all levels of the Federation thirty (30) days of
its ratification by a majority of all President of the
Katipunang Panlalawigan.
ARTICLE VII
AMENDMENTS OF THE BY-LAWS
SECTION 28. AMENDMENTS - The By-Laws or any

portion therefore
may be amended, modified, or altered of replaced by a
majority vote of the Board of the Pambansang

Katipunan ng mga Barangay at a regular or special

meeting called for the purpose.
Such amendment (s), modification, or alteration or

repeal shall become effective and binding on all levels
of the Katipunan thirty (30) days after its ratification by
a majority vote in the Katipunan Pampook.
