DEFINITION OF DIVORCE
Meaning of Divorce
Divorce means ending a marriage, Divorces the
point when a couple cannot continue their
marriage life together

Definition of Divorce
The legal separation of husband and wife, effected
for cause by the judgment by the court, and either
totally dissolving the marriage relation.
CLASSIFICATION OF DIVORCE
Definition of talaq

A form of divorce under Islamic law in which the husband repudiates


the marriage by saying `talaq' three times
KINDS OF TALAQ

Talaq-Ul- Sunnha
Talaq-Ul- Biddat

Talaq- Ahsan Talaq- Hasan


DEFINITION OF ILA
A form of divorce in which a man makes a vow that he will not have a
connection with his wife for not less than four months and observes it
inviolate.
The divorce is thereby effect ipso facto, without a decree of separation from
the judge.

See Qur’an, Suratu ‘l-Baqarah, ii. 226: “Those who swear off from their
woman, they must wait four months; but is they break their vow, God is
forgiving and merciful.”

marriage contract or at any time after the
marriage is technically called Hafeez.

This right of a wife delegated by her


husband is accepted as lawful by all
Muslim jurists.

Khula

In Islamic law, "khula" is a type of divorce initiated by the wife. Khula is different
from talaq, which is initiated by the husband. In a khula divorce, the wife seeks to
dissolve the marriage by returning the dower (mahr) or other financial
compensation she received from her husband at the time of the marriage.
Definition of Mubarat

According to the holy Quran; the basis of Mubarat is Surah –


al – Baqrah[3], it is given in the book, “that there is danger in
mubarat, just as with all forms of divorce, to which the
parties might act hastily, then repent, and again wish to
separate. To prevent such capricious action repeatedly, a
limit is prescribed.
