Brief facts:-

The applicants are permanent resident of Miraj; Dist. Sangli. The


applicant No. 1 is serving as Headmaster in Jawahar High School and
Junior College Miraj. The applicant No. 2 is working as Headmaster in
Jawahar Urdu Primary School at Miraj. The applicant No. 3 is working
as Headmaster in Arbi Urdu Marathi School Miraj. The applicant No. 4
is working as Headmaster in Dr. Salim Urdu High School, Amannagar,
Miraj

The government has launched a scheme by name and under style


as; Rashtriya Shaley Poshan Aahar Yojana, since year 1995 and as per
this scheme rice in the form of grains was supplied, by government. The
supply is being made through marketing federation of every District to
the schools and as per the norms of this scheme the school is suppose to
take the rice in the form of grains, and then after cooking was to be
supplied to the students.

As per this scheme the rice grains obtained by the respective


school was to be kept in safe place and the school was at liberty to store
the rice grain as per their convenient accommodation, and accordingly
the rice grains of the above said institutions was stores in the godown one
Fatima Asif Shaikh who is President of one Indira Gandhi Mahila Bachat
Gat, Khot Nagar, Malgaon Road, Miraj, and she has executed an
agreement with the above said institution for cooking of the rice grains.
Hence for the sack of safety and convenience the rice grains was stored
in the godown above said Fatima Asif Shaikh. On this background one
Sajidali Barkatali Pathan resident of Miraj who is the president of
Rastrawadi Congess Miraj, on 19/10/2013 he went to Miraj City Police
Station and made a oral complaint of theft. Therefore the police attached
to Miraj City Police Station, went to the godown and called officers of
Education Department. The police and the officers of Education
Department took the search of the godown and they found that the gani
bags in the godown were tallying to the supply made to the school and
accordingly they made a note of it in writing and signature of the said
complainant Sajidali Pathan was obtained on it. The Sajidali Pathan with
a malafide intention to rope the above said applicants in a false case; out
of political rivalry, pressurise the administrative officer to file a
complaint of theft against the applicants; and on 22/10/2013 the
administrative officer informed police. Meanwhile the opinion of District
Government Pleader Sangli, was taken he categorically opinioned that no
offence was taken place and no penal action can be taken against the
applicants.

On this backgrounds the complainant Sajidali Pathan filed a


private complaint against the applicants bearing No. 349/2013 under
section 120(b), 420, 406, 409, 477(a) & 34 of I.P.C. before Hon'ble
Judicial Magistrate First Class, Miraj. The Hon'ble Court passed order
U/s. 156(3) of Cr.P.C. and directed the police to lodge F.I.R. and
accordingly the police attached to Miraj City Police Station have
registered and offence under Crime register No. 1/2014 U/s. 120(b), 420,
406, 409, 477(a) & 34 of I.P.C. , and there by applicants are apprehended
by police for their arrest.

Hence the applicants begs to prefer this humble petition of bail


application in the light of following grounds and some other grounds that
may be urged at the time of final hearing of the bail application.

1) The compliant filed by Sajidali Pathan is totally false and bad in


law.

2) The complaint against the present applicant is not at all tenable.


The complainant has suppressed material facts before Learned Judicial
Magistrate, Miraj.
3) The order passed by Learned Judicial Magistrate, Miraj is against
Law Equity and evidence on record.

4) The direction of Learned Judicial Magistrate, Miraj to the Police,


to lodge a F.I.R. is totally wrong.

5) The Learned Judicial Magistrate, Miraj has wrongly held that there
is prima facia case against the applicants.

6) The Learned Judicial Magistrate, Miraj has lost sight of the fact
that the complaint has no locus-standi to file the case.

7) The Complaint has wrongly contended that the rice grains were
stored is a wrong place and there by offence is attracted.

8) The complainant has falsely contended that, applicant's have


played fraud and have committed offence as alleged by complainant.

9) The complaint is total out-come of political vengeance, and just to


make " hot-cake" of situation the complaint is lodged.

10) The complaint does not disclose any offence U/s. 120(b), 420, 406,
409, 477(a) & 34 of I.P.C.

11) The applicant No. 1 is serving as Headmaster in Jawahar High


School and Junior College Miraj and she is residing permanently at Miraj
with her husband & tow minor childrens. The applicant No. 2 is working
as Headmaster in Jawahar High Urdu Primary School at Miraj and she is
permanently residing at Miraj with her two minor childrens. The
applicant No.3 is working as Headmaster in Arabi Urdu Marathi Shcool
Miraj and he is residing permanently at Miraj with his other family
members VIZ, wife, daughter etc. The applicant No. 4 is working as
Headmaster in Dr. Salim Urdu High School, Amannagar, Miraj; and he is
permanent residing at Miraj with his other family members VIZ wife,
mother, two minor childrens etc. The applicants has no concerned with
the case. The roots of the applicants are deep in Sangli district and no
way the applicants are likely to flea away from bail.
12) The applicant's are ready and willing to furnish bail surety as per
orders of this Hon'ble Court.

13) The applicant's are further ready and willing to obey the directions
of this Hon'ble Court.

14) The applicant's if released on bail, undertakes that the applicant


will not leave the jurisdiction of this Hon'ble Court without prior
permission.

15) The applicant's further undertakes that they will not threat or
induce to any person related with the offence.

16) The applicant's further undertakes that they will remain present
before this Hon'ble Court, as well as before concerned I.O. as and when
required.

17) This is first anticipatory bail application of the applicant's, no other


application of like nature is pending before any other proper forum.

18) Therefore it is humbly prayed that,

a) The application may kindly be allowed.

b) The applicant's may kindly be ordered to be released on bail in


the event of their arrest on the basis of the complaint filed against
applicants under crime register No. 1/2014 of Miraj City Police
