10 GAD CONCERNS AND PROBLEMS

1. Discrimination between different genders;


2. Utter disregard of the importance of different genders;
3. Moral, social, and cultural conflicts;
4. Lack of knowledge and GAD awareness;
5. Personal conflicts;
6. Religious aspect conflicts;
7. Insufficient training/seminars;
8. Insufficient funds for such training and seminars;
9. Not prioritizing GAD; and
10. Lack of policies concerning GAD.

10 GAD TOPICS

1. Republic Act No. 9710, otherwise known as the Magna Carta for Women;

SECTION 2. Declaration of Policy. — Recognizing that the economic, political, and


sociocultural realities affect women’s current condition, the State affirms the role of women in
nation building and ensures the substantive equality of women and men. It shall promote
empowerment of women and pursue equal opportunities for women and men and ensure equal
access to resources and to development results and outcome. Further, the State realizes that
equality of men and women entails the abolition of the unequal structures and practices that
perpetuate discrimination and inequality. To realize this, the State shall endeavor to develop
plans, policies, programs, measures, and mechanisms to address discrimination and inequality in
the economic, political, social, and cultural life of women and men.

The State condemns discrimination against women in all its forms and pursues by all appropriate
means and without delay the policy of eliminating discrimination against women in keeping with
the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) and
other international instruments consistent with Philippine law. The State shall accord women the
rights, protection, and opportunities available to every member of society.

The State affirms women’s rights as human rights and shall intensify its efforts to fulfill its duties
under international and domestic law to recognize, respect, protect, fulfill, and promote all
human rights and fundamental freedoms of women, especially marginalized women, in the
economic, social, political, cultural, and other fields without distinction or discrimination on
account of class, age, sex, gender, language, ethnicity, religion, ideology, disability, education,
and status.

The State shall provide the necessary mechanisms to enforce women’s rights and adopt and
undertake all legal measures necessary to foster and promote the equal opportunity for women
to participate in and contribute to the development of the political, economic, social, and
cultural realms.
The State, in ensuring the full integration of women’s concerns in the mainstream of
development, shall provide ample opportunities to enhance and develop their skills, acquire
productive employment and contribute to their families and communities to the fullest of their
capabilities.

In pursuance of this policy, the State reaffirms the right of women in all sectors to participate in
policy formulation, planning, organization, implementation, management, monitoring, and
evaluation of all programs, projects, and services. It shall support policies, researches,
technology, and training programs and other support services such as financing, production, and
marketing to encourage active participation of women in national development.

2. Republic Act No. 7192, otherwise known as the Women in Development and Nation Building
Act;

SEC. 2. Declaration of Policy. — The State recognizes the role of women in nation building and
shall ensure the fundamental equality before the law of women and men. The State shall
provide women rights and opportunities equal to that of men.

To attain the foregoing policy:

(1) A substantial portion of official development assistance funds received from foreign
governments and multilateral agencies and organizations shall be set aside and utilized by the
agencies concerned to support programs and activities for women;

(2) All government departments shall ensure that women benefit equally and participate directly
in the development programs and projects of said department, specifically those funded under
official foreign development assistance, to ensure the full participation and involvement of
women in the development process; and

(3) All government departments and agencies shall review and revise all their regulations,
circulars, issuances and procedures to remove gender bias therein.

3. Republic Act No. 9262, otherwise known as the Anti-Violence Against Women and Their Children
Act of 2004;

SECTION 2. Declaration of Policy.- It is hereby declared that the State values the dignity of
women and children and guarantees full respect for human rights. The State also recognizes the
need to protect the family and its members particularly women and children, from violence and
threats to their personal safety and security.

Towards this end, the State shall exert efforts to address violence committed against women and
children in keeping with the fundamental freedoms guaranteed under the Constitution and the
Provisions of the Universal Declaration of Human Rights, the convention on the Elimination of all
forms of discrimination Against Women, Convention on the Rights of the Child and other
international human rights instruments of which the Philippines is a party.
4. Republic Act No. 6725, or the Act Strengthening the Prohibition on Discrimination against
Women with respect to Terms and Conditions of Employment, amending for the purpose Article
135 Of The Labor Code, As Amended;

SECTION 1. Article One hundred thirty-five of the Labor Code, as amended, is hereby further
amended to read as follows:

"Art. 135. Discrimination Prohibited. — It shall be unlawful for any employer to discriminate
against any woman employee with respect to terms and conditions of employment solely on
account of her sex.

"The following are acts of discrimination:

"(a) Payment of a lesser compensation, including wage, salary or other form of remuneration
and fringe benefits, to a female employee as against a male employee, for work of equal value;
and

"(b) Favoring a male employee over a female employee with respect to promotion, training
opportunities, study and scholarship grants solely on account of their sexes.

"Criminal liability for the willful commission of any unlawful act as provided in this article or any
violation of the rules and regulations issued pursuant to Section 2 hereof shall be penalized as
provided in Articles 288 and 289 of this Code: Provided, That the institution of any criminal
action under this provision shall not bar the aggrieved employee from filing an entirely separate
and distinct action for money claims, which may include claims for damages and other
affirmative reliefs. The actions hereby authorized shall proceed independently of each other."

5. Senate Bill No. 689, or the Sexual Orientation and Gender Identity Expression Bill;

An excerpt from the Senate Bill No. 689 reads:


“In the Philippines, some local governments already have ordinances to protect the welfare of
the LGBT community. In addition, the Department of Education issued the Gender-Responsive
Basic Education Policy which primarily “commits to integrate the principles of gender equality,
gender equity, gender sensitivity, non-discrimination and human rights in the provision and
governance of basic education.”

It is high time for the Philippines to join the long list of countries with a national anti-
discrimination law. With the hopes of giving the LGBT community full acceptance, and not just
tolerance, this proposed legislation aims to finally eliminate the hate and discrimination against
them. This bill also seeks to create an environment that is safe, equal, and reasonable for
everyone regardless of their sexual orientation and gender identity or expression.”

7. Gender-Responsive Teaching Techniques and Classroom Management training and seminar;
8. Lecture, training and seminar about special laws concerning Gender;
9. Formulation of Gender-Related Office Rules and Regulations; and
10. Gender-Responsive Extension and Community Engagement.
