Main Functions
The Department exist to do the following:
 To control people entering and exiting the country in order to uphold the security of
the state.
 To issue Travel documents to eligible people in accordance with the International
Civil Aviation Organisation (ICAO).
 To process and issue Malawi Citizenship, Residence and Work Permits, and Visas in
accordance with the existing policies.
 To monitor, track, apprehend, deport and repatriate illegal immigrants in order to
promote security of the country and safeguard jobs for natives.

Categories of citizenship

MINOR
A minor is a child who is 21 years below.

Citizenship by Birth (sec.4)


A person born in Malawi where one or both of the parents was born in Malawi.

Citizenship by Descent (sec.5)


A child born outside Malawi to one or both of the parents who are Malawi citizens by birth,
that child is automatically Malawian and can obtain a Malawi passport provided is a minor.

Citizenship by Marriage
A woman can obtain a Malawian Citizenship if is married to a Malawian and provided the
person has stayed in Malawi on a valid permit for a period of not less than 5 years. A citizen
of Malawi being a woman who acquires by marriage the citizenship of some country other
than Malawi shall cease to be a citizen on the first anniversary of the date of that marriage
unless before the anniversary she has made a declaration in writing.

Citizenship by Registration of Commonwealth Citizens


Any commonwealth citizen being a person of full age and capacity may be registered as a
citizen of Malawi if he or she fulfills the following:-
a.A person must have resided in Malawi for five(5) years or above.
b.Must have adequate knowledge of the prescribed vernacular languages.
c.Must be of good character.

Citizenship by Registration of wives of Malawi Citizens


Any woman, being a person of full capacity, who has been married to a citizen of Malawi can
be registered as a citizen of Malawi provided she fulfils the following:-
a.Marriage Certificate.
b.Photocopy of Citizenship certificate of husband(in some cases).
c.Photocopies of husband’s passport.

Citizenship by Registration of Stateless Persons


A child born in Malawi to parents who are holders of different nationalities may register as a
citizen of Malawi provided he or she fulfils the following:-
a.A person should be proved that has always been stateless and born in Malawi.
b.One of his parents was born in Malawi.
c.The person has been ordinarily resident in Malawi for 3 years.
d.The person has never been convicted or detained for behavior or to public security or
imprisoned for five years or any other criminal offence.

Naturalization of aliens
Any person being a non commonwealth citizen who has been resident in Malawi for over 7
years is eligible to apply for Malawi citizenship provided he or she has fulfilled the
following:-
a.Have adequate knowledge of English and any one of the prescribed vernacular languages.
b.Have good character suitable to be a citizen of Malawi.
c.Financially solvent.

Citizenship by Conferment
Any person may be conferred Malawi citizenship in special circumstances on the discretion
of the Minister.

Types Of Applications
Naturalisation Of Aliens
This category is for people who are aliens according to the Malawi citizenship act.The
applicant should fill the prescribed application form.The requirements to be attached to the
forms are:-

a.Certified copies of Valid passport.


b.Certified copy of Valid permit especially.
c. And other requirements on the checklist of Naturalisation.

Registration
The applicant is supposed to be a commonwealth citizen according to the citizenship act of
Malawi.The applicant fills the forms for registration as a citizen of Malawi.Requirements:-

a. Certified copies of Valid passport.


b.Certified copy of Valid permit –B.R.P and P.R.P.

And other requirements on the Checklist of Registration.

Restoration
The applicant must fill the form for registration but they are treated as special case because
they are claiming their lost citizenship.The requirements to be attached:-

a.Certified copies of Birth certificate.


b. Certified copies of Malawi passport of the parents.

Stateless Persons

The applicant must fill the application forms for stateless person according to the Malawi
citizenship act.The requirements to be attached to the forms:-

a.Rejection letter from the country of his/her parents.


b.And other requirements on the checklist.

Minor Child Of A Malawi Citizen


The applicant must fill the prescribed application forms for Minor child of a Malawi citizen.
The documents to be attached to the form are:-

a. Certified copy of citizenship certificate of his/her parents.


b.Certified copy of Birth certificate.
c.Certified copies of Malawi passport of his/her parents.
d.And other requirements in the checklist.

Married Woman (Wife Of A Malawi Citizen)


A woman who is married to a Malawian must fill a prescribed application form of a Married
woman.The documents to be attached to the form are :-

a.Certified copy of Marriage certificate.


b.Certified copies of Malawi passport of the husband.
c.Certified copies of certificate of citizen.
d.And other requirements in the checklist.

Types of Passport
1. Ordinary Passport
Any eligible Malawian is entitled to this Passport which is valid for 10 Years.

Documents And Information Which May Be Required


All information in the application is subject to verification and, if no proof has been
submitted upon application, any other document may be requested in order to substantiate
any statement made in the application.

New Passport Application


» Two filled passport forms together with two passport size photographs.
» Documents that prove your identity, e.g. Birth Certificate, Academic Certificate or Voter’s
Registration Certificate or Official Letter from the employer.

Lost Passport
» One filled passport form and a passport size photograph.
» Police Report and Report of Lost form.

Renewal Passport
» One filled passport form and two passport size photographs.
» The previous passport.

Child Passport
» A child passport is valid for 5 years and is issued to children under the age of 10 years.

Documents And Information Which May Be Required


» Two filled passport forms together with two passport size photographs.
» Form of consent from either parent or legal guardian.
» Photocopy of either of the parents’ passport and or with Birth Certificate.
» Photocopy of birth certificate for children born outside Malawi.

2. Temporary Passport
This Passport is valid for six months

» Two filled passport forms together with two passport size photographs.
» Documents that prove your identity, e.g. Birth Certificate, Academic Certificate, Voter’s
Registration Certificate, Official Letter from the employer.

Note: The procedures for Temporary Passport is the same as that of Ordinary Passport

3. Service Passport
Senior Government Officials from Grade H are entitled to this passport.

Documents And Information Which May Be Required


As per the requirement for Ordinary Passport but in addition to that, a letter from the Ministry
responsible must be provided that certifies the grade of the applicant.

4. Diplomatic Passport
Diplomatic Passport is valid for 10 Years except for Members of Parliament which is valid
for 5 years and the following are entitled to this passport:

Types of Malawi Visa


(a) Tourist Visa
This is issued to persons intending to enter Malawi for visits or residence or business. It is
valid for 3 months and can only be used once.

(b) Transit Visa


This is issued to persons intending to transit through Malawi for a period of seven days and
can only be used once.

(c) Official Visa


This is issued to persons holding official/service passport on government official vi sits to
Malawi. It is valid for 3 months and can only be used once.

(d) Courtesy Visa


This is issued to persons holding either official/service or ordinary passport e. g a person on a
visit invited by the Government of Malawi if he or she is not entitled to a diplomatic visa. It
may also be issued to other persons considered to be desirable on grounds of international
courtesy. This visa is valid for 3 months and can only be used once.

(e) Diplomatic Visa


This is issued to a person holding a diplomatic passport on official visit or mission to Malawi.
This visa is valid for 3 months and can only be used once.

Current Institutional Arrangements

The Department of Immigration and Citizenship Services is one of the departments under the
Ministry of Home Affairs and Internal Security. The overall responsibility for institutional
management and development rests with the Director General who is the Head of the
Department. Currently, the departments’ headquarters is in Blantyre and has four operational
regions namely: Southern, Central, Northern and Eastern.

Mandate
The Department of Immigration and Citizenship Services is guided by the Republic of
Malawi Constitution under Section 47 and is governed by the Citizenship Act (CAP 15:01)
and the Immigration Act (CAP 15:03) of the Laws of Malawi.
