FACTS

 William and Henry Golkanath were two brothers. They owned 500 acres of property
total in Punjabi territory.
 The Constitution 17 Amendment allowed for the enactment of the Mysore Land
Reforms Act and the Punjab Security and Land Tenures Act of 1953.
 Article 31 Amendments as well as a number of other Amendments were included in
the 17th Amendment to the Constitution. Article 31A was appended and included into
the Constitution's Ninth Schedule.
 A small piece of the land was granted to tenants under Act No. 10 of the Punjab
Security and Land Tenures Act.
 The remaining land and property was designated as surplus, with only thirty acres
granted to the both brothers.
Under Article 32 of the Constitution, this was contested. The two brothers filed a writ
petition in accordance with Article 32 of the Constitution with the Supreme Court.
 The legitimacy of the 1953 Act was challenged in court by the Golaknath family.

Act violate fundamental rights?
2. Whether the Parliament had the power to amend the Fundamental Rights?
