APPLICATION UNDER ORDER XVI RULE 1 READ WITH

SECTION 151 OF THE CIVIL PROCEDURE CODE, 1908 FOR
SUMMONING OF WITNESSES ON BEHALF OF THE
PLAINTIFF;
Most respectfully showeth:

1. That the present application is being filed on behalf of the

plaintiff under Order XVI Rule 1 read with Section 151 of Civil
Procedure Code1908 for summoning of witnesses as per the
list of witness filed by the plaintiff in the present suit. it is
submitted that the matter is at the stage of plaintiff’ evidence
which is being recorded before the Local Commissioner.

2. That with the prior permission of this Hon’ble Court, the

plaintiff wishes to call the PW-4 i.e. official of Andhra Bank.
However, it is apposite to state here that vide gazette
notification dated March 4, 2020, the Andhra Bank has
amalgamated into Union Bank of India with effect from
01.04.2020. A copy of notification dated 04.03.2020 is annexed
herewith and marked as Annexure-A/1.
3. Therefore, in view of above facts and circumstances, the
Plaintiff prays before this Hon’ble Court, may kindly call the
Bank Official as a Witness along with documents/records as
per details provided below;

 PW4- The Bank Manager or Authorized Representative

of the Union Bank of India (formerly known as Andhra

Bank) Branch at 586, Lajpat Nagar, J-41, Central Market

Lajpat Nagar-II, come along with documents/records

pertaining to Bank Account Number 058610021050150 in

respect of cheque number 240740 dated 31.01.2013 sum

of Rs. 3,50,000/- and cheque number 240741 dated

31.03.2013 for sum of Rs. 3,50,000/- were in the name of

Plaintiff (Dinesh Abrol) by the account holder Praveen

Dhawan drawn on Andhra Bank.

4. That in view of considering the above facts and circumstances,

the plaintiff prays before this Hon’ble Court to allow the
present application and issue notice/summon to the Bank
official of Union Bank of India (formerly known as Andhra
Bank) to come along with relevant documents/records
pertaining to above mentioned Bank Account and Cheques in
question as per details provided above.

PRAYER:
 It is therefore, most respectfully and humbly prayed before
this Hon’ble Court, may kindly be pleased to allow the
application and Summon the Bank Manager/ authorized
representative of Bank of Union Bank of India (formerly
known as Andhra Bank) to bring documents/record
associated with of Bank Account Number 058610021050150,
Bank Account holder name – Praveen Kumar Dhawan in
respect of cheque number 240740 dated 31.01.2013 sum of Rs.
3,50,000/- and cheque number 240741 dated 31.03.2013 for
sum of Rs. 3,50,000/- as per the date fixed by the Local
Commissioner in the interest of justice.
