DECLARATION CUM UNDERTAKING :

Sir/Madam,

I/We, the Security Provider (as specifically mentioned in Schedule “B”), undertake
to deposit with Muthoot Fincorp Limited (“MFL”) the original title deeds and other
related documents as mentioned in Part II of Schedule “A” with respect to my/our
Property (details whereof are mentioned in Part I of Schedule “A”, hereinafter
referred to as the “Property”) with an intention to create Equitable / Registered
Mortgage, as and when required by Muthoot Fincorp Limited (“MFL”), on the
Property together with all buildings and other structures constructed/to be
constructed thereon to create such Security to secure the Loan of Rs. 600000/-
(Rupees Six Lacs Rupees Only) (hereinafter referred to as the “Loan”) availed by
the Borrower(s) from Muthoot Fincorp Limited (“MFL”). I/We have already
executed the Loan Documents in relation to the Loan (hereinafter referred to as the
“Loan Documents”). Further I/We undersigned, being the Security Provider,
(which expression shall unless the context otherwise requires, include his/her/ their
heirs, executors, administrators and permitted assigns) hereby declare and confirm
that:

01. I/We say that I/We are absolutely seized and possessed of or otherwise well
and sufficiently entitled to the Property.
02. I/We have disclosed all facts in relation to the Property and made available to
Muthoot Fincorp Limited (“MFL”), all original title deeds and other deeds
and writings in my/our possession and power.
03. I/We have acquired the Property, with my/our self-acquired funds for the
said Loan.
04. I/We am/are the only sole and absolute owner thereof and no other person
has any share, right, title or interest of any kind or nature whatsoever in the
property or are the beneficial owners thereof.
05. I/We say that the Property is free from all encumbrances, claims and
demands and the same is not subject to any charge, lien, Lis-pendens,
attachment or any other processes issued by any court or authority and I/We
have not created any lien, gift or trust in respect thereof and no suit, writ,
action or other proceeding is pending against me/us in respect of the
Property and that no notice for acquisition or requisition is issued in respect
of the Property. I/We, further, declare that the Property is not encumbered in
any manner whatsoever and I/We have an absolute, clear, and marketable
title thereto.
06. I/We say that the Property has been/will be constructed as per the approved
sanctioned plan and/or building byelaws and completion certificate has
been/ will be obtained from the authority/ies concerned within 3 (three)
months from the date of completion failing which Muthoot Fincorp Limited
(“MFL”), shall have the power and authority to recall the entire Loan with
Interest, costs and other usual charges and may consider it as an Event of
Default as mentioned in the Loan Agreement.
07. I/We hereby agree, confirm, and undertake that I/We will at all times, as and
when required, make out a clear and marketable title to the Property to the
satisfaction of Muthoot Fincorp Limited (“MFL”) , free from all reasonable
doubts, claims and encumbrances.
08. I/We say that I/We have duly paid and will duly pay the rates, taxes, cesses,
assessments, revenues, duties, society charges and all other amounts now or
hereafter due in respect of the Property and that at present there are no
arrears of such rates, taxes, revenue etc. outstanding and that no attachment
or warrants have been served on me/us in respect of sales tax, GST, income
tax, government revenues and other taxes.
09. I/We say that I/We have observed and performed and will duly observe and
perform all rules, regulations, terms, conditions, and covenants subject to
which the Property has been purchased/acquired/held by me/us which are
so required to be observed, performed, complied with by me/us.
10. I/We say that as on date I/We have in my/our possession, power and control
of only those documents, evidence/s and writings being the title deeds,
relating to the Property.
11. There are no action, suit, proceedings, or investigations, decided, disposed or
pending to my/our knowledge or threatened by/against me/us before any
Court of Law or any other competent authority or body which has/have
material effect on my/our business/profession/service, properties or affairs
or which might put into question the validity or performance of the Loan
Documents or any of its terms and conditions.
12. I/We will not sell, exchange, partition, mortgage, charge, encumber, lease,
dispose of or deal with the Property in any manner whatsoever until such
time all the liabilities under the various facilities granted to the Borrower(s)
have been paid in full by the Borrower(s) and until all other obligations under
the Loan have been fully and effectively discharged and a confirmation in
writing from Muthoot Fincorp Limited (“MFL”), in this regard has been
duly obtained.
13. I/We are not aware of any documents/judgment or legal process of
latent/patent-defect in my/our title to the Property which may prejudicially
affect Muthoot Fincorp Limited (“MFL”), or my/our capacity to create a
Security thereon.
14. I/We hereby declare and undertake jointly and severally to indemnify and
keep Muthoot Fincorp Limited (“MFL”), fully indemnified, save and
harmless of or from or against any loss, damage or risk that might arise to
Muthoot Fincorp Limited (“MFL”), on account of any defect in my/our title
to the Property or on account of any default of mine/our(s) or on account of
any defect or non-observance or breach of any terms, clause, conditions or
covenants of the Loan Documents or any other document or any claim,
demand or risk however arising to Muthoot Fincorp Limited (“MFL”), with
reference to the Property or the Loan and that in the event Muthoot Fincorp
Limited (“MFL”), suffering from any claim, risk damages etc. I/We shall
forthwith reimburse to Muthoot Fincorp Limited (“MFL”), the amount of
any such claim demand, risk etc. together with costs, interest etc. as the case
may be, notwithstanding the right of Muthoot Fincorp Limited (“MFL”), to
recall the Loan together with interest and other amounts payable to Muthoot
Fincorp Limited (“MFL”),.
15. I/We further agree and undertake to keep alive the insurance policy/policies
assigned in favor of Muthoot Fincorp Limited (“MFL”), as and by way of
paying in time the premium as and when due and produce the receipts to
Muthoot Fincorp Limited (“MFL”). In case I/We default in payment of any
Spremium or other amounts or charges due under any policy or policies,
Muthoot Fincorp Limited (“MFL”), may at its discretion, pay the same and
in the event of such payment Muthoot Fincorp Limited (“MFL”), would be
entitled to a reimbursement of the same.
16. I/We further say that Muthoot Fincorp Limited (“MFL”), shall have the right
to receive and adjust any amount that Muthoot Fincorp Limited (“MFL”)
may receive in connection with the insurance policy/ policies against the
Loan and alter the amortization or Repayment schedule in any manner as
Muthoot Fincorp Limited (“MFL”), may deem fit notwithstanding anything
to the contrary contained in the Loan Documents or any other document or
paper.
17. I/We have scrutinized and am/are satisfied with the building plans. The
commencement certificate and all the requisite permissions pertaining to the
Property and that the construction is as per the approved plans and of
satisfactory and standard quality.
18. I/We hereby declare and undertake and confirm that Muthoot Fincorp
Limited (“MFL”), or its affiliates may utilize the information furnished by
me/us in such manner, as they may deem fit or necessary, including making
of any disclosures to any regulatory or any other person.
19. I/We irrevocably authorize Muthoot Fincorp Limited (“MFL”), to return the
document/s (including that which may be deposited hereafter), if any, to
me/us/any other Person (who will discharge the Loan) under proper
acknowledgment as per applicable policy of Muthoot Fincorp Limited
(“MFL”).
20. I/We hereby declare and undertake and confirm that the Property shall be
used for the Purpose as set out in the Disbursement Letter.
21. I/We make the aforesaid declarations and statements and give the aforesaid
undertaking solemnly and sincerely believing the same to be true and
knowing fully well that on the faith and strength whereof, Muthoot Fincorp
Limited (“MFL”), has agreed to give the Loan.

This Declaration and Undertaking shall form an integral part of the Loan Documents
and shall be read in conjunction with the same.

NO-766,NEAR MPPS SCHOOL,LAKKARAJUGARLAPADU VILLAGE, SATTENAPALLI MANDAL,
SATTENAPALLI SUB D,PALNADU AP 522403. The property belonging to
LAKKARAJUGARLAPADU VILLAGE, SATTENAPALLI MANDAL, SATTENAPALLI SUB D,PALNADU
AP 522403.area has been inherited by me as mentioned in above nature and has remained
in my right of possession unit today and has been sold and acquired by me to you this date
27/04/2024 in SRO Sattenapalli., SY NO. 276, Door No. 4-388/D Area 240 Sq. Yds.
(Which is hereinafter referred to as the “Said Property”).

As per title deed dated 27/04/2024 the said property is bounded as under:
