Communal Violences and Riots Bill, 2024

A
BILL

to establish a legal framework which mandates the law for communal


violences and riots in the country of Bharat. To decrease the
rates of communal violences and riots in Bharat and solve the
matters of the violence and reduce the negative aftermath of the riot.
To punish the wrong and to do justice with the right and solve
the problems connected herewith.

BE it enacted by Parliament in the Seventy-Fifth Year of the Republic of Bharat


as follows:—

1. (1) This Act may be called the Communal Violences and Riots
bill, 2024

(2) It shall come into force on such a date as the Central


……..Government may, by notification in the Official Gazette, appoint.

2. In this Act, except the context otherwise requires, —

(a) "drafting agency" means any Central Government department,


ministry or a third party, whether Private or public that is tasked on behalf
of the Government of India to draft or amend a law;
(b) "law" means central law and includes any central Ordinance,
Order, by-law, rule regulation, notification, custom or usages having in the
territory of India the force of law;

(c) “Communal Violence” means a form of spoken, physical


expression in which the community, the society or the state gets affected in
a negative manner as follows:

(i) people get killed and injured due to the violent situation of
the community, the society or the state.

(ii) rules, regulations and laws get violated, therefore increasing


the negative impact of the violence.

(iii) people, the youth of our country may get depressed and this
may lead to the increased rates of youth suicides in Bharat.

(iv) the families of the killed or the injured persons may lead to
an economic crisis in the family.

(v) destruction of houses, businesses and places of worship


affecting the livelihood of many individuals.

(vi) social status of the people, the community, the society, the
state gets disturbed.

(vii) demolition of public property causes economic instability to


the state.

(viii) the criminals taking part in the violences may increase the
rates of mortality, rapes, suicides, domestic violence, sexual harassment,
etc.
3. Every ministry and department of the Government of Bharat
shall strive to ensure that no cases of communal violences must occur, and
if they still do, to ensure that the people are safe and away from any kind
of danger.

4. The criminal should be presented to the honourable court as soon


found:

(1) Once the criminal is entangled and proved wrong, he/she should get
the punishment as the honourable court decides.

(2) The families of the victims should get compensation from the
criminal.

(3) Any medical needs of the family and the victim must be fulfilled by
the government.

(4) The places* affected by the violence must be recovered by the


criminal(s) thereby.

(5) There should be a mutual understanding between the people


protesting and the people must try their best to solve the problem with
their understanding.

The places* specifically, any religious/worshipping place, if demolished; places dedicated to


government services; public gathering places.; i.e. the places where people gather, etc.
5. Punishments :
(1) This Act strives to Punish the people that have caused or
attempted to disturb the communal harmony of the community, the
society or the state and have or have tried to create nuisance,
violence, vulgarity, profanity or any other crime. The punishments
are given herewith.

(2) If the criminal has got entangled of the crime and proved to be
wrong, then:

(i) The criminal has to give compensation to the government (or


the damaged individual/family/institution) the amount decided by
the honourable court (+ the cost of the medication/damage).

6. Provisions for Special Unit of Communal Violences under the CRPF :

(1) This Unit may be called the ‘Special Unit for Communal
……..Violences (SUCV)’

(2) This Force is a Security Team that may be formed for the protection
……...of the people from the rebels and the violence.

(3) This Force may be responsible for the protection of the people
…….. during any type of communal violence or riot

(4) The Force will be given verbal training for any type of violent
……...protests

(5) The Force will consist of trained military professionals and in all
… conditions be present in all the states and union territories.
