TURN APP TERMS AND CONDITIONS

Welcome to Turn App! These Terms and Conditions ("Terms") are a binding legal
agreement between you and Turn App that govern your use of our platform, mobile
apps, and services (collectively, the "Services"). By accessing or using our Services, you
agree to comply with and be legally bound by these Terms.
1. Who We Are
1.1 Turn App Services

Turn App is a platform dedicated to bringing people together through events and
experiences. Our Services enable users to create, discover, share, and register for
events.
1.2 Definitions
 "Organizer": Event creators using the Services to create events for attendees.

 "Consumers": Individuals who use our Services to consume information about

or attend events.

 "Users": Collectively refers to Organizers, Consumers, and any third parties

using our Services.
2. Acceptance of Terms
2.1 Agreement to Terms

By using our Services, you are agreeing to follow and be legally bound by these Terms,
our Privacy Policy, and all relevant laws and regulations. This signifies your
understanding and acceptance as a user of Turn App.
2.2 Binding Nature

Accessing or using any part of our platform signifies a binding agreement between
you and Turn App, accepting all rules and responsibilities outlined in these Terms
and our Privacy Policy.
2.3 Privacy Policy

Our Privacy Policy is an integral part of these Terms. It details how we handle your
personal data. By agreeing to these Terms, you consent to the practices described in
the Privacy Policy.
2.4 Compliance with Laws

You must comply with all applicable laws and regulations when using our Services.
This includes laws related to intellectual property, data protection, and consumer
rights.
2.5 No Use Without Agreement

If you do not agree with any part of these Terms or applicable laws, you are not
permitted to use our Services. Your continued use of the Services indicates acceptance

 Date Revision: We will update the "Effective Date" at the top of the Terms to
reflect the date of the latest modifications.

notifications, such as a statement on our homepage or an email notification.
3.3 Acceptance of New Terms

Your continued use of the Services after any changes have been made constitutes your
acceptance of the new Terms. It is your responsibility to review the Terms

4. Use of Services
4.1 Eligibility

represent that you have the legal capacity to enter into these Terms.

content, you grant Turn App a non-exclusive, royalty-free, worldwide license to use,
reproduce, distribute, prepare derivative works of, display, and perform your content
in connection with the Services.

You agree not to post any content that:

 Is illegal or harmful.

 Is defamatory, obscene, vulgar, or offensive.

 Promotes discrimination or violence.

 Infringes third-party rights.

5.3 Removal of Content

Turn App reserves the right to remove any content that violates these Terms or is
otherwise objectionable.
6. Fees and Payments
6.1 Fees

Some features of the Services may require payment. All fees are quoted in KES unless
otherwise stated. You agree to pay all applicable fees related to your use of the
Services.
6.2 Payment Methods

We accept various forms of payment. By providing a payment method, you authorize

us to charge it for the total amount of your order.
6.3 Refunds

All sales are final, and no refunds will be issued unless specified in our Refund Policy.
7. Intellectual Property
7.1 Ownership

Turn App, or its licensors, owns all rights to the Services, including content and
materials provided. By using the Services, you do not gain any ownership rights.
7.2 License to Use Services

Turn App grants you a limited, non-exclusive, non-transferable, and revocable license
to access and use the Services for personal, non-commercial purposes.
8. Third-Party Links
8.1 Inclusion of Links

The Services may include links to third-party websites or services for your
convenience.
8.2 No Ownership or Control

Turn App does not own or control third-party websites or services.

8.3 No Responsibility

Turn App is not responsible for the content, privacy practices, or terms of third-party
websites or services.
9. Disclaimer of Warranties
9.1 "As Is" and "As Available" Basis

The Services are provided "as is" and "as available." Turn App does not guarantee that
the Services will be free from defects or interruptions.
9.2 No Express or Implied Warranties

Turn App disclaims all warranties, including implied warranties of merchantability,

fitness for a particular purpose, non-infringement, and title.
10. Limitation of Liability
10.1 Scope of Liability

Turn App's liability is limited to the fullest extent permitted by law.

10.2 Types of Excluded Damages

Turn App will not be liable for indirect, incidental, special, consequential, or punitive
damages.
10.3 Specific Types of Losses

Turn App will not be liable for loss of profits, data, use, goodwill, or other intangible
losses.
10.4 Maximum Aggregate Liability
Turn App’s total liability for all claims will not exceed the amount you paid to Turn
App in the past 12 months.
11. Indemnification
11.1 Your Agreement to Indemnify

You agree to indemnify Turn App and its officers, directors, employees, agents,
licensors, and suppliers from any claims, liabilities, damages, losses, costs, and
expenses arising from your use of the Services or violation of these Terms.
12. Termination
12.1 Right to Terminate or Suspend

Turn App reserves the right to terminate or suspend your access to the Services at any
time, with or without cause or notice.
12.2 Immediate Effect

Termination or suspension will be effective immediately.

12.3 Cessation of Rights

Upon termination, your right to use the Services will cease immediately.
12.4 Surviving Provisions

Certain provisions of these Terms will continue to be in effect even after termination,
including ownership, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law
13.1 Choice of Law

These Terms are governed by the laws of Kenya.

13.2 Conflict of Law Principles

The application of Kenyan law is without regard to its conflict of law principles.
13.3 Jurisdiction Agreement

You consent to the jurisdiction of Kenyan courts for any disputes related to these
Terms.
13.4 Personal and Exclusive Jurisdiction

You agree to submit to the personal and exclusive jurisdiction of Kenyan courts.
13.5 Dispute Resolution Location

All litigation related to these Terms must be conducted in Kenya.

14. Miscellaneous
14.1 Entire Agreement

These Terms constitute the entire agreement between you and Turn App regarding
the Services and supersede any prior agreements.
14.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions will
remain in full force and effect.
14.3 Waiver

No waiver of any term will be deemed a further or continuing waiver of such term or
any other term.
14.4 Assignment

You may not assign these Terms without Turn App’s prior written consent. Turn App
may assign these Terms without restriction.
