SUBJECT : REITERATION OF DILG MEMORANDUM CIRCULAR NO.

2008-144 DATED SEPTEMBER 19, 2008 RE: MAINTENANCE
AND UPDATING OF RECORDS OF ALL INHABITANTS OF
THE BARANGAY

Please be informed that several complaints were brought to this Department’s

attention relative to the conduct of house-to-house collection for the Records of
Barangay Inhabitants (RBIs) in some barangays. Allegedly, when the barangay
workers/collectors were asked for a privacy policy or notice, they could not provide
any information, and the RBI Forms do not have data privacy notice or consent.

In view of this, you are hereby requested to please remind our local chief executives
and barangay officials, through our field officers, of their roles and responsibilities as
mandated in the said MC and take necessary precautions in the distribution and
retrieval of the RBI Forms.

Specifically, please remind them about paragraphs 3 and 6 of the DILG MC No. 2008-
144 which state that:

“The City/Municipal Mayors and Punong Barangays shall adopt necessary

measures to ensure that the right to privacy will be observed in the process
of maintaining and updating records of all inhabitants of the Barangay.”

“The City/Municipal Mayors shall reactivate the RBI Task Force, which she/he
will head and shall be composed of the local civil registrar, the city/municipal
President of the Liga ng mga Barangay, the DILG Officer assigned in the
city/municipality and two (2) other members to be designated by the Mayor.”

Further, any provisions under Republic Act (RA) 10173 or the Data Privacy Act of
2012, whichever are applicable, shall also be observed and considered in collecting
the records of barangay inhabitants.

Moreover, pursuant to Section 12(e) of the said Act, the processing of personal
information is necessary in order to respond to national emergency, to comply with

the requirements of public order and safety, or to fulfill functions of public authority
which necessarily includes the processing of personal data for the fulfillment of its
mandate.

As the maintenance and updating of Records of Barangay Inhabitants (RBIs) is

mandated by law, collecting and processing personal data may be done even without
the consent of the data subject, however, the data subject shall also be informed of
the purpose and the use of the gathered data/information, through the Privacy Notice
indicated in the forms. Likewise, the concerned Offices shall ensure that
organizational, physical and technical security measures are in place to protect the
personal data of the data subject.

While the development of the Omnibus Policy on RBI, in collaboration with the
Commission on Population and Development (CPD), is in progress, we deemed it
appropriate to issue this Advisory in the exigency of public service and to avoid the
recurrence of similar complaints. Attached are the following revised RBI forms that
shall be utilized for the collection of data:

1. Revised RBI Form A containing Data Privacy Notice and Consent;

2. Revised RBI Form B containing Data Privacy Notice and Consent to be
accomplished by the head of the family;
3. Revised Form C adjusting the age bracket to be consistent with that of PSA;
and
4. Revised RBI Form D - Monitoring Form.
