Application for releasing the vehicle Splendor Plus


bearing registration No.PB-09-AL-9034, on sapurdari.

ORDER

The present application for releasing the vehicle Splendor

Plus bearing registration No.PB-09-AL-9034, on sapurdari, has been

moved by applicant Kashmir Singh through his counsel Ms.Kulwinder

Kaur Pannu, Advocate, in case bearing FIR No.84 dated 18.03.2024,

under Sections 379-B/411 IPC, P.S. City Kapurthala. In the application, it

has been submitted that the above said vehicle has been taken into

custody by the police of Police Station City Kapurthala in the above noted

case. The applicant is the registered owner of the above said vehicle,

which is required by the applicant for his personal use. The condition of

the motorcycle is deteriorating day by day while lying in the police station

and no useful purpose shall be served to keep the abovesaid vehicle in

police custody. Hence, the present application.

2. On filing of the application, report of police has been

requisitioned, who has been reported that the vehicle in question was

taken in police possession on 23.03.2024 in the above noted case and the

applicant Kashmir Singh is registered owner of the said vehicle. They

have further reported that they have no objection if the vehicle in question

be released to the applicant, on Sapurdari.

3. Alongwith application, the applicant has placed on record the

copy of RC of the vehicle in question and copy of his Aadhar Card.

4. In view of the contents mentioned in the application,

documents placed on record and the report received from the concerned

police station, the present application is hereby allowed and the vehicle in

question is ordered to be released to the applicant i.e. Kashmir Singh,

subject to furnishing sapurdari bonds in the sum of ₹75,000/- with one

surety in the like amount against immovable property subject to the

following conditions:-

i. That he shall not alienate, mutilate, destroy the vehicle, as


mentioned in the application during the pendency of the case;
ii That he shall keep the same intact during the pendency of the
case, with further condition that he shall produce the same on
each and every date of hearing.

5. The application moved by applicant stands disposed off.

Requisite Sapurdari bonds not furnished. The file be attached with the

concerned papers/main file.
