PETITION FOR CORRECTION OF ENTRY


IN THE TRANSFER OF CERTIFICATE OF TITLE

PETITIONER, through undersigned counsel unto to this


Honorable Court, respectfully alleges:

1. Petitioner Bright Homes & Realty Corporation (“Petitioner”) is a


corporation duly organized and existing under the laws of the Republic
of the Philippines with office address at #50 Scout Borromeo St. South
Triangle, Quezon City where it may be served with the notices,
summons and court processes of this Honorable Court.
2. The Register of Deeds (“RD”) of Meycauayan, Bulacan is hereby
impleaded as a nominal party being the government agency tasked with
the duty to issue corrected transfer certificate of the title over real
property estates in Sta. Maria Bulacan. It may be served with the
notices, summons and court processes of this Honorable Court at
Murilla St., Brgy., Iba, Meycauayan Bulacan.

3. Petitioner engages in business as real estate developer particularly


located in Sta. Maria Bulacan. Lawful ownership of the petitioner is
evidenced by the Transfer of Certificate of Title No. 040-2015033623
issued by the Registry of Deeds of Meycauayan confirmed by the Land
Registration Authority and a Tax Declaration No. 2018-24008-20272
issued by Office of Municipal Assessor of Meycauayan Bulacan. Copy of
TCT No. 040-2015033623 and Tax Declaration 2018-24008-20272 is
hereto attached as Exhibit “A” and “B” respectively.

4. Records shows that the Survey Plan of Lot 265 Block 56 Pcs-03-02067
provides the following specifications:

1. The Survey Plan was prepared by Engr. Aibraham O. Maling on 17
February 2014 and was duly approved by the DENR on December 9,
2014 comprising several subdivided lots with corresponding Technical
Descriptions in the Transfer Certificate of Title. Copy of the Lot Data
Computation, Cadastral Map and Approved Survey Plan is herein
attached as Exhibit “C” to “E” respectively.

2. The Technical Description of the subject property was also certify by the
Records and Verification Section of the Regional Technical Director for
Land of the Department of Environment and Natural Resources. Copy of
the Certification is herein attached as Exhibit “F”.

3. However, the Transfer of Certificate of Title No. 040-2015033623


provided a different area in its technical description. The Transfer of
Certificate of Title No. 040-2015033308 provided the details as follows:

4. That Bright Homes & Realty Corporation is the owner of the land
adjoining the Northern, Eastern, Southern, and Western sides of the
subject property and that there are no conflicts or legal encumbrances
between/among with respect to said exact area boundaries; Copy of the
Affidavit of Adjoining Owner with respective Certified True Copy of the
title is herein attached as Exhibit “G”.

5. Prompted by this event, Petitioner sought the assistance of the Registry


of Deeds Meycauyan to verify the details appearing in the Transfer
Certificate of Title and found out that there was indeed a discrepancy in
the area provided in the title vis-à -vis in the approved survey plan.

6. Said discrepancy was inadvertently committed while the technical


description for the new TCT of the property was encoded.

7. Thus, this instant Petition is being filed pursuant to Section 108, P.D. No.
1529 provided as follows:

Section 108. Amendment and alteration of certificates. No


erasure, alteration, or amendment shall be made upon the
registration book after the entry of a certificate of title or of a
memorandum thereon and the attestation of the same by the
Register of Deeds, except by order of the proper Court of First
Instance. A registered owner or other person having interest
in the registered property, or, in proper cases, the Register of
Deeds with the approval of the Commissioner of Land
Registration, may apply by petition to the court upon the
ground that the registered interest of any description, whether
vested, contingent, expectant or inchoate appearing on the
certificate, have terminated and ceased; or that new interest not
appearing upon the certificate have arisen or been created; or that
an omission or an error was made in entering a certificate or
any memorandum thereon, or on any duplicate certificate: or
that the same or any person in the certificate has been changed or
that the registered owner has married, or, if registered as
married, that the marriage has been terminated and no right or
interest of heirs or creditors will thereby be affected; or that a
corporation which owned registered land and has been dissolved
has not yet convened the same within three years after its
dissolution; or upon any other reasonable ground; and the
court may hear and determine the petition after notice to all
parties in interest, and may order the entry or cancellation of
a new certificate, the entry or cancellation of a memorandum
upon a certificate, or grant any other relief upon such terms
and conditions, requiring security and bond if necessary, as it
may consider proper; Provided, however, That this section shall
not be construed to give the court authority to reopen the
judgment or decree of registration, and that nothing shall be done
or ordered by the court which shall impair the title or other
interest of a purchaser holding a certificate for value and in good
faith, or his heirs and assigns without his or their written consent.
Where the owners duplicate certificate is not presented, a similar
petition may be filed as provided in the preceding section.

All petitions or motions filed under this section as well as any


other provision of this decree after original registration shall be
filed and entitled in the original case in which the decree of
registration was entered.

WHEREFORE, it is respectfully prayed that the petition be granted and
the Registry of Deeds be ordered to a new title bearing the correct details of
the property respectively pursuant to the Technical Descriptions duly
approved by the Department of Natural Resources.

Other just and equitable relief and remedies are likewise prayed for.
