A person who intends to import food, additives, apparatus or containers and packaging to serve for UNCTAD refer the purpose of marketing or to use in business shall make a notification to the Minister of Health, to : e-Gov Labour and Welfare on a case-by-case basis, pursuant to an Ordinance of the Ministry of Health, Laws and Labour and Welfare (Article 27 of the Food Sanitation Act). The following information should be notified: (i) The name and address (for a juridical No. 233 of 24 person, its name and the location of its principal office); (ii) Whether the cargoes are food, additives, December apparatus, containers and packaging, or toys, the names of the articles, loaded quantity, loaded 1947 weight, type of packaging, and usage, and when the cargoes have any marks and numbers, said marks and numbers; (iii) When the cargoes are food containing additives which are used for purposes other than for flavoring (for food which is generally served for human consumption and is used as an additive, limited to food for which standards or criteria have been established pursuant to the provisions of Article 11, paragraph (1) of the Act), the name of said additives; (iv) When the cargoes are processed food, the raw materials thereof and production or processing methods; (v) When the cargoes are food of farm products or processed food listed in item 12. of appended table 3 (excluding those listed in Article 21, paragraph (14), item (i) or item (ii)), the matters listed in paragraph (1), item (i), (nn), 1. to 3.of the same Article according to the relevant classification set forth in (nn), 1. to 3. of the same item; (vi) When the cargoes are additives, or preparations containing said additives (excluding those used for flavoring and those generally served for human consumption which are used as additives), the ingredients thereof; (vii) When the cargoes are apparatus, containers and packaging, or toys, the materials thereof; (viii) The name and address of the producer or processor of the cargoes (excluding food other than processed food) (for a juridical person, its name and the location of its principal office); (ix) The name and location of the production or processing facility of the cargoes (in the case of food other than processed food, the place of production), the loading port, loading date, unloading port, and arrival date of the cargoes; (x) The name or flight of the ship or airplane loaded with the cargoes; (xi) The name and location of the warehouse where the cargoes have been stored and the date of carrying-in; (xii) Whether there have been any accidents concerning the cargoes and the outline of the accidents if any. Article 7 Paragraph 1 of the Law stipulates that any person shall not import (i) Plants that are sent UNCTAD refer from areas provided for in Annexed Table 2 (list of the import prohibited plants) of the Ministerial to : e-Gov Ordinance for Enforcement of the Plant Protection Law (Ordinance of the MAFF No. 73 of 1950); (ii) Laws and Plants provided for in Annexed Table 1-2 (list of the plants subject to the growing site inspection in Regulations the exporting countries) of the Ministerial Ordinance, except those that have been cultivated in the Database region listed in the table; (iii) Quarantine Pests that are listed in Annexed Table 1 (Quarantine Pest System - Plant list) of the Ministerial Ordinance; (iv) Soil or plants to which soil is attached; and (v) Containers or Protection Act packages of goods listed in each of the foregoing items. Among (i)-(v), - (i), (ii), and (v) correspond to geographical restrictions of imports; and - (iii), (iv), and (v) correspond to prohibitions of imports regardless of a country of origin. However, the import prohibitions/restrictions shall not apply if the permission of the MAFF is obtained for use in test and research and for other special purposes specified by Article 6-2 in the Ministerial Ordinance: - for use as a sample, or storage, in museum, in the facilities of the Botanical Gardens, and other public;. - for use as evidence for the criminal investigation; and - for use in producing melon fly that is in non-reproductive in order to perform the control of melon fly. This measure id concerns (i) and (v) above.
