At the end of subtitle A of title XVII, add the fol-


lowing new section:

1 SEC. 17ll. LIMITATION ON ASSISTANCE TO THE MILITARY

2 AND SECURITY SECTOR OF PAKISTAN.

3 (a) LIMITATION.—The President may not provide


4 any weapons, training, or security assistance, including
5 through the foreign military financing, international mili-
6 tary education training, or international narcotics and
7 control law enforcement programs or under any authority
8 in chapter 16 of title 10, United States Code, to the mili-
9 tary, and security, and intelligence services of Pakistan,
10 and shall suspend or terminate any pending foreign mili-
11 tary sales to Pakistan, until the date on which the Presi-
12 dent certifies to Congress that the Government of Paki-
13 stan has met each of the conditions described in subsection
14 (c).
15 (b) WAIVER.—The President may waive the limita-
16 tion under subsection (a) on a case-by-case basis if, not
17 later than 60 days before assistance is to be provided, the
18 President submits to Congress—

1 (1) a justification that the waiver is in the na-
2 tional security interest of the United States; and
3 (2) a certification that the recipients have met
4 the requirements of either section 620M of the For-
5 eign Assistance Act of 1961 (22 U.S.C. 2378d), for
6 assistance funded through appropriations made
7 available to the Department of State, or section 362
8 of title 10, United States Code, for assistance fund-
9 ed through appropriations made available to the De-
10 partment of Defense.
11 (c) CONDITIONS DESCRIBED.—The conditions de-
12 scribed in this subsection are the following:
13 (1) Pakistan has held a free and fair national
14 election without significant interference or coercion
15 by military, security police, or intelligence officials
16 during either the pre-election period or during the
17 tabulation process or the formation of a government.
18 (2) Intimidation and coercion of the judiciary
19 has ended and recipients of relevant security assist-
20 ance have not engaged in undermining democracy in
21 Pakistan or committed significant human rights vio-
22 lations, including the taking of political prisoners.
23 (3) Pakistan has reasserted separation of pow-
24 ers and the independence of the judiciary from exec-
25 utive pressure and interference.

1 (d) FORM.—The certifications required by this sec-
2 tion shall be submitted in unclassified form but may in-
3 clude a classified annex.
