Notice of Intention To Sue The Govt
We further bring to your attention the fact that we are writing this notice under instructions from
our clients named Proches Eleza Tarimo whose address of communication and services
concerning this notice is under the care of Infinity Law Attorneys which is fully indicated in this
letter head hereinabove.
Our client has instructed us to demand from you the sum of T.Shs. 1,721,881,500/= As
compensation for the loss suffered following demolition of 38 shops and 1 residential house done
by Tanzania National Roads Agency from 7th day of April, 2016 to 11th day of April, 2016.
The said demolition were affected contrary the judgment of the High Court dated 31 st May, 2013
and the order of the court dated 17 th March, 2016 the said judgment and order of the court were
within your knowledge and the officers effecting the demolition were shown out you decided to
ignore.
NOW THEREFORE our client has instructed us to issue this statutory notice of intention to
sue the government on the grounds (cause of action) above stated. If the said payments are not
paid court action will be indulged upon after the expiry of 90 days from the date of services of
this notice to you and the copy being circulated to and received by the office of the Attorney
General as required.
In the intended suit we are prepared to move the court for declaration that the demolition was
illegal, the demolition was without basis, our client be compensated for the loss caused.
