Subject: 1. Show cause notice for cancellation/ revocation of consent to operate granted
to the industry under the Water (Prevention & Control of Pollution) Act, 1974
and the Air (Prevention& Control of Pollution) Act, 1981.

2. Notice to issue directions u/s 33-A of the Water (Prevention & Control of
Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act,
1981.

Whereas, it is mandatory on the part of the facility to obtain the consent to


establish (NOC) of the Board as required u/s 25 of the Water (Prevention & Control of Pollution)
Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981, for establishment of
industry.
And whereas, it is mandatory on the part of the facility to obtain the consent of
the Board to operate an outlet/ plant as required u/s 25 ofthe Water (Prevention & Control of
Pollution) Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981, for
discharge of effluents/emissions arising from its premises.
And whereas, it is mandatory on the part of the facility to provide adequate and
appropriate effluent treatment facilities/air pollution control device, so as to contain the various
pollutants within the standards laid down bythe Board, in the effluent/ emissions discharged by
the industry.
And whereas, the facility was granted 'consent to operate' under the Water
(Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of
Pollution) Act, 1981 on 06.08.2020, validity upto 31.03.2021 for processing of E-Waste 3.34
TPD subject to suitable conditions. These consents were further renewed upto 30.06.2025.
And whereas, the facility was visited by officers from Head Quarter-3 of Head
office of the Board on 31.10.2023. During visit, it was observed as under:
1. The entity is engaged in business of dismantling/processing of E-waste, but the same was
not in operation during visit.
2. No raw material/ e-waste was stored within the shed.
3. The condition of the shed shows that the entity has not been operated since long.
4 No dismantling table has been installed within the shed. Only suction hoods attached with
APCD were installed alongwith stack.
5. The entity has provided separate chambers for storage of e-waste, but the same were found
empty.
6. No shredder and size separator were installed in the shed, whereas, some machinery in
non-operational condition was placed in one corner of the shed.
7. The entity has not provided weigh bridge within its premises.
8. No record is available with the representative of the entity at the same time of visit.
9 The entity has not got itself registered on the Centralized online EPR Portal as mandatory
under the E-Waste (Management) Rules, 2022.
And whereas, show cause notice for violations of the provisions of the E-waste
Management Rules, 2022 framed under the Environment (Protection) Act, 1986 was issued to
the facility with an opportunity of personal hearing before the Chief Environmental Engineer
(Waste Management) on 17.11.2023 (postponed to 22.11.2023), which was attended by Sh
Ashwani Kumar, representative of the facility, wherein, it was decided that:
1. The entity shall upgrade its unit as per E-Waste (Management) Rules, 2022 and apply for
obtaining Consent to Establish (NOC expansion) as well as Consent to Operate under the
Water Act, 1974 and Air Act, 1981 by 15.12.2023.
2. The entity shall apply for obtaining authorization under the Hazardous & Other Wastes
(Management & Transboundary Movement) Rules, 2016 by 15.12.2023.
3. The entity shall apply for obtaining registration from the Centralized online EPR Portal as
mandatory under the E-Waste (Management) Rules, 2022 by 15.12.2023.
4. The entity shall submit its operational schedule to this office.
The entity shall purchase one no. Tata Ace for collection/ transportation of E-waste only
and submit its details alongwith copy of Registration Certificate (RC) to this office.
6. The entity shall organize a seminar at Nabha for Schools, Colleges, Banks and Municipal
Councils of District Patiala, Malerkotla and Sangrur for awareness under the E-Waste
(Management) Rules, 2022.
And whereas, the facility has not submitted compliance of the decision of the
hearing to the Board, so far.
And whereas, the facility is not complying with the E-Waste Rules, 2022 as well as
the provisions of the VWater Act, 1974 and the Air Act, 1981 as during visit on 31.10.2023, there
is no raw material/e-waste, no machinery such as dismantling table, shredder or separator waive
bridge within the facility and also there is no record of e-waste procured / processing available
with the facility.
And whereas, the Environmental Engineer, Regional Office, Patiala personally
visited the site of the facility two times and requested the facility representative to come at site
for verification. However, the representative of the facility has refused to get the facility visited
due to reasons best known to the facility. Also, no records are being furnished by the facility as
mandated under the E-Waste (Management) Rules, 2022.
And whereas, the facility was found not complying with the decisions of the
personal hearing given to it by the Chief Environmental Engineer of the Board on 22.11.2023 and
also not complying with the conditions of the consent to operate granted to it under the
provisions of the Water (Prevention &Control of Pollution) Act, 1974 and Air (Prevention &
Control of Pollution) Act, 1981 as well as provisions of the E-Waste (Management) Rules, 2022
and violating the provisions of the said Acts intentionally and deliberately.
The matter has been considered by the Competent Authority and it has been
decided to issue show cause notice for revocation/cancellation of the consent to operate granted
to the facility under the provisions ofthe Water (Prevention &Control of Pollution) Act, 1974 and
the Air (Prevention & Control of Pollution) Act, 1981 as well as to issue notice for issuance of
directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air
(Prevention & Control of Pollution) Act, 1981 after affording an opportunity of personal hearing,
due to aforesaid violations.
Now, therefore, the Punjab Pollution Control Board, in exercise of the powers
conferred upon it u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of
the Air (Prevention & Control of Pollution) Act, 1981 proposes to direct you as under
1 That the consent to operate granted to the facility under the provisions of the Water
(Prevention & Control of Pollution) Act, 1974 &the Air (Prevention &Control of Poilution)
Act, 1981 shall be revoked / cancelled.
2. That the facility shall take all necessary steps to close down its operations.
3. That the facility shall stop forthwith discharging any effluent/ emissions from its industrial
premises or through any mode.
4. That the facility will immediately stop its activities and will not restart the same uniless all

necessary water and air pollution control measures are taken.


5. That the Punjab State Power Corporation Ltd. authorities shall be directed to disconnect
the supply of electricity available to the facility.
6. That Environmental Compensation shall be imposed on the facility for polluting the
environment.
7 That legal action shall be initiated against the facility and its responsible persons
8. That DG sets installed by the facility shall be sealed.
As such, you are, hereby, afforded an opportunity to appear in person before the
Chairman, Punjab Pollution Control Board, Vatavarn Bhawan, Nabha Road, Patiala on
07/06/2024 at 11.00 AM to explain your failure to comply with provisions of the Water
(Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,
1981, failing which, it will be presumed that the facility has nothing to say in the matter and further
action under the provisions of the said Acts, will be taken against the industry, witheut any further
notice/ opportunity

Control Board, Regional Office, Rupnagar for information and necessary action. It is requested to
get the copy of the notice delivered to the facility through special messenger and send the
receipt of the same to this office and ensure its presence in the hearing.
