स्ट्तंभ (6) मे जर्जनर्ददष्ट खुदरा मूल्य के अधार पर ऄनुसूजचत जर्जनर्ममजतयों के जलए खुदरा मूल्य जनधावठरत करें । जनमावता औषध
(मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 24 के तहत फॉमव V में ऄजधसूचना की तारीख से एक मूल्य सूची एनपीपीए को
अइपीडीएमएस के माध्यम से जारी करें तथा ईसकी प्रजत राज्य औषजध जनयंत्रकों और जर्जनमावता जर्तरकों को जारी करें।

(घ) औषध (मूल्य जनयंत्रण) अदेि, 2013 के 24 (4) के ऄनुसार प्रत्सयेक फु टकर जर्क्रेता और जर्तरक जर्जनमावता द्वारा ददए गए
रूप में ऐसे पठरसर, जहां कारबार को आस प्रकार दकया जा रहा है दक ईससे परामिव के आच्छु क दकसी व्यजि के जलए पहुंच
असान हो, र्हां ईसके दकसी सुस्ट्पष्ट भाग पर कीमत सूची और पूरक सूची, यदद कोइ हो, को प्रदर्मित करे गा।

(ङ) ईपयुवि गैर ऄजधकतम कीमत (खुदरा मूल्य) के र्ल ईपयुवि जनमावता/जर्पणन के जलए लागू है जैसा दक ईन्होंने औषध (मूल्य
जनयंत्रण) अदेि, 2013 के तहत ऄनुबद्ध मूल्य जनधावरण/संिोधन के जलए फॉमव I पर जमा दकया गया था और सरकार द्वारा
जनधावठरत सभी लागू र्ैधाजनक अर्श्यकताओं की पूर्मत के ऄधीन प्रासंजगक जर्जधयों/जनयमों के ऄन्तगवत जैसा दक के न्रीय/राज्य
लाआसेंजसग ऑथोठरटी के सिम प्राजधकारी द्वारा मैन्यूफैक्चररग लाआसेंस मंजूरी के तहत संबंजधत जर्जनर्ममत जनमावता/जर्पणन
कम्पजनयां जो ऄनुपालन करती हैं।

(च) जर्जनमावता या जर्पणन कम्पनी, ईपरोि जर्जनर्ममजतयों और जर्जनर्ददष्ट ितों का पालन नहीं करती है तो र्े अर्श्यक र्स्ट्तुएाँ
ऄजधजनयम, 1955 के साथ पठठत डीपीसीओ, 2013 के प्रार्धानों के ऄधीन ब्याज सजहत ऄजधप्रभाठरत राजि को जमा करने
के जलए ईत्तरदायी होंगे।

(छ) आस अदेि में ईपरोि ताजलका के कॉलम (3) और (5) में तत्सस्ट्थानी प्रजर्जष्टयों में जनर्ददष्ट जर्जनमावण और जर्पणन कं पजनयों की
स्ट्रेंथ और नाम के साथ, ईपरोि ताजलका के कॉलम (2) में जनर्ददष्ट ऐसे फॉमूवलेिन के खुदरा मूल्य के जनधावरण के
पठरणामस्ट्र्रूप, कॉलम (2), (3) और (5) में तत्सस्ट्थानी प्रजर्जष्टयों में यथा जनर्ददष्ट ईस जर्जनमावण और जर्पणन कं पजनयों के
जलए जनर्ददष्ट स्ट्रेंथ के साथ फॉमूवलेिन के खुदरा मूल्य को जनधावठरत करने र्ाले कोइ मूल्य अदेि यदद आस ऄजधसूचना से पहले
जारी दकए गए हो, तो ईसे आसका स्ट्थान जलया माना जाएगा।

Note:
(a) The manufacturer of above-mentioned formulations i.e., ―new drug‖ under paragraph 2(1)(u) of the DPCO,
2013 shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or it is payable to the
Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in
accordance with the retail price specified in column (6) of the above table as per provisions contained in
paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of
Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State
Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on
business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturer / marketer as mentioned
above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated
under DPCO, 2013 and subject to fulfilment of all the applicable statutory requirements as laid down by the
Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent
Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturer/
marketing companies.
(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price
notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be
liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO,
2013 read with the Essential Commodities Act, 1955.
(g) Consequent to the fixation of retail price of such formulation as specified in column (2) of the above table
with the strength and name of Manufacturer & Marketing Companies specified in the corresponding entries
in Column (3) & (5) thereof, the price order(s) fixing the retail price of the formulation with specified
strength for that Manufacturer & Marketing Companies as specified in corresponding entries in Column (2),
(3) and (5) thereof, if any, issued prior to this notification, stand(s) superseded.

(ग) औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 11 मे ददए गए प्रार्धानों के तहत जनमावताओं को ईपयुवि सारणी के स्ट्तंभ
(6) में जर्जनर्ददष्ट खुदरा मूल्य के अधार पर ऄनुसूजचत जर्जनर्ममजतयों के जलए खुदरा मूल्य जनधावठरत करें । जनमावता औषध
(मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 24 के तहत फॉमव V में ऄजधसूचना की तारीख से एक मूल्य सूची एनपीपीए को
अइपीडीएमएस के माध्यम से जारी करें तथा ईसकी प्रजत राज्य औषजध जनयंत्रकों और जर्जनमावता जर्तरकों को जारी करें।

(घ) औषध (मूल्य जनयंत्रण) अदेि, 2013 के 24 (4) के ऄनुसार प्रत्सयेक फु टकर जर्क्रेता और जर्तरक जर्जनमावता द्वारा ददए गए
रूप में ऐसे पठरसर, जहां कारबार को आस प्रकार दकया जा रहा है दक ईससे परामिव के आच्छु क दकसी व्यजि के जलए पहुंच
असान हो, र्हां ईसके दकसी सुस्ट्पष्ट भाग पर कीमत सूची और पूरक सूची, यदद कोइ हो, को प्रदर्मित करेगा।

(ड.) ईपयुवि ईजल्लजखत ऄजधकतम कीमत (खुदरा मूल्य) के र्ल ईपयुवि जनमावता/जर्पणन के जलए लागू है जैसा दक ईन्होंने औषध
(मूल्य जनयंत्रण) अदेि, 2013 के तहत ऄनुबद्ध मूल्य जनधावरण/संिोधन के जलए फॉमव I पर जमा दकया गया था और सरकार
द्वारा जनधावठरत सभी लागू र्ैधाजनक अर्श्यकताओं की पूर्मत के ऄधीन प्रासंजगक जर्जधयों/जनयमों के ऄन्तगवत जैसा दक

S.O. 2285(E).—In exercise of the powers conferred by paragraphs 5, 11 and 15 of the Drugs (Prices Control)
Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S. O. 5249(E) dated 11th November, 2022 issued by
the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority

Note:
(a) The manufacturer of above-mentioned formulations i.e. ―new drug‖ under paragraph 2(1)(u) of the DPCO,
2013 shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or it is payable to the
Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in
accordance with the retail price specified in column (6) of the above table as per provisions contained in

paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of
Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State
Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on
business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturer / marketer as mentioned
above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated
under DPCO, 2013 and subject to fulfilment of all the applicable statutory requirements as laid down by the
Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent
Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned
manufacturer/marketing companies.
(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price
notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be
liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO,
2013 read with the Essential Commodities Act, 1955.
(g) Consequent to the fixation of retail price of such formulation as specified in column (2) of the above table
with the strength and name of Manufacturer & Marketing Companies specified in the corresponding entries
in Column (3) & (5) thereof, the price order(s) fixing the retail price of the formulation with specified
strength for that Manufacturer & Marketing Companies as specified in corresponding entries in Column (2),
(3) and (5) thereof, if any, issued prior to this notification, stand(s) superseded.

आसजलए, औषजध (मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 11 के ईप पैराग्राफ (3) और (4) द्वारा प्रदत्त िजियों के साथ,
एस.ओ. 1394 (इ) ददनांक 30 मइ, 2013 को, एस.ओ. 5249(इ) ददनांक 11 नर्ंबर, 2022 के साथ पठठत अदेि को भारत सरकार

है।

(ख) ऄगर जनमावताओं ने ईपयुवि सारणी के स्ट्तंभ (5) में र्र्मणत ऄजधकतम कीमत पर सरकार को र्ास्ट्तर् में भुगतान दकया है या
यह देय है तो र्े र्स्ट्तु एर्ं सेर्ा कर को जोड़ सकते हैं।

(ग) जनमावता औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 24 के तहत फॉमव - V में ऄजधसूचना की तारीख से ऄनुपालन में
एक मूल्य सूची जारी करे गा।

(घ) औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैरा 24 (4) के ईपबंधों के ऄनुसार प्रत्सयेक फु टकर जर्क्रेता और जर्तरक
जर्जनमावता द्वारा ददए गए रूप में ऐसे पठरसर, जहां कारोबार को आस प्रकार दकया जा रहा है दक ईससे परामषव के आच्छु क
दकसी व्यजि के जलए पहुंच असान हो, र्हां ईसके दकसी सहजदृष्य भाग पर कीमत सूची और पूरक सूची, यदद कोइ हो,
को संप्रदर्मषत करे गा।

(ङ) कोइ ऄन्य जर्जनमावता जो जसप्रोफ्लोक्साजसन 200 जमलीग्राम/100 जम.ली. को जर्जिष्ट जर्िेषताओं के साथ गैर -ललास में
पैकेज के जलए के जलए ऄलग ऄजधकतम मूल्य का दार्ा करता है तो र्ह ऄलग ऄजधकतम मूल्य ऄनुमोदन के जलए
एनपीपीए को अर्ेदन करेगा।

(च) जनर्ममत दकए गए ऄन्य जर्िेष सुजर्धाओं या दकसी ऄन्य पैक अकार के जलए जनमावता ऄपनी जर्जनर्ममजत के जनमावण के जलए
जर्जिष्ट मूल्य ऄनुमोदन हेतु एनपीपीए से संपकव करेगा।

(छ) ईपयुवि सारणी में जर्जनर्ददष्ट ऄजधकतम कीमत के जलए जर्जनर्ददष्ट ऄनुसूजचत जर्जनर्ममजतयों के जर्जनर्ददष्ट जर्जभन्न तरीके और
प्रबलता से जभन्न ऄगर मौजूदा जनमावताओं द्वारा एक नइ औषजध को लांच करता है तो ईसे पहले औषध (मूल्य जनयंत्रण)
अदेि, 2013 के पैराग्राफ 2(1)(यू) के ऄनुसार औषध (मूल्य जनयंत्रण) अदेि , 2013 के तहत सूची II में जर्जनर्ददष्ट फामव I
के माध्यम से एनपीपीए में मूल्य जनधावरण हेतु अर्ेदन करना होगा।

(ज) ईपयुवि ऄनुसूजचत फॉमूवलेिनों के जनमावता (जनमावताओं) को डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-III में ऄनुसूजचत
फॉमूवलेिनों के ईत्सपादन/अयात और जबक्री के संबंध में एनपीपीए को जतमाही ठरटनव प्रस्ट्तुत करना होगा। ईपयुवि ऄनुसूजचत
फॉमूवलेिन का ईत्सपादन बंद करने का आरादा रखने र्ाले दकसी भी जनमावता को ऄनुसूजचत फॉमूवलेिन के ईत्सपादन और/या
अयात को बंद करने के संबंध में डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-IV में बंद करने की आजच्छत तारीख से कम से
कम छह महीने पहले एनपीपीए को जानकारी प्रस्ट्तुत करनी होगी।

(झ) जर्जनमावता या जर्पणन कम्पनी, ईपरोि कजथत सारणी में दिावये ऄजधकतम मूल्य और ितों का पालन नहीं करती हैं तो र्े
अर्श्यक र्स्ट्तुएाँ ऄजधजनयम, 1955 के साथ पठठत डीपीसीओ, 2013 के प्रार्धानों के ऄधीन ब्याज सजहत ऄजधप्रभाठरत
राजि को जमा करने के जलए दायी होंगे।
(ञ) आस अदेि में ईपरोि सारणी के स्ट्तंभ (2) में की तत्सस्ट्थानी प्रजर्जष्ट में जर्जनर्ददष्ट ऐसी जर्जनर्ममजतयों के पैकों की ऄजधकतम
कीमत जनयत होने के पठरणामस्ट्र्रुप, ऄजधकतम या खुदरा मूल्य जनधावठरत अदेि यदद कोइ हो, जो दक आस अदेि से पूर्व

S.O. 2286(E).—Whereas, Ciprofloxacin Injection 200mg/100ml is scheduled formulation under Schedule-I
of DPCO 2013 and its ceiling price is fixed.
And whereas, M/s Aculife Healthcare Pvt. Ltd. has applied for separate ceiling price of Ciprofloxacin
Injection 200mg/100ml with euro head having special features like Aseptic Blow Fill Seal (ABFS) process, Low
Density Polyethylene Plastic, self- sealability, self-collapsibility and Precise Pressure Dosing System.
And whereas, the Multidisciplinary Committee of Experts in its 52nd, 53rd, 55th, 56th, 57th & 59th meetings
dated 11.07.2023, 08.08.2023, 17.10.2023, 20.12.2023, 27.02.2024 & 08.05.2024 respectively observed that
Ciprofloxacin Injection 200mg/100ml is a scheduled formulation. The Committee further observed that packages of
Ciprofloxacin Injection 200mg/100ml of M/s Aculife Healthcare Pvt. Ltd. has special features.
And whereas, the Multidisciplinary Committee of Experts recommended that an increase of 15% over and
above the ceiling price of Ciprofloxacin Injection 200mg/100ml be allowed to M/s Aculife Healthcare Pvt. Ltd. for the
formulation Ciprofloxacin Injection 200mg/100ml on account of special packaging.
And whereas, NPPA in its 124thAuthority meeting under DPCO, 2013 dated 07.06.2024 accepted the
recommendation of the Multidisciplinary Committee of Experts.
Therefore, in exercise of powers, conferred by sub paragraph (3) and (4) of paragraph 11 of the Drugs (Prices Control)
Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013, S.O. 5249(E) dated 11th November, 2022 issued by
the Government of India in the Ministry of Chemicals and Fertilizers in so far as it relates to Ciprofloxacin Injection
200mg/100ml having special features, manufactured by the manufacturer specified in Table ‗B‘, the National
Pharmaceutical Pricing Authority (hereinafter referred as NPPA) hereby fixes the price as specified in column (5) of
the Table ‗A‘ herein below as ceiling price exclusive of Goods and Services Tax applicable, if any, in respect of the
Scheduled formulation specified in the corresponding entry in column (2) of the Table A with the dosage form,
strength and packaging and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

(a) The ceiling price specified in column (5) of Table A is applicable only to the manufacturer mentioned in
Table B. The manufacturer specified in Table B, selling the branded or generic or both the versions of
scheduled formulations with dosage form and strength specified in column (2) and (3) of Table A
respectively, at a price higher than the ceiling price (plus Goods and Services Tax as applicable) so fixed
and notified by the Government, shall revise their prices of all such formulations downward not exceeding
the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or if it is payable to the
Government on the ceiling price mentioned in column (5) of the above said table.
(c) The manufacturer shall issue a price list in Form-V in compliance from date of this notification as per
paragraph 24 of the DPCO, 2013.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries
on business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) Any other manufacturer claiming separate ceiling price having special feature of Ciprofloxacin Injection
200mg/100ml in 100ml for packages in non-glass with special features shall apply to NPPA for separate
ceiling price approval.
(f) For other special features claimed or any other pack size manufactured, the manufacturer shall approach
the NPPA for specific price approval for its formulation.
(g) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in
the above Table A, launches a new drug as per paragraph 2(1) (u) of the DPCO, 2013 such existing
manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified
under Schedule-II of the DPCO, 2013.
(h) The manufacturer(s) of above said scheduled formulations shall furnish quarterly return to the NPPA, in
respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO,
2013. Any manufacturer intending to discontinue production of above said scheduled formulation shall
furnish information to the NPPA, in respect of discontinuation of the production and / or import of
scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the
intended date of discontinuation.
(i) The manufacturer(s) not complying with the ceiling price and notes specified hereinabove shall be liable
to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Price
Control) Order, 2013 read with Essential Commodities Act, 1955.
(j) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above
Table A in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above
said date of notification, stand(s) superseded.

नोट:

और लागू स्ट्थानीय कर, यदद कोइ हो, ऐसे सभी जर्जनर्ममती की कीमतों को संिोजधत करे गा जो ऄजधकतम सीमा से ऄजधक
नहीं है।

(ख) ऄगर जनमावताओं ने ईपयुवि सारणी के स्ट्तंभ (5) में र्र्मणत ऄजधकतम कीमत पर सरकार को र्ास्ट्तर् में भुगतान दकया है या
यह देय है तो र्े र्स्ट्तु एर्ं सेर्ा कर को जोड़ सकते हैं।

(ग) जनमावता औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 24 के तहत फॉमव- V में ऄजधसूचना की तारीख से ऄनुपालन में
एक मूल्य सूची जारी करे गा।

(घ) औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैरा 24 (4) के ईपबंधों के ऄनुसार प्रत्सयेक फु टकर जर्क्रेता और जर्तरक
जर्जनमावता द्वारा ददए गए रूप में ऐसे पठरसर, जहां कारोबार को आस प्रकार दकया जा रहा है दक ईससे परामषव के आच्छु क
दकसी व्यजि के जलए पहुंच असान हो, र्हां ईसके दकसी सहजदृष्य भाग पर कीमत सूची और पूरक सूची, यदद कोइ हो,
को संप्रदर्मषत करे गा।

(ङ) कोइ ऄन्य जर्जनमावता जो 500 जमली पैक में डेक्सरोज आं जेक्िन (25% डब्ल्यू / र्ी) के जलए ऄलग से ऄजधकतम मूल्य का
दार्ा करता है, जजसमें जर्िेष जर्िेषता है, ईसे ऄलग से ऄजधकतम मूल्य ऄनुमोदन के जलए एनपीपीए में अर्ेदन करना
होगा।

(च) जनर्ममत दकए गए ऄन्य जर्िेष सुजर्धाओं या दकसी ऄन्य पैक अकार के जलए जनमावता ऄपनी जर्जनर्ममजत के जनमावण के जलए
जर्जिष्ट मूल्य ऄनुमोदन हेतु एनपीपीए से संपकव करेगा।

(छ) ईपयुवि सारणी ए में जर्जनर्ददष्ट ऄजधकतम कीमत के जलए जर्जनर्ददष्ट ऄनुसूजचत जर्जनर्ममजतयों के जर्जनर्ददष्ट जर्जभन्न तरीके
और प्रबलता से जभन्न ऄगर मौजूदा जनमावताओं द्वारा एक नइ औषजध को लांच करता है तो ईसे पहले औषध (मूल्य
जनयंत्रण) अदेि, 2013 के पैराग्राफ 2(1)(यू) के ऄनुसार औषध (मूल्य जनयंत्रण) अदेि, 2013 के तहत ऄनुसूची II में
जर्जनर्ददष्ट फामव I के माध्यम से एनपीपीए में मूल्य जनधावरण हेतु अर्ेदन करना होगा।

(ज) ईपयुवि ऄनुसूजचत फॉमूवलेिनों के जनमावता (जनमावताओं) को डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-III में ऄनुसूजचत
फॉमूवलेिनों के ईत्सपादन/अयात और जबक्री के संबंध में एनपीपीए को जतमाही ठरटनव प्रस्ट्तुत करना होगा। ईपयुवि ऄनुसूजचत
फॉमूवलेिन का ईत्सपादन बंद करने का आरादा रखने र्ाले दकसी भी जनमावता को ऄनुसूजचत फॉमूवलेिन के ईत्सपादन और/या
अयात को बंद करने के संबंध में डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-IV में बंद करने की आजच्छत तारीख से कम से
कम छह महीने पहले एनपीपीए को जानकारी प्रस्ट्तुत करनी होगी।

(झ) जो जनमावता (जनमावता) उपर जनर्ददष्ट ऄजधकतम मूल्य और ठटटपजणयों का ऄनुपालन नहीं करते हैं , ईन्हें अर्श्यक र्स्ट्तु
ऄजधजनयम, 1955 के साथ पठठत औषजध (मूल्य जनयंत्रण) अदेि, 2013 के प्रार्धानों के ऄंतगवत ऄजधक र्सूली गइ राजि
ब्याज सजहत जमा करानी होगी।

(ञ) आस ऄजधसूचना में ईपयुवि सारणी (ए) के कॉलम (2) में जनर्ददष्ट ऐसे फॉमूवलेिनों की ऄजधकतम कीमतों के जारी होने के
पठरणामस्ट्र्रूप, ऄजधसूचना की ईपयुवि तारीख से पहले जारी दकए गए ऄजधकतम या खुदरा मूल्य, यदद कोइ हो, को
जनधावठरत करने र्ाले मूल्य अदेि स्ट्र्तः ही समाप्त हो जाएंगे।

S.O. 2289(E).—In exercise of powers, conferred by sub paragraph (3) and (4) of paragraph 11, 14 and 16 of
the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30 th May, 2013, S.O. 5249(E) dated 11th
November, 2022 and S.O. 1557(E) dated 26th March 2024 issued by the Government of India in the Ministry of
Chemicals and Fertilizers in relation to formulation and packs mentioned in the Table A below, manufactured by the
manufacturers specified in Table B for specified products and pack-sizes, the National Pharmaceutical Pricing
Authority, hereby fixes the price as specified in column (5) of the Table A herein below as separate ceiling price
exclusive of Goods and Services Tax applicable, if any, in respect of the scheduled formulations specified in the
corresponding entry in column (2) of the Table A with the dosage form, strength and packaging and unit specified
respectively in the corresponding entries in columns (3) and (4) thereof:

Note:
(a) The ceiling price specified in column (5) of Table A is applicable only to the manufacturer mentioned in
Table B. The manufacturer specified in Table B, selling the branded or generic or both the versions of
scheduled formulations with dosage form and strength specified in column (2) and (3) of Table A
respectively, at a price higher than the ceiling price (plus Goods and Services Tax as applicable) so fixed
and notified by the Government, shall revise their prices of all such formulations downward not exceeding
the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or if it is payable to the
Government on the ceiling price mentioned in column (5) of the above said table.
(c) The manufacturer shall issue a price list in Form-V in compliance from date of this notification as per
paragraph 24 of the DPCO, 2013.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries
on business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) Any other manufacturer claiming separate ceiling price for Dextrose Injection (25% w/v) in 500 ml pack
having special feature shall apply to NPPA for separate ceiling price approval.
(f) For other special features claimed or any other pack size manufactured, the manufacturer shall approach
the NPPA for specific price approval for its formulation.
(g) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in
the above Table A, launches a new drug as per paragraph 2 (1)(u) of the DPCO, 2013 such existing
manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified
under Schedule-II of the DPCO, 2013.
(h) The manufacturer(s) of above said scheduled formulations shall furnish quarterly return to the NPPA, in
respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO,
2013. Any manufacturer intending to discontinue production of above said scheduled formulation shall
furnish information to the NPPA, in respect of discontinuation of the production and / or import of
scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the
intended date of discontinuation.
(i) The manufacturer(s) not complying with the ceiling price and notes specified hereinabove shall be liable
to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Price
Control) Order, 2013 read with Essential Commodities Act, 1955.
(j) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above
Table A in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above
said date of notification, stand(s) superseded.

(ग) जनमावता औषध (मूल्य जनयंत्रण) अदेि, 2013 के पैराग्राफ 24 के तहत फॉमव- V में ऄजधसूचना की तारीख से ऄनुपालन में
एक मूल्य सूची जारी करे गा।

जजसमें जर्िेष जर्िेषता है, तो ईसे ऄलग से ऄजधकतम मूल्य ऄनुमोदन के जलए एनपीपीए में अर्ेदन करना होगा।

(च) जनर्ममत दकए गए ऄन्य जर्िेष सुजर्धाओं या दकसी ऄन्य पैक अकार के जलए जनमावता ऄपनी जर्जनर्ममजत के जनमावण के जलए
जर्जिष्ट मूल्य ऄनुमोदन हेतु एनपीपीए से संपकव करेगा।

(छ) ईपयुवि सारणी में जर्जनर्ददष्ट ऄजधकतम कीमत के जलए जर्जनर्ददष्ट ऄनुसू जचत जर्जनर्ममजतयों के जर्जनर्ददष्ट जर्जभन्न तरीके और
प्रबलता से जभन्न ऄगर मौजूदा जनमावताओं द्वारा एक नइ औषजध को लांच करता है तो ईसे पहले औषध (मूल्य जनयंत्रण)
अदेि, 2013 के पैराग्राफ 2(यू) के ऄनुसार औषध (मूल्य जनयंत्रण) अदेि, 2013 के तहत ऄनुसूची II में जर्जनर्ददष्ट फामव I
के माध्यम से एनपीपीए में मूल्य जनधावरण हेतु अर्ेदन करना होगा।

(ज) ईपयुवि ऄनुसूजचत फॉमूवलेिनों के जनमावता (जनमावताओं) को डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-III में ऄनुसूजचत
फॉमूवलेिनों के ईत्सपादन/अयात और जबक्री के संबंध में एनपीपीए को जतमाही ठरटनव प्रस्ट्तुत करना होगा। ईपयुवि ऄनुसूजचत
फॉमूवलेिन का ईत्सपादन बंद करने का आरादा रखने र्ाले दकसी भी जनमावता को ऄनुसूजचत फॉमूवलेिन के ईत्सपादन और/या
अयात को बंद करने के संबंध में डीपीसीओ, 2013 की ऄनुसूची-II के फॉमव-IV में बंद करने की आजच्छत तारीख से कम से

(ञ) आस ऄजधसूचना में ईपयुवि सारणी (ए) के कॉलम (2) में जनर्ददष्ट ऐसे फॉमूवलेिनों की ऄजधकतम कीमतों के जारी होने के
पठरणामस्ट्र्रूप, ऄजधसूचना की ईपयुवि तारीख से पहले जारी दकए गए ऄजधकतम या खुदरा मूल्य, यदद कोइ हो, को

New Delhi, the 14th June, 2024
S.O. 2290(E).—In exercise of powers, conferred by sub paragraph (3) and (4) of paragraph 11, 14 and 16 of
the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30 th May, 2013, S.O. 5249(E) dated
11th November, 2022 and S.O. 1556(E) dated 26th March, 2024 issued by the Government of India in the Ministry of
Chemicals and Fertilizers, in relation to formulation and packs mentioned in the Table A below, manufactured by the
manufacturers specified in Table B for specified products and pack-sizes, the National Pharmaceutical Pricing
Authority, hereby fixes the price as specified in column (5) of the Table A herein below as separate ceiling price
exclusive of Goods and Services Tax applicable, if any, in respect of the scheduled formulations specified in the
corresponding entry in column (2) of the Table A with the dosage form, strength and packaging and unit specified
respectively in the corresponding entries in columns (3) and (4) thereof:

Note:
(a) The ceiling price specified in column (5) of Table A is applicable only to the manufacturer mentioned in
Table B. The manufacturer specified in Table B, selling the branded or generic or both the versions of

scheduled formulations with dosage form and strength specified in column (2) and (3) of Table A
respectively, at a price higher than the ceiling price (plus Goods and Services Tax as applicable) so fixed
and notified by the Government, shall revise their prices of all such formulations downward not exceeding
the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or if it is payable to the
Government on the ceiling price mentioned in column (5) of the above said table.
(c) The manufacturer shall issue a price list in Form-V in compliance from date of this notification as per
paragraph 24 of the DPCO, 2013.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries
on business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) Any other manufacturer claiming separate ceiling price for Mannitol Injection 20% in 350 ml pack having
special feature shall apply to NPPA for separate ceiling price approval.
(f) For other special features claimed or any other pack size manufactured, the manufacturer shall approach
the NPPA for specific price approval for its formulation.
(g) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in
the above Table A, launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing
manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified
under Schedule-II of the DPCO, 2013.
(h) The manufacturer(s) of above said scheduled formulations shall furnish quarterly return to the NPPA, in
respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO,
2013. Any manufacturer intending to discontinue production of above said scheduled formulation shall
furnish information to the NPPA, in respect of discontinuation of the production and / or import of
scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the
intended date of discontinuation.
(i) The manufacturer(s) not complying with the ceiling price and notes specified hereinabove shall be liable
to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Price
Control) Order, 2013 read with Essential Commodities Act, 1955.
(j) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above
Table A in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above
said date of notification, stand(s) superseded.
