2. a. ‘A’, a girl, was a Christian by birth declares herself as a Hindu
and lives as a Hindu. She marries 'B' a Hindu boy according to
the Hindu rites and rituals. After 2 years 'B' started living 4

separately. Decide whether ‘A’ is a Hindu or not with the help of
relevant provisions and case laws.

OR
b. ‘A’, a Jain boy, married 'B' a Christian girl and begot a child 'C'.
'C' was in the care and custody of 'B' ever since his birth as the
relation between ‘A’ and 'B' was strained. 'B' brought up the 4

child 'C' according to Christian values. Decide the religious
status of 'C' with the help of relevant provisions and case laws.

UNIT-II
3. a. Explain the essentials of a valid marriage under the Hindu
Marriage Act, 1955. 12 2

b. Examine the grounds of divorce under the Hindu Marriage Act,
1955 in brief. 12 2

4. a. ‘A’, husband of 'B' comes home drunk, physically and verbally


abuses wife 'B' in front of his parents and relatives. Unable to 08 4
bear this all, 'B' wants to obtain divorce from ‘A’. Decide

whether 'B' will succeed in getting divorce from ‘A’, with the
help of relevant provisions and case laws.

b. ‘A’ and 'B' are husband and wife respectively. 'A' persistently
forced 'B' to bring gold jewellery, refrigerator and washing
machine from her parents. When 'B' refused to meet ‘A’s
demands, he physically abused her. 'B' wants to file a case 08 3
against ‘A’. Advise 'B' with the help of relevant provisions and
case laws.

UNIT-III
5. a. Elucidate the effects of adoption under the Hindu Adoptions and
Maintenance Act, 1956. 12 4

b. Analyse the provisions related to maintenance under section 18
of the Hindu Adoptions and Maintenance Act, 1956. 12 4

6. a. ‘A’ and 'B' are husband and wife respectively. They obtained
divorce. They had an 8 year old son. ‘A’ was working as a
software engineer and handsomely salaried. 'B' is an MBA
graduate, unemployed and has serious health issues. Dispute
arose between ‘A’ and 'B' regarding the custody of their son. ‘A’ 08 3
filed a law-suit in the Family Court to claim custody of his son.
Decide whether ‘A’ will succeed in the above suit with the help
of case laws and provisions.

b. 'A' adopts 'C', a 4 years old boy, without the consent of his wife
'B'. Is this adoption valid? Decide with reasons. 08 4

7. a. Examine the various modes of partition.

8. a. ‘A’, the Karta of a Hindu joint family has two sons and one
daughter. ‘A’ gifted 1 acre of land out of 30 acres of joint family
property to his daughter at the time of marriage. ‘A’s sons
challenge this gift in the court as not being within the powers of 08 4
‘A’ as Karta. Decide whether the two sons will succeed in their
action with the help of relevant case laws.

b. ‘A’, the Karta and his four married sons partition amongst 08 4

themselves, the joint family property. When this partition took
place, ‘A’s wife was pregnant with the 5th child. After the birth
of this child named ‘F’, ‘F’ wants to reopen partition which took
place between his father and four elder brothers. Can ‘F’ succeed
in doing so? Decide with the help of decided cases.

UNIT-V
9. a. Examine stridhana under section 14 of the Hindu Succession 4
Act, 1956. 12

b. Analyse the general rules of succession to the property of Hindu 4
male dying intestate under the Hindu Succession Act, 1956. 12

10. a. ‘A’ dies leaving behind his sons 'B' and 'C' and widow 'W'. ‘A’ 5
has left behind 12 acres of agricultural land. Divide this land

between 'B' 'C' and 'W'.

b. ‘A’ has left behind two widows and a son of first (eldest) widow. 4
What shares are they entitled to in the property belonging to ‘A’? 08
